Vulnerable road users.

Defines "vulnerable road user". Provides that it is a criminal offense if a person commits a moving traffic offense that results in the serious bodily injury or death of a vulnerable road user. Urges the legislative council to assign certain topics to an existing study committee.

Private card games.

Defines "private low stakes card game" and provides a defense to certain gambling crimes if the gambling was a private low stakes card game. Defines "cheating" and makes cheating at gambling a Class A misdemeanor, and increases the penalty for the offense based on the gain obtained by cheating. Makes conforming amendments.

Select commission on passenger rail.

Establishes the select commission on passenger rail (commission) under the Indiana department of transportation (department). Provides for the membership of the commission. Requires the commission to adopt bylaws governing: (1) the activities and procedures of the commission; (2) the powers and duties of the commission and its officers; (3) the appointment procedures and terms of the members of the commission; (4) the voting rights of the members of the commission; (5) the voting procedures of the commission; (6) conducting the business of the commission; and (7) any other matters necessary to fulfill the duties of the commission. Requires the commission to advocate for long-term, sustainable funding to implement and expand passenger rail. Requires the commission to identify and develop public and private partnerships to implement and expand passenger rail. Requires the commission to, before November 1 of each year, publish an annual report regarding the activities of the commission in an electronic format to the legislative council and the legislative services agency for the use of the members of the general assembly. Provides that the commission may: (1) advocate for passenger rail systems included in the State Rail Plan and approved by the department; (2) educate local officials and the public on the advantages of passenger rail service; and (3) establish committees. Provides that the commission may not study, advocate, or promote passenger rail in Marion County.

Eligibility for resident tuition.

Provides that an individual who meets certain conditions is eligible for the resident tuition rate as determined by the state educational institution. Requires such an individual to verify that the individual meets the criteria to receive the resident tuition rate.

Disclosure of eviction information.

Prohibits a court or the operator of a case management system from disclosing information relating to an eviction action: (1) if the case is dismissed or if the tenant prevails in the action or upon appeal; or (2) upon order of the court after a petition to prohibit disclosure is made by the tenant: (A) not earlier than seven years after a judgment of eviction against the tenant becomes final; or (B) at least one year after the case was filed if the case remains pending with no judgment.

Distribution of revenue for public safety purposes.

Provides that, subject to the approval of a county adopting body, a fire protection district or a qualified fire protection territory may apply for distributions of tax revenue. Provides that a township that provides fire protection or emergency medical services (other than a township in Marion County) may apply to a county adopting body for a distribution of tax revenue for public safety purposes. Requires the adopting body to conduct a public hearing to review and approve the application. Specifies the method for determining the amount of the distribution to the qualified township.

Regulation of coal combustion residuals.

Establishes a state policy favoring beneficial uses of coal combustion residuals (CCR). Provides that the rules of the environmental rules board may not allow CCR to be disposed of if, after the disposal, any of the CCR: (1) would be within a 500 year flood plain; (2) would be in contact with ground water; (3) could migrate into the uppermost aquifer; (4) would be left in an unstable area; or (5) would be in a seismic impact zone. Requires that the CCR disposal rules of the environmental rules board and the state permit program implementing the federal CCR rule be at least as protective and comprehensive as the federal CCR rule. Defines "closure in place" and prohibits the department from approving the closure in place of a CCR surface impoundment if: (1) the CCR surface impoundment is within a 500 year flood plain; (2) any of the CCR disposed of in the CCR surface impoundment would be in contact with ground water; or (3) CCR could migrate into the uppermost aquifer after the closure in place. Makes corresponding changes and a technical correction.

Data privacy.

Defines "data steward". Requires the bureau of motor vehicles (bureau) to disclose certain personal information that is not highly restricted personal information if the bureau has obtained the written consent of the person to whom the personal information pertains, and the person requesting the information provides proof of identity and represents that the use of the personal information will be strictly limited. Requires the bureau to designate a data steward to oversee strategic and tactical data management for personal information collected and retained by the bureau. Makes conforming changes.
