Amends the Illinois Public Aid Code. In a Section concerning child care for TANF recipients, makes a technical change in provisions for payment for child care by the Department of Human Services.

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to designate a staff person to handle issues related to Chronic Obstructive Pulmonary Disease. Specifies the staff person's duties. Imposes conditions on any rulemaking authority. Effective immediately.
Appropriates $44,060,000 from the General Revenue Fund to the Department of Public Health for expenses of AIDS/HIV Education, Drugs, Services, Counseling, Testing, Referral and Partner Notification, and Patient and Worker Notification. Effective July 1, 2010.
Amends the Teacher Certification Article of the School Code. Removes a provision that provides that no one may be certified to teach or supervise in the public schools who is not of good health. Provides that a person must be at least 20 (instead of 19) years of age in order to be certified to teach or supervise in the public schools. Effective July 1, 2010.
Amends the Firearm Owners Identification Card Act. Provides that the Department of State Police may revoke a Firearm Owner's Identification Card of a parent or guardian of a person under 21 years of age who is unable to prevent his or her child under 21 years of age from gaining access to a firearm or ammunition, or both, when (1) the child upon 2 occasions has had possession of his or her parent or guardian's firearm or ammunition, or both, without the parent or guardian's permission and (2) the child met the criteria for severe or major mood disorder or severe conduct disorder (evidenced by behavior such as forced sex, physical cruelty, use of a weapon, stealing while confronting a victim, breaking and entering), or both, as defined in the DSM-IV-TR published by the American Psychiatric Association, or the child is an adjudicated delinquent minor for acts involving aggressive or violent behavior. Imposes conditions on any rulemaking authority.
Creates the Care of Students with Diabetes Act. Requires a parent or guardian to submit a diabetes care plan for a student with diabetes who seeks assistance with diabetes care in the school setting (whether a public or a private school). Provides that a delegated care aide shall perform the activities and tasks necessary to assist a student with diabetes in accordance with his or her diabetes care plan. Requires training for school employees and delegated care aides. Requires that an information sheet be provided to any school employee who transports a student for school-sponsored activities. Sets forth what a student with diabetes must be permitted to do. Provides that a school district may not restrict the assignment of a student with diabetes to a particular school on the basis that the school does not have a full-time school nurse, nor may a school deny a student access to any school or school-related activities on the basis that a student has diabetes. Provides for school employee protections against retaliation, civil immunity, and rights under federal law. Amends the School Code. In provisions concerning the administration of medication, provides that under no circumstances shall teachers or other non-administrative school employees, except certified school nurses, non-certificated registered professional nurses, and advanced practice nurses (currently, except certified school nurses and non-certified registered professional nurses) be required to administer medication to students. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Environmental Protection Act. Makes a technical change in a Section concerning the short title.
Creates the Equal Marriage Act. Makes legislative findings: same-sex couples are denied equal access to civil marriage benefits; the current marriage law is discriminatory and harms same-sex couples; and there is no compelling interest or rational basis to deny same-sex couples those benefits. Provides that the Act does not interfere with any religious beliefs about marriage. Provides that the Act's purpose is to provide eligible same-sex and opposite-sex couples with the same treatment as those in a civil marriage. Provides that parties to a marriage of the same sex are included in the terms "spouse", "immediate family", "dependent", and related matters. Provides that domestic relations, probate, and family law shall apply equally to parties to a marriage of the same sex. Provides that benefits apply equally to same-sex marriages in these areas: causes of actions related to spousal status, for wrongful death, emotional distress, and loss of consortium; adoption; family leave; group insurance for State and municipal employees; accident and health insurance protections tied to former spouses and dependents; and taxes and tax deductions based on marital status. Provides that a civil marriage is prohibited between siblings or between an uncle and a nephew or an aunt and a niece. Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that nothing in the Act should be construed to interfere or regulate any religious practice concerning marriage and no religion is required to solemnize a marriage to which it objects. Provides that a marriage is between 2 persons (rather than, a man and a woman) licensed, solemnized, and registered under the Act. Effective immediately.
Amends the Illinois Pension Code. Allows a designated domestic partner to qualify as a surviving spouse for purposes of survivor and death benefits. Effective immediately.
