Amends the Mental Health and Developmental Disabilities Code. Provides that "person subject to involuntary admission" includes (i) a person with mental illness and who because of his or her illness is reasonably expected to engage in dangerous conduct (instead of reasonably expected to inflict serious physical harm upon himself or herself or another in the near future) and (ii) a person with mental illness who, because of the nature of his or her illness, is unable to understand his or her need for treatment and who, if not treated, is reasonably expected to suffer or continue to suffer mental deterioration or emotional deterioration, or both, to the point that the person is reasonably expected to engage in dangerous conduct. Defines "dangerous conduct" as threatening behavior or conduct that places another individual in reasonable expectation of being harmed, or a person's inability to provide, without the assistance of family or outside help, for his or her basic physical needs so as to guard himself or herself from serious harm.
Congratulates the staff, faculty, and students of Eastern Illinois University in Charleston as they celebrate the 25th anniversary of the Tarble Arts Center.
Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides an exemption from taxation under the Acts for tangible personal property used in the construction, maintenance, or operation of a public water supply that is operated by a not-for-profit entity. Provides that the Acts' sunset provisions do not apply to these exemptions.
Amends the Criminal Code of 1961 concerning the offense of threatening a public official. Includes in the definition of "public official" a sworn law enforcement or peace officer.
Amends the Code of Civil Procedure. Provides that the exceptions to the physician-patient privilege against disclosure of information are expanded with a new class of exceptions (at present, there are 11 other exceptions) for information sought by subpoenas under the Medical Practice Act of 1987, the Illinois Dental Practice Act or the Nursing Home Administrators Licensing and Disciplinary Act. Provides that records of a health care facility shall be made available for examination or copying to the patient or the patient's legally authorized representative, his or her healthcare practitioner (at present, physician), authorized attorney, or any person, entity, or organization that presents a valid authorization for the release of records signed by the patient or the patient's legally authorized representative. Provides that a patient's records maintained by a health care practitioner shall be available to any person, entity, or organization presenting a valid authorization for the release of the records signed by the patient or the patient's legally authorized representative. Deletes reference in a Section concerning copying fees to a repealed Section.
Amends the Illinois Insurance Code and the Health Maintenance Organization Act. Requires coverage for a mammogram at the age and intervals considered medically necessary by the woman's health care provider for women under 40 years of age and having a family history of breast cancer, prior personal history of breast cancer, positive genetic testing, or other risk factors (now, only for women under 40 years of age and having a family history of breast cancer or other risk factors). Also requires coverage for a comprehensive ultrasound screening of an entire breast or breasts if a mammogram demonstrates heterogeneous or dense breast tissue based on the Breast Imaging Reporting and Data System established by the American College of Radiology or if the woman is believed to be at increased risk for breast cancer due to family history or prior personal history of breast cancer, positive genetic testing, or other indications as determined by a woman's health care provider. Effective immediately.
Amends the Uniform Peace Officers' Disciplinary Act. Provides that Secretary of State sergeants, lieutenants, commanders, and investigator trainees are included in the definition of "officer".
Amends the Department of Human Services (Alcoholism and Substance Abuse) Law of the Civil Administrative Code of Illinois. Provides that any person who is required to submit to a drug test within the State must pay a $2 fee. Provides that the funds shall be deposited into a special fund in the State treasury and may be used to make grants to drug courts for certain specified purposes. Creates the position of Statewide Drug Court Coordinator within the Department of Human Services. Amends the State Finance Act to make conforming changes.
Amends the Counties Code. Provides that a county may establish standards for wind farms and electric-generating wind devices. Provides that a county may regulate zoning with respect to wind farms and electric-generating wind devices. Provides that a municipality may not regulate zoning with respect to wind farms and electric-generating wind devices in a manner that conflicts with an existing county ordinance. Limits the concurrent exercise of home rule powers.
