Changes name of Early Learning Division to Department of Early Learning and Care. Establishes Department of Early Learning and Care as state agency that is separate from Department of Education and that functions under, and is coordinated by, Early Learning Council. Prescribes expanded duties, functions and powers of Department of Early Learning and Care, including administration of Employment Related Day Care. Modifies requirements of Employment Related Day Care. Directs Early Learning Division, Department of Education and Department of Human Services to develop and implement plans for seamless transfer of relevant duties, functions and powers, and to report on plans to appropriate interim committees of Legislative Assembly. Revises goals of statewide early learning system. Modifies membership and duties of State Interagency Coordinating Council. Declares emergency, effective on passage.

Establishes regulations for kratom products, including testing standards, labeling requirements and minimum age for sale. Prohibits sale of kratom products unless kratom product derives from processor registered with State Department of Agriculture. Directs department to adopt rules to carry out regulations. Authorizes imposition of civil penalty for certain violations. Creates crime of unlawful distribution, sale or exposure for sale to individual under 21 years of age. Punishes by maximum of 30 days' imprisonment, $1,250 fine, or both. Appropriates moneys from General Fund to State Department of Agriculture for carrying out provisions of Act. Requires Director of Oregon Health Authority to work with Alcohol and Drug Policy Commission to take statewide inventory of services available to prevent and treat substance use disorders and to support individuals in recovery from substance use disorders. Specifies requirements for inventory. Requires Director of Alcohol and Drug Policy Commission to report findings to interim committees of Legislative Assembly related to mental and behavioral health by November 1, 2021. Sunsets January 2, 2023. Expands designated state agencies that must work with commission and requires agencies to meet with commission quarterly to review and report on each agency's progress and to report process and outcome measures established under commission's comprehensive addiction, prevention, treatment and recovery plan. Requires marijuana testing laboratory employee to obtain worker permit from Oregon Liquor Control Commission. Defines "premises" for purposes of marijuana testing laboratories. Allows applicant for worker permit who successfully passes permit examination to temporarily perform work for licensee or laboratory prior to receiving worker permit. Becomes operative January 1, 2022. Directs Oregon Liquor Control Commission to establish by rule process to register medical marijuana grow sites. Defines "medical marijuana grow site." Allows medical marijuana grow sites to apply for registration no later than June 1, 2022. Establishes plant production limits for medical marijuana grow sites registered by commission. Specifies that marijuana grow sites registered by Oregon Health Authority may produce marijuana for no more than two registry identification cardholders. ] Allows authority to specify marijuana item testing batch size up to 50 pounds. ] Allows commission to allow certain licensed marijuana retailers to relocate to other premises without obtaining new license. Allows marijuana processor to transfer, sell or transport specified industrial hemp commodity or product to person that is not licensed by commission. Becomes operative January 1, 2022. Directs Oregon Criminal Justice Commission to establish, in collaboration with Department of Corrections, Family Preservation Project pilot program at Coffee Creek Correctional Facility. Provides that program shall be administered by YWCA of Greater Portland. Specifies goals of program and services that may be provided. Requires commission to perform analysis of program and report results of analysis to Legislative Assembly beginning September 15, 2024, and every two years thereafter. Appropriates moneys to Oregon Criminal Justice Commission for distribution to YWCA of Greater Portland for purposes of program. Sunsets program on January 1, 2029. Declares emergency, effective on passage.
