Appropriates moneys to Oregon Health Authority to allocate to community mental health programs for oversight of residential facilities and for conducting abuse investigations. Declares emergency, effective July 1, 2023.
Provides that contract for certain services related to fitness to proceed must require provider to maintain professional and commercial liability insurance. Appropriates moneys to Oregon Department of Administrative Services to reimburse local governments, community mental health programs and providers for payment of awards, settlements and expenses incurred in civil actions arising out of services. Directs department to study barriers to obtaining liability insurance and report to appropriate committee or interim committee of Legislative Assembly no later than February 1, 2024. Declares emergency, effective on passage.
Appropriates moneys from General Fund to Oregon Department of Administrative Services for purposes of deposit in Universal Representation Fund. Appropriates moneys from General Fund to Judicial Department for purposes of transfer to Oregon State Bar for purposes of use by Legal Services Program to provide legal services to individuals on immigration matters. Declares emergency, effective on passage.
Requires Department of Consumer and Business Services to study how to build efficiency and resiliency into buildings. Directs department to submit findings to interim committees of Legislative Assembly related to environment not later than September 15, 2024. ] Specifies requirements for energy savings performance contract and provides that contracting agency may solicit and award energy savings performance contract without competitive process and without requirement to issue request for proposals but may award energy savings performance contract only to qualified energy service company. Requires Oregon Department of Administrative Services to cooperate with State Department of Energy to develop methodology and work plan for state agencies to conduct assessment of energy use in, and greenhouse gas emissions from, state-owned buildings. Specifies requirements for assessments. Requires departments to create searchable and modifiable database with data collected from state agencies and to use baseline data from database to plan energy use reduction and greenhouse gas emission reduction targets in capital projects. Requires Oregon Department of Administrative Services, with support from State Department of Energy, to oversee specified capital projects and to develop and implement guidelines for sustainable design and provide guidance and technical expertise to state agencies with respect to construction methods, materials, energy conservation measures, greenhouse gas emission reduction methods, and other techniques and technologies. Requires state agencies to report regularly to Oregon Department of Administrative Services concerning progress on capital projects and toward meeting specified goals. Authorizes state agencies to enter into energy generation projects at state-owned or state rented facilities and to retain 100 percent of net savings from project. Takes effect on 91st day following adjournment sine die.
Requires Oregon Department of Administrative Services to establish pilot program for evaluating use of challenge-based procurement to conduct certain information technology procurements. Specifies features that pilot program must have. Requires contracting agencies that use challenge-based procurement method to provide sufficient information to department to allow department to evaluate and report results of pilot program to Governor and to interim committees of Legislative Assembly related to public procurement not later than December 31, 2025. Sunsets January 2, 2026. Takes effect on 91st day following adjournment sine die.
Proposes amendment to Oregon Constitution to enumerate examples of rights, the denial or abridgement of which would violate existing constitutional guarantee of equality of rights. Makes conforming change to repeal constitutional policy of marriage being between one man and one woman. Refers proposed amendment to people for their approval or rejection at special election held on same date as next regular general election.
Prohibits state from paying costs of travel to or from Oregon for employee in state service who telecommutes from principal worksite more than 60 miles outside this state , unless collective bargaining agreement provides otherwise or essential requirements of position make it necessary for employee to telecommute from outside this state .
Provides employee with right to refuse to perform task assigned by employer under certain circumstances. Protects employee against disciplinary action for exercising right. ] Prohibits employer from retaliating or discriminating against employee for invoking right ] or prospective employee who, in good faith and with no reasonable alternative, refuses exposure arising from hazardous condition at place of employment . Allows employee to use sick leave to cover period when employee is not working due to employee's exercising right to refuse to perform assigned task. ] Requires Director of Department of Consumer and Business Services to adopt rules to implement provisions of Act that are in accordance with federal Occupational Safety and Health Act.
Permits adopted former foster children to have amount of tuition and all fees waived if attending defined institutions of higher education for purposes of pursuing initial undergraduate degree. Defines "adopted former foster child." Permits adopted former foster children previously ineligible for waiver of tuition due to being adopted to be eligible for waiver if adoption occurred on or after January 1, 2012. Declares emergency, effective on passage.
Expands types of prior convictions that increase offense level for crime of public indecency. Modifies crime of luring a minor to include engaging in sexual conduct in immediate presence of minor for purposes of inducing minor to engage in sexual conduct.
