Sen. David Smith

Authorizes counties to allow contiguous clustered nonresource dwellings on clustered development tract in lieu of approval of individual nonresource dwellings on farm, forest or mixed farm and forest use. Allows bonus dwellings when dwellings are sited on low value soil or with shared water or sewage systems. Establishes requirements for siting and approving dwellings and subdividing or partitioning clustered development tracts.

Directs Oregon Department of Administrative Services to engage independent auditor to analyze expenditures from Drug Treatment and Recovery Services Fund for mental health purposes. Requires department to report to Legislative Assembly after completion of audit.

Appropriates $50 million to State Forestry Department to fund increased forest thinning operations in specified wildfire-prone counties. Directs department to allocate $5 million to fund forest thinning operations on public lands located in each wildfire-prone county. Requires department to confer with county governing body of each county to determine which specific forest thinning operations to fund. Declares emergency, effective on passage.

Prohibits Department of Justice from charging officers and agencies of state government for assistance rendered. Directs department to pay for costs of assistance rendered to officers and agencies of state government out of funds appropriated to department for that purpose. Becomes operative on July 1, 2025. Provides that department may not enter into or renew collective bargaining agreement that permits job classification or evaluation on basis of hours billed by attorney. Allows department to track billable hours only for purposes of reimbursement.

Appropriates moneys from General Fund to Oregon Department of Administrative Services for distribution to Beacon Broadband for development of broadband service infrastructure in southern Oregon coast region.

Expands attorney fee award for prevailing applicants to include any person developing needed housing whose approval is appealed to Land Use Board of Appeals.

Defines "victim" for purposes of release of sex offender information by Department of State Police.

Requires person who operates website or online service for commercial purposes that collects consumers' personally identifiable information to develop, maintain and implement data management practices policy and post policy or link to policy prominently on website or online service home page. Specifies minimum policy requirements. Makes violation of Act unlawful practice under Unlawful Trade Practices Act.

Prohibits Department of Environmental Quality from imposing effluent limitations or other requirements in seafood processing wastewater permit that are more stringent than requirements established under federal law or that would result in substantial and widespread economic and social impacts on coastal communities. Takes effect on 91st day following adjournment sine die.

Prohibits individual from collecting and returning ballot of another individual, subject to specified exceptions.
