GOVT ETHICS SPECIAL GOVT AGENT

Amends the Illinois Governmental Ethics Act. Requires that a special government agent file a statement of economic interests within 60 days after assuming responsibilities as a special government agent (now, within 30 days after making the first ex parte communication). Effective immediately.

STATE UNIV CERTIF PARTICIPAT

Creates the State University Certificates of Participation Act. Provides that the power of the board of trustees of any State university to enter into contracts includes, but is not limited to, the power to enter into financing agreements in connection with the financing of capital improvements by selling certificates of participation in the installment payments made under such financing agreements. Allows such financing agreements to be entered into for any period of time less than or equal to 30 years, but not to exceed the useful life of the capital improvement. Provides that, upon determination by the board of trustees of a State university to undertake a transaction for the sale of certificates of participation and enter into related financing agreements in connection with the financing of capital improvements, the board shall adopt a resolution or resolutions describing in a general way the contemplated facilities or a combination thereof designated as the project, the estimated cost thereof, and any additional relevant information. Provides that these provisions are declaratory of existing law. Amends the Statute on Statutes to provide that a citation to the Omnibus Bond Acts is a citation to the State University Certificates of Participation Act.

STATE FINANCE-LAPSE EXTENSION

Amends the State Finance Act. Provides that all outstanding liabilities as of June 30, 2010, payable from appropriations that would otherwise expire at the conclusion of the lapse period for fiscal year 2010, may be paid out of the expiring appropriations until April 30, 2011 (instead of December 31, 2010). Effective immediately.

PROCUREMENT CONTRACT WAIVER

Amends the Illinois Procurement Code. With respect to the waiving of the prohibition against certain State officials and employees having State contracts, (i) requires that a granted waiver must be filed with the Secretary of State and Comptroller within 60 days after issuance or when contract performance begins, whichever is earlier, (ii) requires that the filing must occur before the contract is executed, (iii) requires that the waiver must be published in the electronic Illinois Procurement Bulletin before the contract is executed, and (iv) provides that a contract for which an issued waiver has not been properly filed and published is voidable. Effective immediately.

COOK CNTY HOSPITALS-BOARD

Amends the Counties Code. Requires that the Cook County Board of Commissioners establish a permanent independent governing body for the Cook County Public Health System. Requires that the General Assembly must, by joint resolution, determine the independence of the governing body. Provides that if the Cook County Board of Commissioners does not establish a governing body and the General Assembly does not approve the governing body within 120 days after the effective date of the amendatory Act, then the Cook County Public Health System may not receive any State moneys until the governing body is established and approved. Limits home rule powers. Effective immediately.

CHIP-RECOUP DEFICITS

Amends the Comprehensive Health Insurance Plan Act. Provides that any deficit incurred or expected to be incurred on behalf of eligible persons who qualify for plan coverage under the provisions concerning eligibility shall be recouped by an assessment of all insurers made in accordance with the provisions concerning deficit or surplus (instead of by an appropriation made by the General Assembly). Provides that the Comprehensive Health Insurance Plan Board shall, within 90 days after the effective date of the amendatory Act and within the first quarter of each fiscal year thereafter, assess all insurers for the anticipated deficit. Provides that the Board may also make additional assessments no more than 4 times a year to fund unanticipated deficits, implementation expenses, and cash flow needs. Makes a technical change to update Section numbering. Effective immediately.

USE/OCC-RETAILER-NEXUS

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that a retailer or serviceman is considered to be (i) maintaining a place of business in the State and (ii) engaged in selling personal property at retail in the State if the retailer or serviceman solicits business within the State through employees, independent contractors, agents, or other representatives. Provides that a retailer or serviceman is presumed to be soliciting business through an employee, independent contractor, agent, or other representative if the retailer or serviceman enters into an agreement with a resident of this State under which the resident, for a commission or consideration, directly or indirectly refers potential customers, whether by a link on an Internet website or otherwise, to the retailer or serviceman, if the cumulative gross receipts from sales by the retailer or serviceman to customers in the State who are referred to the retailer by all residents with this type of an agreement with the retailer is in excess of $10,000 during the preceding 4 quarterly periods ending on the last day of February, May, August, and November. Provides that the presumption may be rebutted by proof that the resident with whom the retailer or serviceman has an agreement did not engage in any solicitation in the State on behalf of the retailer or serviceman that would satisfy the nexus requirement of the United States Constitution during the 4 quarterly periods in question.

STATE CONTRACT DURATION

Amends the Illinois Procurement Code. Specifies that the 10-year limit on the duration of State contracts and leases is inclusive of proposed renewals. Effective July 1, 2009.
