Directs Oregon Criminal Justice Commission to conduct study on criminal sentencing outcomes and present report on findings to interim committees of Legislative Assembly related to judiciary on or before September 15, 2020. Sunsets January 2, 2021.
Provides that Water Resources Commission has certain amount of time to enforce general or special standards related to well construction activities. Establishes Task Force on Oregon Well Construction Enforcement Activities. Sunsets task force on December 31, 2020. Takes effect on 91st day following adjournment sine die.
Extends sunset for tax credit for crop donation. Increases percentage of wholesale price allowed as amount of credit. Applies to tax years beginning on or after January 1, 2019. Takes effect on 91st day following adjournment sine die.
Requires health care practitioner to exercise proper degree of care to preserve health and life of child born alive after abortion or attempted abortion. Requires health care practitioner to ensure child born alive is transported to hospital. Creates crime for failure to exercise proper standard of care, punishable by maximum of five years' imprisonment, $125,000 fine, or both. Allows specified person to bring civil action for damages and equitable relief against health care practitioner for failure to exercise proper standard of care. Directs court to award attorney fees to prevailing plaintiff. Allows court to order identity or personally identifiable information of specified person protected from disclosure.
Increases total amount allowed in tax year to all taxpayers as tax credits for donations to fiduciary organizations for distribution to individual development accounts. Increases maximum percentage of taxpayer donation for which credit may be allowed. Applies to tax years beginning on or after January 1, 2019, and before January 1, 2022. Updates and makes technical corrections to statutes governing individual development accounts. Takes effect on 91st day following adjournment sine die.
Requires that State Board of Parole and Post-Prison Supervision hearings be presided over by hearings officer. Specifies procedures for review by board and issuance of final order. Modifies contested case procedures applicable to board proceedings.
Prohibits abortion unless physician has first determined probable post-fertilization age of unborn child, except in case of medical emergency. Prohibits abortion of unborn child with probable post-fertilization age of 20 or more weeks, except in case of medical emergency. Requires physician who performs or induces, or attempts to perform or induce, abortion to file report, within 30 days, with Oregon Health Authority. Requires authority to publish annually statistics relating to abortion.
Requires person that provides mental health care or services to prevent substance abuse to make certain disclosures in any advertisement for or following any communication regarding person's services or facilities. Prohibits person from paying or accepting compensation for referring or referral of resident of this state for mental health care or services to prevent substance abuse. Provides that failure to comply with or violation of Act is unlawful practice under Unlawful Trade Practices Act. Becomes operative on January 1, 2020. Takes effect on 91st day following adjournment sine die.
Allows State Forester to order use of wildfire suppression personnel, equipment and services on any ] federal lands within state borders. Creates exceptions.
Provides that hours worked by school marshal providing security in school do not count for purposes of limitations on reemployment of retired member of Public Employees Retirement System.
