SUNSET ACT-PEST CONTROL ACT

Amends the Regulatory Sunset Act. Extends the repeal date of the Structural Pest Control Act from December 31, 2009 to January 1, 2019. Effective immediately.

VEH CD-STOP FOR PEDESTRIAN

Amends the Illinois Vehicle Code. Provides that where traffic signals are not in place, vehicles must stop and yield to a pedestrian in a crosswalk rather than yielding the right-of-way by slowing down or stopping if need be. Provides that on a school day when children are present and so close that a potential hazard exists because of the close proximity of the motorized traffic and when traffic signals are not in place or in operation, vehicles must stop and yield to a pedestrian in a crosswalk rather than yielding the right-of-way by slowing down or stopping if need be to so yield. Effective immediately.

ELEC CD-CONTRIBUTION LIMITS

Amends the Election Code with respect to campaign finance. Limits a candidate to the establishment of one political committee; permits a General Assembly caucus leader to establish an additional caucus committee. Requires candidates, and permits political parties and General Assembly caucus leaders, to designate a single political committee to accept campaign contributions and regulates the manner of designation. Prohibits campaign contributions to political committees of public office candidates, established political parties, political party committeeperson candidates, and legislative caucuses except in limited amounts from individuals and political committees. Regulates the solicitation by corporations, labor organizations, and associations of employees and employee families for campaign contributions. Requires political committees to furnish the State Board of Election with reports of audits of the committees.

VITAL REC ACT-GENDER CHANGE

Amends the Vital Records Act. Adds a definition for "physician". Provides that any foreign physician submitting an affidavit shall submit proof of medical licensure along with the affidavit. Provides that an affidavit by a physician that he has conducted a physical examination of a person and that by reason of an operation previously performed on such person the sex designation on such person's birth record should be changed. Provides that the State Registrar of Vital Records may make any investigation or require any further information he deems necessary. Effective immediately.

PUBLIC-PRIVATE PARTNERSHIP

Creates the Public-Private Partnerships for Transportation Act. Provides that the Act is intended to promote public-private partnerships for transportation by authorizing the Illinois Department of Transportation (the Department) and the Illinois State Toll Highway Authority (the Authority) to enter into public-private agreements related to the development, operation, and financing of transportation facilities and to encourage the practice of congestion pricing in connection with toll highways, pursuant to which higher toll rates are charged during times or in locations of most congestion. Grants to the Department and the Authority the necessary powers for the development, financing, and operation of transportation projects through public-private agreements with one or more private entities. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois, Illinois Finance Authority Act, Illinois Procurement Code, Public Construction Bond Act, Public Works Preference Act, Employment of Illinois Workers on Public Works Act, Business Enterprise for Minorities, Females, and Persons with Disabilities Act, Retailers' Occupation Tax Act, Property Tax Code, Toll Highway Act, and Prevailing Wage Act to implement the new Act. Amends the State Finance Act to create the Public-Private Partnerships for Transportation Fund and provides that all money in the fund shall be used to supplement funding, as directed in the appropriation, for transportation projects in the State. Makes other changes. Effective immediately.

DHS-COMMUNITY SERVICES PLAN

Directs the Department of Human Services, Division of Developmental Disabilities, to develop a 7-year Plan with yearly benchmarks to enhance and expand access to quality community services and supports, by December 1, 2009.

NURSING HOME ADMIN-REPORTING

Amends the Nursing Home Administrators Licensing and Disciplinary Act. Adds to the grounds for disciplinary action the failure to report certain specified events involving acts or conduct similar to acts or conduct which would constitute grounds for disciplinary action under the Act. Creates separate reporting requirements related to licensees under the Act for the following groups: (1) the chief administrator or executive officer of any health care institution licensed by the Illinois Department of Public Health, including nursing homes; (2) any insurance company that offers policies of professional liability insurance to licensees or any other entity which seeks to indemnify the professional liability of a licensee; (3) the State's Attorney of each county; and (4) any agency, board, commission, department, or other instrumentality of the government of the State of Illinois. Provides that upon the receipt of any report required by the Act, the Department shall notify in writing, by certified mail, the person who is the subject of the report within 30 days after receipt by the Department of the report. Provides that the Department shall, in writing, make a determination as to whether there are sufficient facts to warrant further investigation or action and that failure to make such determination within the time provided shall be deemed to be a determination that there are not sufficient facts to warrant further investigation or action. Provides that any violation of the reporting provisions shall be a Class A misdemeanor. Provides for injunctive relief. Effective on January 1, 2011.

$DPH-ARTHRITIS PREVENTION

Appropriates $350,000 from the General Revenue Fund to the Department of Public Health for the purposes of the Arthritis Prevention, Control, and Cure Act. Effective July 1, 2009.

PREV WAGE-REVISED RATE-NOTICE

Amends the Prevailing Wage Act. In provisions making it a public body's responsibility to notify contractors and subcontractors of a revised prevailing wage rate, provides that the publication of an ordinance or resolution passed by the public body that states the ascertained prevailing wage is sufficient notification to the contractor and each subcontractor.

MERCURY THERMOSTAT ACT

Creates the Mercury Thermostat Collection Act. Requires certain thermostat manufacturers, not later than October 1, 2011, to submit to the Illinois Environmental Protection Agency a plan that describes a collection and financial incentive program for mercury thermostats. Requires these manufacturers, no later than January 1, 2012, to implement the Agency-approved plan and to report certain information about their collection efforts by April 1, 2012 and April 1 of each year thereafter. Prohibits, beginning on April 1, 2011, a thermostat wholesaler from selling or distributing thermostats unless it acts as a collection site for thermostats that contain mercury, participates in an education and outreach program to educate consumers on the collection program for mercury thermostats, and meets other requirements. Provides that manufacturers, thermostat wholesalers, and thermostat retailers are subject to certain sales prohibitions beginning on April 1, 2011. Provides for public comment on manufacturer plans. Requires the Agency to post certain information on its website, conduct an educational program, and report certain information about the program to the legislature. Authorizes the Agency to modify manufacturer plans and conduct certain investigations. Defines "Agency", "Board", "out-of-service mercury thermostat", "person", "thermostat manufacturer", "thermostat retailer", and "thermostat wholesaler". Effective immediately.
