Amends the Illinois Controlled Substances Act. Provides that a prescription for a Schedule II controlled substance shall not be filled more than 90 (rather than 7) days after the date of issuance.

BIMP-HEALTH AND HUMAN SERVICES

Creates the Health Care and Human Services Emergency Budget Implementation Act of 2009. States that the Act is to be liberally construed and interpreted in a manner that allows the State to address the fiscal crisis for the fiscal year ending June 30, 2010. Amends the Illinois Administrative Procedure Act by providing that during the period July 1, 2009 through June 30, 2010, a State agency shall not enforce rules that implement or are authorized by a statute to the extent that the duties under that statute have been suspended by law by the General Assembly or by Executive Order of the Governor during that same time period; authorizes emergency rules to implement any provision of the amendatory Act or any other budget initiative for fiscal year 2010 in accordance with specified provisions, except that the 24-month limitation on the adoption of emergency rules and certain provisions of the Act concerning JCAR oversight do not apply to rules adopted under the new provisions. Repeals the State Facilities Closure Act. Amends the Illinois Act on the Aging, the Children and Family Services Act, the Child Care Act of 1969, the Illinois Public Aid Code, the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act, the Abused and Neglected Child Reporting Act, the Mental Health and Developmental Disabilities Code, and other Acts. Provides for the suspension, limitation, or discontinuance of specified services, programs, duties, and functions. Provides that specified services and programs are subject to appropriation. Provides for changes in eligibility for specified services and programs. Makes other changes. Contains a severability provision. Effective immediately.

ADOPTION-REINSTATE PARENTAL RT

Amends the Adoption Act. Provides that a former parent whose parental rights have been terminated pursuant to a surrender of the minor for adoption, a consent to the minor's adoption, or a finding of unfitness of the parent may petition for those rights to be reinstated if the adoptive parent dies or is incapable of caring for the child due to a physical or mental impairment and consents to the reinstatement of parental rights. Provides that, before granting a petition for reinstatement, the court must consider the petitioner's current abilities, the best interests of the minor and the basis for the termination of parental rights. Contains other provisions. Effective July 1, 2009.

$DHS-SUPPORTIVE HOUSING SRVCS

In addition to any other amounts appropriated for this purpose, appropriates a total of $3,000,000 from the Health and Human Services Medicaid Trust Fund and the General Revenue Fund to the Department of Human Services for supportive housing services. Effective July 1, 2009.

INS-MATERNITY COVERAGE

Amends the Illinois Insurance Code. Provides that accident and health insurance policies shall provide coverage for maternity care. Provides that an insurer providing coverage shall ensure that the financial requirements and treatment limitations applicable to maternity benefits are no more restrictive than the predominant requirements and limitations applied to substantially all hospital and medical benefits covered by the policy. Provides that an insurer shall not refuse or limit coverage or charge a different rate for the same coverage solely on the basis that an individual is pregnant or had a previous cesarean delivery. Provides that no company may determine the premium or underwriting through a method that is in any way based upon the gender of any person. Amends the Health Maintenance Organization Act. Provides that every contract or evidence of coverage shall provide coverage for maternity care. Provides that no health maintenance organization shall refuse or limit coverage or charge a different rate for the same coverage solely on the basis that an individual is pregnant or had a previous cesarean delivery. Provides that health maintenance organizations shall be subject to the provisions of the Illinois Insurance Code prohibiting gender rating. Contains a nonacceleration clause. Effective July 1, 2010.

LIQUOR-TAX

Amends the Liquor Control Act of 1934. Raises the rates for taxes imposed upon the privilege of engaging in business as a manufacturer or as an importing distributor of alcoholic liquor other than beer. Raises the tax rate imposed upon the privilege of engaging in business as a manufacturer or as an importing distributor of beer. Provides that of the tax revenue received from the tax rate increases of the amendatory Act of the 96th General Assembly, minus the costs of administering the tax rate increases, 55% shall be deposited into the Community Addiction Prevention, Treatment, and Recovery Rescue Fund, 36% shall be deposited into the Community Mental Health Rescue Fund, and the remainder shall be deposited into the General Revenue Fund. Creates the Community Addiction Prevention, Treatment, and Recovery Rescue Fund and the Community Mental Health Rescue Fund as special funds in the State Treasury. Provides that, subject to appropriation, moneys in the Community Mental Health Rescue Fund may only be expended for the purposes of payment to community mental health providers for certain services. Provides that, subject to appropriation, moneys in the Community Addiction Prevention, Treatment, and Recovery Rescue Fund may only be expended for the purposes of payment to addiction prevention, intervention, treatment and recovery providers authorized in, and for services authorized by, the Alcoholism and Other Drug Abuse Dependency Act. Provides that moneys in either Fund may not be expended to pay for the costs of State employees, their benefits, or other operational costs of the State. Amends the State Finance Act to include the Community Addiction Prevention, Treatment, and Recovery Rescue Fund and the Community Mental Health Rescue Fund. Effective immediately.
