Relating to railroad-highway grade crossing safety.

Prohibits willfully obstructing, blockading, interfering with or preventing use of railroad-highway grade crossing for longer than 10 consecutive minutes. Provides exemptions. Imposes civil penalty for each violation. Provides that maximum penalty is $3,000 for first violation. Directs Department of Transportation to adopt by rule schedule of penalties for second and subsequent violations.

Relating to notification requirements for structures located within 1,000 feet of an interstate pipeline; prescribing an effective date.

Requires person that proposes to construct building or structure located within 1,000 feet of interstate pipeline to notify owner or operator of interstate pipeline. Prohibits state agency or municipality from issuing building permit for building or structure unless agency or municipality receives copy of notice and copy of reply from owner or operator of interstate pipeline. Requires owner or operator of interstate pipeline each year to provide contact information to Oregon Utility Notification Center. Takes effect on 91st day following adjournment sine die.

Relating to motorboats; prescribing an effective date.

Provides that maximum loading weight of motorboat must be less than 4,000 pounds to obtain towed watersports motorboat certificate. Authorizes State Marine Board to conduct study related to increasing prescribed maximum loading weight. Provides that person shall carry towed watersports endorsement if engaged in any towed watersports within Newberg Pool Congested Zone. Takes effect on 91st day following adjournment sine die.

Relating to rural broadband; prescribing an effective date.

Direct Public Utility Commission to study laws related to rural broadband and provide results to interim committees of Legislative Assembly no later than September 15, 2022. Sunsets January 2, 2023. Takes effect on 91st day following adjournment sine die.

Relating to Willamette River fishing endorsements.

Authorizes State Fish and Wildlife Commission to establish by rule annual and daily Willamette River salmon, steelhead and sturgeon recreational fishing endorsements. Requires that fees collected for endorsements be deposited in Willamette River Fisheries Enhancement Fund. Establishes Willamette River Fisheries Enhancement Fund in State Treasury, separate and distinct from General Fund. Continuously appropriates moneys in Willamette River Fisheries Enhancement Fund to State Department of Fish and Wildlife to implement measures that enhance fisheries, optimize economic benefits of fisheries and advance native fish conservation. Establishes Willamette River Endorsements Board within department. Directs board to determine uses of moneys in Willamette River Fisheries Enhancement Fund.

Relating to the Oregon Conservation and Recreation Fund; declaring an emergency.

Repeals abolishment of Oregon Conservation and Recreation Fund. Repeals sunset of Oregon Conservation and Recreation Advisory Committee. Appropriates moneys to Emergency Board, out of General Fund, to be allocated to State Department of Fish and Wildlife for purposes of Oregon Conservation and Recreation Fund. Provides that moneys may only be released to department in increments matching deposits into fund from sources other than state government. Declares emergency, effective on passage.

Relating to the employment of substitute teachers.

Provides that certain substitute teachers are considered employees of school district and are eligible for retirement benefits and health benefit plans. Allows for retroactive applicability of law.

Relating to overtime.

Prohibits employers from permitting , or ] requiring or suffering agricultural workers to work in excess of 40 ] certain maximum hours in one workweek unless workers are compensated for overtime hours worked. Phases in requirement over three calendar years. Authorizes Commissioner of Bureau of Labor and Industries to enforce wage claim regarding overtime pay for agricultural workers. Authorizes commissioner to assess civil penalty for willful violations of overtime pay requirements. Requires Oregon Business Development Department to develop and implement overtime compensation payment program to assist employers of agricultural workers in paying required overtime to workers. Establishes Agricultural Worker Overtime Account. Appropriates moneys from General Fund to department for deposit into account to carry out purposes of program. Sunsets program on January 2, 2026.

Relating to the Oregon Business Development Department assistance program.

Directs Oregon Business Development Department to establish by rule program to assist certain pulp mills and paper mills and employees of such mills in finding opportunities to transfer mill ownership to employees and to convert mill operations into production and manufacturing of personal protective equipment to be sold in this state.
