Disposal of firearms by trade for new equipment.

Permits a law enforcement agency to dispose of certain confiscated firearms by trade with a licensed firearms dealer, a licensed firearm manufacturer, or another law enforcement agency in exchange for new firearms and other law enforcement equipment. Sets forth the recording and reporting requirements for the trade of firearms by a law enforcement agency.

Kratom.

Defines "kratom product" as a food product or dietary ingredient that: (1) is derived from the leaf or extract of mitragyna speciosa and has a level of residual solvent that is not more than permitted by USP 467; (2) does not contain a level of 7-hydroxymitragynine in the alkaloid fraction that is greater than 1% of the overall alkaloid composition of the product; and (3) does not contain any synthetic alkaloids including synthetic mitragynin, synthetic 7-hydroxymitragynine, or any other synthetic compound of a kratom plant. Establishes requirements for the manufacture, labeling, and sale of kratom products. Specifies that a kratom product is not a controlled substance.

Town of Hardinsburg.

Legalizes the action of the county commissioners of Washington County dissolving the town of Hardinsburg. Repeals an 1893 act that legalized the incorporation of the town of Hardinsburg.

School board elections.

Provides that a candidate for a school board office may not be an employee or agent of that school corporation. Establishes a process for a school board or the voters in a school corporation to change the method by which the members of the school board are nominated and elected. Provides that the members of a school board may be nominated and elected by one of the following processes: (1) Through nonpartisan election (as is the case under current law). (2) Through nonpartisan nomination (under the current process) and designation of a candidate's political affiliation or independent status on the general election ballot. (3) Through nomination and election in a partisan process as other candidates for elected office are nominated and elected. Provides that a school board may adopt a resolution to initiate a change or the voters of the school corporation may initiate a change through petition. Provides that, in either case, the voters of the school corporation must approve any change by public question. Provides that the method of election of members of a school board may not be changed until after 10 years after the most recent change was made. Makes conforming changes.

Breakthrough therapies.

Provides that a drug, biological product, or medical device that has been designated as a breakthrough therapy under federal law may be made available to a qualified patient and offered by a physician as a part of the patient's medical treatment. Specifies that a civil or criminal cause of action is not created against a manufacturer or health care provider for any harm to a qualified patient resulting from use of an investigational drug, biological product, or device.

Various public safety matters.

Provides that a conservancy district (district) in which each director of the board has been elected to the board may employ a district marshal or deputy district marshal. Provides that the law enforcement training board shall adopt rules establishing a town marshal and conservancy district marshal basic training program. (Current law provides that the law enforcement training board shall adopt rules establishing a town marshal basic training program.) Provides that the district marshal is the chief police officer of the district and has the powers of other law enforcement officers in enforcing laws. Adds a district marshal or deputy district marshal to certain definitions of "police officer", "officer", or "law enforcement officer". Provides that after obtaining an initial permit or authorization to conduct fire training exercises, a fire department, including a volunteer fire department, is not required to obtain subsequent permits or authorization from the department of environmental management or a unit of local government before conducting fire training exercises located at the same location authorized in the initial permit or authorization. Makes conforming and technical amendments.

Service and delivery of alcoholic beverages.

Allows a beauty culture salon (salon) to serve complimentary wine or beer by the glass to a customer on the premises without an alcoholic beverage permit. Allows a minor to be present in the salon. Allows a grocery store or drug store to deliver carryout alcoholic beverages to a customer in the store's parking lot or an adjacent area.

Emergency powers.

Provides that the orders, rules, and regulations made, amended, or rescinded by the governor must be narrowly tailored to serve a compelling public health or safety interest. Provides that if the governor declares a state of disaster emergency, the state of disaster emergency expires not later than 30 days after the declaration and may not be renewed. Provides that the governor may suspend certain regulatory statutes only to the extent necessary to carry out certain emergency responses. Provides that the governor may not suspend any provision of any regulatory statute if that suspension infringes upon any right or protection guaranteed or provided in the Constitution of the United States or the Constitution of the State of Indiana. Provides that nothing may be construed to authorize the executive board of the Indiana department of health to suspend any law, ordinance, or regulation enacted by the general assembly or other legislative body as part of a rule adopted by the executive board. Provides that the Indiana department of health may establish quarantine and may do what is reasonable and necessary for the prevention and suppression of disease if the Indiana department of health is authorized to do so in a declared disaster emergency. Provides that the Indiana department of health may order schools closed and forbid public gatherings when considered necessary to prevent and stop epidemics if the Indiana department of health is specifically authorized to do so in an emergency declaration. Provides that certain actions authorized by the commissioner of the Indiana department of health, local health boards, or local health officers may not be construed to authorize the commissioner, board, or official to suspend any law or regulation enacted by the general assembly or other legislative body unless otherwise specifically authorized by a declared disaster emergency. Repeals provisions relating to the governor's authority to establish an energy emergency.
