American Broadband Act This bill addresses broadband and other communications services. The bill limits applicable state and local regulatory authority. Limitations include setting (and providing statutory authority for) deadlines for reviews and decisions related to personal wireless and other telecommunication service facilities, as well as cable franchises and services. Further, a state or locality may not provide broadband services in areas with more than one other commercial provider. The bill exempts certain telecommunications infrastructure projects from environmental and historic preservation reviews, including projects carried out after a declared disaster or emergency (e.g., a wildfire). The bill also establishes a rebuttable presumption that a request for a review of the effects of deploying wireless service on historically, culturally, or religiously significant tribal or Native Hawaiian land is complete if the tribe or Native Hawaiian organization receives certain forms. The bill enhances criminal penalties for willful or malicious destruction of a communication facility. Furthermore, the General Services Administration must establish a common fee schedule for deploying wireless facilities that affect federal property. Additionally, the National Telecommunications and Information Administration must award grants for expanding high-speed broadband access, facilitate through an interagency strike force timely reviews of telecommunications-related requests that affect federal property (e.g., a request for an easement or right-of-way), and report on certain requests concerning communications facilities on federal real property. The bill also requires collaboration among federal agencies that support broadband deployment.

This resolution mourns the death of Frederick Stephen Humphries, former president of Florida A&M University and Tennessee State University, and requests that a copy of this resolution be transmitted to his family.

Reducing Hereditary Cancer Act of 2021 This bill provides for Medicare coverage of germline mutation testing for individuals with a personal or family history of a hereditary cancer gene mutation or suspected history of hereditary cancer, as well as for associated coverage of risk-reducing surgeries and screenings.

Foreign Gain-of-Function Research Prevention Act of 2021 This bill prohibits the use of federal funds to conduct or support gain-of-function research involving potential pandemic pathogens by China, Russia, Iran, North Korea, or other foreign adversaries. Gain-of-function research is any research that is anticipated to confer an attribute on a pathogen to enhance its pathogenicity or transmissibility in mammals. If the Department of State finds that an entity has used funds for prohibited research, the entity may not receive any federal funding for a period of five years.

Ensuring Patient Access to Critical Breakthrough Products Act of 2021 This bill provides for Medicare coverage of medical devices that are approved under the Food and Drug Administration (FDA) Breakthrough Devices Program. (Under the program, manufacturers work with the FDA to expedite the review and approval of certain medical devices that provide for more effective treatment or diagnosis of life-threatening or irreversibly debilitating human diseases or conditions.) The bill allows designated medical breakthrough devices to be temporarily covered under Medicare during a four-year transitional period. The Centers for Medicare & Medicaid Services (CMS) must assign payment codes for such devices within three months of FDA approval. The CMS must also establish a process to allow for continued coverage after the transitional period has expired, taking into account any additional evidence or data the CMS deems necessary. The CMS must also provide for temporary and, where appropriate, permanent Medicare coverage of breakthrough devices for which there is no existing benefit category (i.e., classification).

Stop the Outlay of Payments Act This bill prohibits the award of federal funds to entities that have had prior awards suspended or terminated due to certain legal violations and that have failed to take necessary remedial action. Specifically, the bill requires federal agencies to notify the Office of Management and Budget (OMB) within 120 days of suspending or terminating any portion of a federal award to a recipient for failure to comply with (1) the terms and conditions of the award, (2) a federal law or regulation, or (3) a request by the agency making the award for information or materials relating to that award. The OMB must maintain an up-to-date list of suspended entities on its website. An agency may not make a federal award or disburse funds under an award to a suspended entity until that entity remedies the reason for the suspension or termination, with specified exceptions.

Manufacturing API, Drugs, and Excipients in America Act or the MADE in America Act This bill establishes a tax credit for taxpayers engaged in medical production activities in certain areas and contains other provisions related to pharmaceuticals. An eligible taxpayer may claim a tax credit equal to 25% of qualified expenditures related to the production of pharmaceuticals, medical devices, or other related items in a designated qualified opportunity zone with a poverty rate higher than 30%. The bill provides for increases to this tax credit in certain situations, such as if a substantial portion of the employees reside in areas with certain poverty levels. In addition, the Food and Drug Administration (FDA) must continue programs to facilitate the development and review of new drug or biological products that are manufactured using certain advanced manufacturing technologies. The bill imposes various requirements on these programs, including deadlines for evaluating such a technology. Furthermore, the Department of Health and Human Services must ensure timely and effective internal coordination and alignment between FDA field investigators and the staff of the Center for Drug Evaluation and Research's Office of Compliance and Drug Shortage Program regarding reports and feedback related to facility inspections.

Defending Domestic Produce Protection Act This bill establishes a process by which a core seasonal industry may petition for countervailing and antidumping duties. A core seasonal industry means the producers (1) of a domestic like product that is a raw agricultural product, (2) whose collective output constitutes a majority of the total production in any state or group of states that accounts for a major portion of the total production during a discrete season or cyclical period of time, and (3) that make substantially all of their sales during that season or time period. The bill also provides that this process shall apply with respect to goods from Canada and Mexico.

Toxic Exposure in the American Military Act or the TEAM Act This bill requires the Department of Veterans Affairs (VA) to expand health care, benefits, and resources for veterans with conditions related to exposure to toxic substances. Specifically, the bill expands eligibility for VA hospital care, medical services, and nursing home care to include veterans who (1) were exposed to toxic substances, radiation, or other conditions, and were awarded certain medals (e.g., the Armed Forces Service Medal); (2) are eligible for inclusion in the Airborne Hazards and Open Burn Pit Registry; or (3) have been identified by the Department of Defense to have been possibly exposed during service to an open burn pit, toxic substance, or specified hazardous sites. (A burn pit is an area used for burning solid waste in open air without equipment.) The bill establishes a presumption of service-connection for diseases associated with exposure to certain toxic substances and that become manifest within a certain time period; the VA must specify such diseases and requirements through regulations. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. The bill also requires the VA to take specified actions to (1) evaluate scientific evidence regarding associations between diseases and exposure to toxic substances; (2) train its health care personnel on identifying, treating, and assessing illnesses related to such exposure; and (3) provide resources to veterans exposed to toxic substances.

This bill designates the community-based outpatient clinic of the Department of Veterans Affairs in Middleburg, Florida, as the A.K. Baker VA Clinic.
