Imposes a pass-through business tax; defines terms; provides for the imposition and rate of tax, tax reductions, payment of estimated tax, filing of return and payment of tax, accounting periods and methods and procedural provisions; makes related provisions.
Relates to the compensation for injury or damage caused by the intoxication or impairment of ability of a person under the age of twenty-one years; defines impairment of ability.
Requires every general hospital to report within seven days to the US consumer product safety commission with any report of any examination or inquiry prepared with respect to any death or serious injury occurring to a child determined to be caused by either a children's product or a durable juvenile product.
Relates to the creation of a crime database of all convictions in New York state of animal cruelty, fighting, neglect, abandonment and mistreatment; makes such crime database available to all law enforcement entities, district attorneys, duly incorporated humane societies, societies for the prevention of cruelty to animals, dog or cat protective associations and animal control officers.
Requires state disaster preparedness plans to include at least one annual simulation of both natural and man-made disaster events in the form of a tabletop exercise in which key personnel assigned emergency management roles and responsibilities gather to discuss, in a non-threatening environment, various simulated emergency situations; provides that such simulation shall be completed annually prior to the first of May in areas at risk to hurricane damage.
Relates to funding for emergency management services for certain counties with non-operational nuclear power plants.
Relates to special act school districts and special education; authorizes boards of education of special act school districts to establish fiscal stabilization reserve funds.
Relates to military enhanced recognition, incentive and tribute scholarships; removes the date requirement of on and after August 2, 1990 for a member of the armed forces of the United States or state organized militia to be a member and for children, spouses and financial dependents of such member to receive such scholarships; authorizes a member of the armed forces of the United States military who: received a service-connected disability rating from the department of veterans affairs consisting of a minimum of zero percent and a maximum of one hundred percent; and was a legal resident of New York state at the time of military service to receive the MERIT scholarship; provides for eligible persons, the amount; requirements; and residency for such scholarship.
