Provides that licensed optometrist may perform specified ophthalmic surgery procedures. Defines "ophthalmic surgery." Removes requirement that optometrist treating patient with antiglaucoma medication consult with ophthalmologist. Takes effect on 91st day following adjournment sine die.
Limits, for purposes of personal income taxation, availability of itemized deductions, using phaseout based on adjusted gross income of taxpayer. Applies to tax years beginning on or after January 1, 2021, and before January 1, 2023. Takes effect on 91st day following adjournment sine die.
Requires sentencing court to consider as mitigation evidence defendant was subjected to domestic abuse that was significant factor in criminal behavior. Provides that such evidence constitutes substantial and compelling reasons justifying downward departure sentence. Authorizes court to impose lesser sentence even if sentence is mandatory or otherwise required by law. Creates procedure by which person currently serving sentence may petition court for resentencing if person was subjected to abuse that was significant factor in criminal behavior. Allows State Department of Agriculture to enter into agreement with law enforcement agency to enable law enforcement agency to assist department in carrying out certain inspections of industrial hemp.
Conforms felony jury verdict statute with constitutional rule requiring guilty verdicts to be unanimous. Requires not guilty verdicts in cases involving felonies to be unanimous. Establishes process by which person with qualifying conviction based on nonunanimous jury verdict may apply to have conviction set aside. Directs district attorneys to make reasonable efforts to identify convictions based on nonunanimous jury verdicts and notify convicted person of ability to set aside conviction.
Directs Department of State Lands ] Oregon Business Development Department to study impact of laws related to wetlands on economic development and to provide results of study in report to interim committees of Legislative Assembly no later than September 15, 2022. Requires person subject to requirement to obtain license under Oregon Securities Law to disclose to individual that person is not fiduciary if person is not subject to or has not assumed fiduciary duty with respect to individual. Specifies requirements for disclosure. Requires person subject to requirement to obtain license under Oregon Securities Law to assume fiduciary duty with respect to individual to whom person provides counsel or advice or on behalf of whom person transacts business related to individual's investments in retirement benefit plan that is not subject to federal Employee Retirement Income Security Act of 1974. Punishes violation of Act by maximum of 364 days' imprisonment, $6,250, or both. Takes effect on 91st day following adjournment sine die.
