Rep. Bobby Levy

Removes limitation on percentage of students in school district who may enroll in virtual public charter school not sponsored by school district without first receiving approval from school district. Establishes open enrollment process for school districts to allow students to attend schools in nonresident school district with consent of receiving school district. Directs district school boards to adopt and implement policy that provides for establishment of education savings accounts for students who are considered residents in school district to use for educational expenses.

Authorizes landowners who meet certain criteria to petition for formation of predator damage control district as funding mechanism to pay actual costs to county of preventing, reducing and mitigating damage to property from predatory animals. Defines "prevent, reduce and mitigate damage to property from predatory animals" to include both lethal and nonlethal methods of prevention, reduction and mitigation. Establishes presumptive charges of $2 per acre for tax lots of 10 or more acres and $50 flat rate charge for tax lots of less than 10 acres. Creates cause of action under district program for counties, landowners, districts and cities involved in program. Takes effect on 91st day following adjournment sine die.

Instructs State Forester to analyze certain criteria before adopting rule changing management of state forest lands. Instructs State Forester to annually report to committee or interim committee of Legislative Assembly related to natural resources on projected revenues from state forest lands and degree to which forest management decisions affect projected revenues. Declares emergency, effective on passage.

Creates income and corporate excise tax credits for investments in facilities used for manufacturing, siting of headquarters or research. Enhances credit amount for facility that provides environmental benefit. Applies to tax years beginning on or after January 1, 2024, and before January 1, 2030. Takes effect on 91st day following adjournment sine die.

Restores criminal penalties for possession of controlled substance offenses to level prior to enactment of Drug Addiction Treatment and Recovery Act of 2020 (Ballot Measure 110 (2020)) when person has been previously cited for Class E violation for possession of controlled substance. Provides that person charged with crime, who would otherwise have been charged with Class E violation pursuant to Ballot Measure 110 (2020), is eligible for diversion upon first charge after previous citation and for any drug court offered in county upon second charge.

Recognizes and honors Robin A. Church for her outstanding service to people of Oregon.

Requires practitioner to query electronic prescription monitoring system with respect to patient prior to issuing to, or renewing for, patient prescription for certain prescription drugs. Takes effect on 91st day following adjournment sine die.

Requires school districts to develop, review and revise individualized suicide prevention protection plan for each youth who demonstrates suicidal behavior. Requires State Board of Education, in consultation with Oregon Health Authority, to adopt rules for school districts to implement individualized suicide prevention protection plans and adopt standard form for use in developing for youth individualized suicide prevention protection plan. Requires Department of Education and Oregon Health Authority to maintain record of all individualized suicide prevention protection plans developed. Requires school district's plan on student suicide prevention to include training for all school employees in preventing suicide. Directs Oregon Health and Science University to convene work group to examine ways to improve individualized suicide prevention protection plans and manage disruptive classroom environments during a behavioral or mental health crisis. Directs university to submit report on work group's findings and recommendations to interim committees of Legislative Assembly related to education and human services no later than September 15, 2024.

Requires public schools to take special care to ensure that instruction is provided in neutral manner that focuses on academic subject matter and does not advocate personal views of educator. Prohibits State Board of Education from adopting rules that promote stance or otherwise show support for or against political movement or group that is attempting to change government policy or social values. Requires faculty and other employees at community colleges and public universities who provide instruction to students to ensure that instruction is provided in neutral manner that focuses on academic subject matter and does not promote stance or otherwise show support for or against political movement or group that is attempting to change government policy or social values.

Directs Department of Education to conduct study to identify sources of funding to pay for costs of establishing secure, single point of entry for each public school and to determine if costs may be covered in seismic rehabilitation projects. Directs department to submit report to interim committee of Legislative Assembly no later than September 15, 2024. Sunsets January 2, 2025. Declares emergency, effective on passage.
