OBRE-DAGING-FRAUD

Amends the Office of Banks and Real Estate Act. Requires the Commissioner of Banks and Real Estate to work in cooperation with the Director of Aging to ensure that all financial institutions regulated by the Office of Banks and Real Estate participate fully in the Department on Aging's financial exploitation of the elderly intervention program. Effective immediately.

MORT INSURANCE-OVERINSURANCE

Amends the Mortgage Insurance Limitation and Notification Act. Prohibits a lender from requiring a borrower, as a condition of receiving or maintaining a loan secured by real property, to provide hazard insurance coverage against risks to the improvements on that real property in an amount exceeding the replacement value of the improvements on the real property. Requires the lender to disclose to the borrower, in writing, that the borrower is not required to have hazard insurance coverage against risks to the improvements on that real property in an amount exceeding the replacement value of the improvements on the real property. Effective immediately.

PEN CD-CHGO FIRE-SALARY

Amends the Chicago Firefighter Article of the Illinois Pension Code. Changes the definition of salary to include duty availability pay. Allows certain persons to have their salary for pension purposes retroactively adjusted to include duty availability pay previously received, upon payment of the corresponding employee contributions, without interest. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

SENIOR RX DRUGS-MEDICARE

Amends the Senior Pharmaceutical Assistance Act. Provides that if a prescription drug benefit is added to the federal Medicare program, State-operated senior prescription drug programs shall be realigned to ensure that Illinois residents qualify for at least the same level of benefits available to them prior to implementation of the Medicare prescription drug benefit. Requires a Senior Pharmaceutical Assistance Review Committee report on the matter within 60 days after the Medicare prescription drug benefit becomes law. Effective immediately.

STATE RESIDENTIAL BUILDNG CODE

Creates the Illinois Residential Building Code Act. Provides that a contract to build a home in any municipality or unincorporated portion of a county that does not have a residential building code in effect must include, as part of the construction contract, the applicability of a residential building code that is agreed to by the home builder and the home purchaser. The home builder and the home purchaser may agree to adopt any municipal residential building code or county residential building code that is in effect in any county or municipality that is within 100 miles of the location of the new home. If the home builder and the home purchaser fail to agree to a residential building code or if no residential building code is stated in the contract, the International Residential Code shall, by law, be adopted as part of the construction contract. Effective January 1, 2004.
