PENCD-SERS-VESTING

Amends the State Employees Article of the Illinois Pension Code. Provides that a member is entitled to a retirement annuity if he or she is in service upon attainment of age 60 after having at least 3 years of creditable service. Effective immediately.

RECREATION USE LAND-ARTIFICIAL

Amends the Recreational Use of Land and Water Areas Act. Provides that the purpose of the Act is to encourage owners of land to make land and water areas available to any person whether invited or uninvited (instead of the public) for recreational or conservation purposes by limiting their liability toward persons entering thereon for such purposes. Changes the definition of "land". Defines "artificial addition". Provides that, for any artificial addition, an owner of land owes a duty of care to keep the premises safe and properly maintained for entry or use by any person for recreational or conservation purposes. Provides that an owner of land must give warning of any natural or artificial dangerous condition, use, or activity concerning the artificial addition on the premises to persons entering for recreational and conservation purposes. Provides that an owner of land is not liable for any misuse of the artificial addition by the person entering the land.

EPA-LANDFILL-POST CLOSURE-BOND

Amends the Environmental Protection Act. Requires the Department to establish and maintain a program to monitor the status of performance bonds or other security required to operate a solid waste disposal site. Provides that if the Agency determines that a bond or other security is insufficient to ensure the closure of a site and post-closure care, the Agency must notify that operator of the site of the insufficiency and require any additional security and requires the operator to obtain additional security. Provides that if, upon or after the closure of a site, a performance bond or other security required under this Section is discovered to be insufficient to ensure the closure of a site and post-closure care in accordance with this Act, the Agency shall use any unencumbered moneys in the Landfill Closure and Post-Closure Fund for the purpose of taking any action necessary to bring the closure and post-closure of the site into compliance with this Act, and, if no unencumbered moneys exist in the Fund, the Department shall request from the General Assembly an appropriation to the Fund to bring the closure and post-closure of the site into compliance with this Act. Effective immediately.

EPA-FEES

Amends the Environmental Protection Act. Reduces the amounts various fees to be collected by the Environmental Protection Agency. Sets forth new procedures for the collection of NPDES fees and requires that all moneys collected from the fees be deposited into the Illinois Clean Water Fund. Repeals Sections concerning air pollution operating permit fees and fees for water quality certification. Amends the State Finance Act to create the Illinois Clean Water Fund. Effective immediately.
