Artisan distillers.

Modifies a provision that specifies the general purposes of laws concerning alcohol and tobacco. Increases the number of gallons of liquor that an artisan distiller may produce in a calendar year from 10,000 to 30,000. Amends the limitations on the amount of liquor from another manufacturer that an artisan distiller may obtain and use.

Medical marijuana.

Permits the use of medical marijuana by persons with serious medical conditions as determined by their physician. Establishes a medical marijuana program to permit the cultivation, processing, testing, transportation, and dispensing of medical marijuana by holders of a valid permit. Requires the Indiana department of health (state department) to implement and enforce the medical marijuana program. Requires that permit holders undertake steps to prevent diversion of medical marijuana to unauthorized persons. Requires that medical marijuana and medical marijuana products be properly labeled, placed in child resistant packaging, and tested by an independent testing laboratory before being made available for purchase. Prohibits packaging medical marijuana in a manner that is appealing to children. Authorizes research on medical marijuana in accordance with rules set forth by the state department. Prohibits discrimination against medical marijuana users. Prohibits harassment of medical marijuana users by law enforcement officers, and prohibits cooperation with federal law enforcement officials seeking to enforce federal laws that criminalize the use of marijuana authorized in Indiana. Establishes the medical marijuana oversight board to review appeals and grievances concerning the medical marijuana program. Provides a defense to prosecution for a person who operates a vehicle or motorboat with marijuana or its metabolite in the person's blood under certain conditions that involve medical marijuana. Makes conforming amendments.

School board elections.

Provides that for school board offices, each candidate's affiliation with a political party or status as an independent candidate must be stated on a petition of nomination and on the ballot. Specifies: (1) requirements that apply to a candidate who claims affiliation with a major political party; and (2) a process to challenge a candidate's statement that the candidate is affiliated with a major political party. Makes conforming changes.

School distribution of firearm safety information.

Requires the department of education, in collaboration with the state police department, to identify a set of best practices and develop a set of educational materials concerning the safe possession and storage of a firearm in a home with a child. Provides that the department of education shall provide the best practices and educational materials to certain schools for annual distribution to parents of students.

Lawful carry by state elected officials and staff.

Permits a member of the general assembly, professional staff of the general assembly, and a state officer to carry a handgun within the state capitol building and on the property of the Indiana government center campus if the person is not prohibited from carrying a handgun by state or federal law.

Repeal of involuntary firearm removal process.

Repeals provisions concerning the: (1) confiscation and retention of firearms from a dangerous person; (2) compilation and publication of statistics related to the confiscation and retention of firearms from a dangerous person; and (3) making of a false report that a person is dangerous. Modifies a provision concerning a petition to find that an individual is no longer dangerous.

Second amendment protection.

Provides that certain federal laws that infringe on the right to keep and bear arms are invalid, not recognized, and rejected, and shall not be enforced by Indiana. Specifies penalties and causes of action concerning a political subdivision or law enforcement agency that employs a: (1) law enforcement officer who enforces or attempts to enforce certain provisions or otherwise deprives a citizen of Indiana of particular constitutional rights or privileges; or (2) federal official, or person who gives material aid to a federal official, who knowingly enforces or attempts to enforce certain laws. Specifies exceptions. Makes findings and defines particular terms.

Income tax credit for firearms safety expenses.

Provides a state income tax credit for expenses incurred to receive qualified firearms instruction or to purchase a qualified firearms storage device. Provides that the tax credit is equal to the amount of the incurred expenses. Provides that the maximum amount allowed as a tax credit is $300 for individuals filing single returns or $600 for married couples filing joint returns. Provides that a tax credit may not exceed the taxpayer's state income tax liability. Provides that a taxpayer is not entitled to a carryover, carryback, or refund of any unused tax credit.
