LOCAL GOV FOREIGN FIRE INS

Amends the Illinois Municipal Code. Provides that a fire department foreign fire insurance board in a municipality with fewer than 500,000 (now, 250,000) inhabitants shall have 7 trustees, including the fire chief and 6 members of the fire department (now, the board is established by ordinances of the corporate authorities). Provides for an annual election of board officers. Provides that the annual municipal audit shall include funds appropriated to the board and shall determine whether the funds have been expended by the board only for the maintenance, use, and benefit of the department. Amends the Fire Protection District Act. Provides that in each fire protection district that has an organized fire department there shall be a foreign fire insurance board. Provides that the board shall have 7 trustees, including the fire chief and 6 members of the fire department. Provides that officers shall be elected annually. Authorizes the board to make rules. Provides that the treasurer must give a bond to the board. Provides that the board shall develop and maintain a list of items that are appropriate expenditures. Provides that the annual fire protection district audit shall include funds appropriated to the board and shall determine whether the funds have been expended by the board only for the maintenance, use, and benefit of the department. Makes other changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

HIGHER ED-ENERGY CONSERVATION

Amends the Public University Energy Conservation Act. Provides that "energy conservation measure" includes construction of a new building or facility that is designed to reduce energy consumption or operating costs.

$COMPTROLLER-COURT REPORTING

Makes FY09 appropriations to the State Comptroller for expenses related to court reporting. The sum of $3,633,750 is appropriated for official court reporting. The sum of $760,000 is appropriated for State contributions to the State Employees’ Retirement System and $356,250 for State contributions to Social Security. Effective immediately.

EPA-NPDES-MINE DISCHARGE FEE

Amends the Environmental Protection Act. Changes the annual NPDES discharge fee for mines other than mines producing coal from $5,000 to $1,000. Effective July 1, 2007.

E85 INSTALLATION

Amends the Motor Fuel Sales Act. Requires that, no later than December 31, 2012, there must be installed, at each gasoline station or service station, one or more new E85 ethanol fuel dispensing pumps. Amends the Illinois Income Tax Act. Creates a tax credit, for taxable years ending on or after December 31, 2007 and on or before December 30, 2017, for taxpayers who install a new E85 ethanol fuel dispensing pump at a gasoline station or service station in Illinois during the taxable year in the amount equal to the cost of that installation. Provides that the credit: (i) may not exceed $80,000 per pump: (ii) may not be claimed in any one taxable year in an amount exceeding $20,000 per pump, but any excess amount may be carried forward; and (iii) may not be claimed with respect to the installation of more than one E85 ethanol fuel dispensing pump at any one station. Provides that the credit may be carried forward for 4 years. Effective immediately.

CRIM CD-HEINOUS BAT UNBORN

Amends the Criminal Code of 1961. Creates the offense of heinous battery of an unborn child. Defines the offense as intentionally or knowingly without medical legal justification extracting by cutting, severing, mutilating, or otherwise causing by force the unnatural expulsion of an independently viable fetus from the uterus of another living human being. Provides that the penalty is a Class X felony for which a person shall be sentenced to a term of imprisonment of not less than 6 years and not more than 45 years. Exempts from this offense acts that cause bodily harm to an unborn child if those acts were committed during any abortion to which the pregnant woman has consented and acts that were committed pursuant to usual and customary standards of medical practice during diagnostic testing or therapeutic treatment.

CRIM CD-EAVESDROPPING EXEMPT

Amends the Criminal Code of 1961. Includes, in the activities that are exempt from the Eavesdropping Article of the Code, intercepting, recording, or listening to, with the approval of the State's Attorney, a conversation or electronic communication where a law enforcement officer, or a person acting at the direction of law enforcement, is a party to the conversation or electronic communication and has consented to it being intercepted or recorded in the course of an investigation of child pornography.
