Sen. Kim Thatcher

Requires health care practitioner to exercise proper degree of care to preserve health and life of child born alive after abortion or attempted abortion. Requires health care practitioner to ensure child born alive is transported to hospital. Creates crime for failure to exercise proper standard of care, punishable by maximum of five years' imprisonment, $125,000 fine, or both. Allows specified person to bring civil action for damages and equitable relief against health care practitioner for failure to exercise proper standard of care. Directs court to award attorney fees to prevailing plaintiff. Allows court to order identity or personally identifiable information of specified person protected from disclosure.

Requires committees and subcommittees of Senate and House of Representatives, and joint committees and subcommittees of Legislative Assembly, to accept remote testimony given by telephonic or electronic means. Requires Legislative Policy and Research Director to post on legislative website procedures witnesses may follow to testify remotely. Requires director to post procedures within seven calendar days of adoption of resolution.

Grants higher property tax exemption for property of veterans with service-connected disabilities. Grants exemption for veteran's surviving spouse who remains unmarried. Takes effect on 91st day following adjournment sine die.

Creates income tax subtraction for recovery rebates paid to personal income taxpayers. Directs Department of Revenue to make refund payments of overpayments due to operation of subtraction as soon as practicable. Applies to tax years beginning on or after January 1, 2020, and before January 1, 2022. Takes effect on 91st day following adjournment sine die.

Requires State Forestry Department to conduct program of loan guarantees to assist persons with financing cost of replacing logging equipment lost in wildfire.

Requires State Forester to carry out appraisal and sale of forest products on state-owned forestland damaged by wildfire.

Proposes amendment to Oregon Constitution to require vote of at least two-thirds of all members elected to each House of Legislative Assembly to pass bills during even-numbered year regular session of Legislative Assembly. Refers proposed amendment to voters for their approval or rejection at next regular general election.

Increases criminal and civil penalties for subsequent and intentional violations of specified election laws. Enhances penalties if person committing violation is public official acting in official capacity.

Modifies standards for judicial review of agency rules and orders.

Directs Department of Education to establish voucher program for students from low-performing schools. Establishes Department of Education Voucher Account. Continuously appropriates moneys to Department of Education for payment of department's expenses under program. Establishes Treasurer Voucher Account. Continuously appropriates moneys to State Treasurer for payment of treasurer's expenses under program. Establishes Oregon Voucher Account within State School Fund. Continuously appropriates moneys to Department of Education for purpose of making transfers under program. Declares emergency, effective on passage.
