Removal of immunization requirements.

Provides that the department of child services may not require an individual to undergo an immunization as a condition of issuing the individual a foster family home license, or renewing the individual's foster family home license, if the individual provides: (1) written notice that the individual objects to the immunization on religious grounds; or (2) written certification from a physician that the immunization is or may be detrimental to the individual's health.

Elkhart County courts.

Allows the judges of the Elkhart circuit and superior courts to appoint four full-time magistrates and beginning January 1, 2024, to appoint two additional full-time magistrates. (Current law allows for the appointment of two magistrates.)

Abortion.

Terminates the licensure of abortion clinics. Specifies that the abortion statutes do not apply to in vitro fertilization. Makes changes to when an abortion may be performed, including when: (1) the abortion is necessary to prevent any serious health risk of the pregnant woman or to save the pregnant woman's life; (2) the fetus is diagnosed with a lethal fetal anomaly; or (3) the pregnancy is a result of rape or incest. Specifies time frames and conditions that must be met in order for the abortion to be performed. Provides that the statute requiring consent of a parent or legal guardian for a minor's abortion does not apply to a minor who is pregnant as a result of rape or incest by a parent, legal guardian, or custodian of the unemancipated minor. Requires the revocation of a physician's license for specified violations. Provides a defense for a pregnant mother charged with a criminal offense for terminating or seeking the termination of her pregnancy. Specifies that a person who terminates the pregnancy of a pregnant woman upon her request may only be charged with certain crimes. Exempts from the crime of feticide: (1) the pregnant mother; (2) a person who provides medical treatment in good faith to a pregnant woman that results in the accidental or unintentional termination of the pregnancy; and (3) a physician who performs a medical procedure to terminate the pregnancy upon request of the pregnant woman. Requires the maternal mortality review committee to study how changes in the state's abortion laws affect maternal mortality in Indiana and extends the committee until June 30, 2027. Voids certain administrative rules concerning abortion clinics. Establishes the prosecutorial oversight task force and specifies duties of the task force. Makes conforming amendments.

Participation in school sports.

Requires, for purposes of interscholastic athletic events, school corporations, public schools, nonpublic schools, and certain athletic associations to expressly designate an athletic team or sport as one of the following: (1) A male, men's, or boys' team or sport. (2) A female, women's, or girls' team or sport. (3) A coeducational or mixed team or sport. Prohibits a male, based on the student's biological sex at birth in accordance with the student's genetics and reproductive biology, from participating on an athletic team or sport designated as being a female, women's, or girls' athletic team or sport. Requires school corporations, public schools, certain nonpublic schools, and certain athletic associations to: (1) establish and maintain grievance procedures; or (2) maintain grievance or protest procedures established before July 1, 2022; for a violation of these provisions. Establishes a civil action for a violation of these provisions. Provides that school corporations, public schools, certain nonpublic schools, and certain athletic associations are not subject to liability in a civil, administrative, disciplinary, or criminal action for acting in compliance with these provisions.

Firearms matters.

Repeals the law that requires a person to obtain a license to carry a handgun in Indiana. Specifies that certain persons who are not otherwise prohibited from carrying or possessing a handgun are not required to obtain or possess a license or permit from the state to carry a handgun in Indiana. Prohibits certain individuals from knowingly or intentionally carrying a handgun. Creates the crime of "unlawful carrying of a handgun" and specifies the penalties for committing this crime. Allows particular individuals who do not meet the requirements to receive a handgun license and are not otherwise prohibited to carry a handgun in limited places. Allows a resident of Indiana to obtain in certain circumstances a license to carry a handgun in Indiana. Makes theft of a firearm a Level 5 felony. Defines certain terms. Makes conforming amendments and repeals obsolete provisions.

Flood plain management.

Provides that in a county having a population within certain parameters, a local flood plain administrator may issue a variance allowing a structure located in a floodway to remain in its location without a permit issued by the director of the department of natural resources if the structure is an abode or residence, a permit for the construction of the abode or residence was issued by the appropriate official of the county before December 19, 2018, and other conditions are met.

Medicaid coverage for pregnant women.

Repeals the statute specifying Medicaid eligibility for qualified pregnant women. Increases the Medicaid income eligibility requirements for pregnant women. Removes the Medicaid limitation for pregnant women of medical assistance coverage only for pregnancy related services. Provides that the extension of postpartum Medicaid coverage for pregnant women shall be determined by the office of the secretary of family and social services and must be at least 60 days but not more than 12 months beginning on the last day of the pregnancy.

Coerced abortion.

Requires that a pregnant woman seeking an abortion must be informed that a coerced abortion is illegal. Provides that certain medical personnel must inquire with a pregnant woman seeking an abortion whether the abortion is coerced. Requires certain medical personnel who believe that an abortion is coerced to offer the pregnant woman information on certain services, the use of a telephone, and an alternative exit from the health care facility. Makes it a Level 6 felony if a person knowingly or intentionally coerces a pregnant woman into having an abortion. Mandates reports of a coerced abortion to law enforcement. Provides that a law enforcement agency must immediately respond and initiate an investigation upon receipt of a complaint of coercion or attempted coercion. Makes it a Class C infraction if a reproductive health facility knowingly employs a mandatory reporter who violates the mandatory reporting statute.

Manufactured housing in mobile home community.

Prohibits a governmental body from regulating or restricting the installation of a mobile home, manufactured home, or industrialized residential structure within a mobile home community based on the age or size of the mobile home, manufactured home, or industrialized residential structure, regardless of whether: (1) the mobile home, manufactured home, or industrialized residential structure; or (2) the lot on which, or the mobile home community in which, it is or will be located or installed; constitutes a conforming structure or use, or a legal, nonconforming structure or use. Provides that after March 14, 2022: (1) a unit may not adopt, impose, amend, or enforce a regulation, or a provision in a regulation, that violates this prohibition, regardless of when the regulation or provision was originally adopted or imposed; and (2) any provision that: (A) is included in a regulation adopted or imposed by a unit; and (B) violates this prohibition; is void and unenforceable regardless of when the regulation or provision was originally adopted or imposed. Prohibits a unit from adopting, imposing, or enforcing a regulation that mandates size requirements for, or that is based on the age of, a mobile home, a manufactured home, or an industrialized residential structure that will be installed in a mobile home community, regardless of whether the mobile home community, or any part of the mobile home community, constitutes: (1) a conforming structure or use; or (2) a legal, nonconforming structure or use. Provides that after March 14, 2022: (1) a unit may not adopt, impose, amend, or enforce a regulation, or a provision in a regulation, that violates this prohibition, regardless of when the regulation or provision was originally adopted or imposed; and (2) any provision that: (A) is included in a regulation adopted or imposed by a unit; and (B) violates this prohibition; is void and unenforceable regardless of when the regulation or provision was originally adopted or imposed. Provides that a mobile home community operator who attempts to exclude an owner with the intent to evade the requirement that the operator provide notice not less than 180 days before the date of an intended closure commits a deceptive act that is actionable by the attorney general. Amends the statute concerning the reconstruction of nonconforming structures to provide that whenever a legal, nonconforming structure, including: (1) a mobile home; (2) a manufactured home; or (3) an industrialized residential structure; on a parcel of real property used for residential purposes in a mobile home community is removed, the owner of the parcel shall be permitted to replace the structure without losing the status of the structure or parcel as a legal, nonconforming structure or use if the replacement meets the existing statutory requirements. Provides that these provisions concerning the continuing status of the structure or parcel in a mobile home community as a legal, nonconforming structure or use apply after March 14, 2022, regardless of whether: (1) the structure or parcel is conferred status as a legal, nonconforming structure or use; or (2) the legal nonconforming structure is: (A) damaged, destroyed, or removed; or (B) reconstructed, renovated, repaired, or replaced; before or after March 15, 2022.
