Amends the Hospice Program Licensing Act. In provisions concerning minimum standards for licensed hospice programs, removes language providing that the number of persons who may be served in a residence shall not exceed 16 persons per location.
Amends the State Finance Act. Makes a technical change in a Section concerning the short title.
Creates the Illinois Freedom from Tracking Device Surveillance Act. Provides that a law enforcement agency may not use a tracking device to gather evidence or other information about the location of a person or his or her property, except that a law enforcement agency may use a tracking device to gather evidence or other information about the location of a person or his or her property only if the law enforcement agency first obtains a search warrant signed by a judge authorizing the use of a tracking device. Provides that evidence obtained or collected in violation of these provisions is not admissible as evidence in any criminal, civil, administrative, or other proceeding. Provides that if during any calendar year a law enforcement agency obtains a tracking device warrant, then on the following April 1 it shall report in writing to the Illinois Criminal Justice Information Authority the number of times that it did so. Provides that on July 1 of each year, the Authority shall publish on its publicly available website a concise report that lists every law enforcement agency that obtained a tracking device warrant during the prior calendar year, and for each of those agencies, the number of tracking device warrants.
Creates the Consumer Reciprocal Attorney's Fees Act. Defines "consumer contract" as any contract in which the money, property, or service that is the subject of the transaction is primarily for personal, family, or household purposes. Provides that if a consumer contract allows for the recovery of attorney's fees in an action brought to enforce the contract, the court may allow reasonable attorney's fees to the defendant if the defendant prevails in the action. Provides that the Act applies to any action filed on or after the effective date of the Act where the amount claimed does not exceed the maximum amount of a judgment allowable for a small claim under the Illinois Supreme Court Rules, but does not apply if the plaintiff does not request attorney's fees in the complaint or if each party to the consumer contract was represented by counsel in the negotiation of the contract. Provides that nothing in the Act shall be construed to apply to or limit the rights of any party to attorney's fees under any other contract or other provisions of Illinois law.
Amends the General Provisions Article of the Illinois Pension Code. In a Section requiring the use of a competitive selection process for obtaining investment services, creates an additional exception for "contracts for follow-on funds with the same fund sponsor through closed-end funds". Effective immediately.
Amends the Illinois Municipal Code. Makes a technical change in a Section concerning home rule preemption.
Amends the Civic Center Code. Makes a technical change in a Section concerning a civic center authority's power to incur obligations.
Amends the Illinois Banking Act. Provides that a bank shall utilize a form, statement, or writing to obtain a customer's consent to disclose any financial records or information obtained from financial records relating to that customer to non-affiliated third persons or parties. Provides criteria for banks to meet regarding the form, statement, or writing to obtain a customer's consent to disclose financial information relating to the customer's financial records. Provides that a bank shall not discriminate against or deny an otherwise qualified customer a financial product or financial service because the customer has not provided the consent to authorize the bank to disclose or share financial records or financial information obtained from financial records relating to that customer with any non-affiliated third person. Provides that a bank shall not be liable for failing to offer products and services to a customer solely because (i) that customer has failed to provide consent and the bank could not offer the product or service without consent and (ii) the customer has failed to provide consent.
Amends the Affordable Housing Planning and Appeal Act. Makes a technical change in a Section concerning the short title.
