PROBATE-CAUSING DEATH-INSANE

Amends the Probate Act of the 1975. Provides that a person acquitted by reason of insanity but who has been found by the court to have in fact committed the murder of the decedent shall also be conclusively presumed to have caused the death intentionally and unjustifiably for inheritance purposes. Adds a tenancy to the list of types of property that a person who intentionally and unjustifiably causes the death of another is banned from receiving. Effective immediately.

GANG TATTOO REMOVAL ACT

Creates the Gang Tattoo Removal Act. Establishes the Gang Tattoo Removal Task Force. Provides for the appointment of members to the Task Force. Requires the Task Force to study the costs and effectiveness of a program for the removal of gang tattoos. Requires the Task Force to submit a report of its findings to the General Assembly no later than January 1, 2008. Provides that Task Force members shall be reimbursed for reasonable and necessary expenses. Repeals the Act on January 2, 2008.

GRF TRANSFERS

Amends the State Finance Act. Provides that the Governor may, through June 30, 2005 (now, June 30, 2007), direct the State Treasurer and Comptroller to transfer a specified sum from any fund held by the State Treasurer to the General Revenue Fund in order to help defray the State's operating costs for the fiscal year. Provides that no transfers may be made in this manner after June 30, 2005. On January 1, 2006, or as soon as may be practical after than date, the State Treasurer and the Comptroller shall reverse all transfers previously made under this authority unless the General Assembly has specifically authorized the transfers prior to that date. Places the same restrictions and requires the same reverse transfers with respect to the allocation and transfer of amounts generated by certain new and increased fees. Effective immediately.

HOSPITALS-SCREEN FOR MRSA

Amends the University of Illinois Hospital Act and the Hospital Licensing Act. Provides that every hospital subject to either of the Acts must screen all patients for methicillin-resistant Staphylococcus aureus (MRSA) in accordance with guidelines published by the Centers for Disease Control and Prevention. Provides that if a patient tests positive for MRSA, the hospital must so inform the patient and offer treatment to the patient. Requires hospitals to report all cases of MRSA to the Department of Public Health in the form and manner prescribed by the Department in rules.

NURSNG HOME-ABUSE PREVENTION

Amends the Counties Code, the Abuse Prevention Review Team Act, and the Nursing Home Care Act. Requires a nursing home administrator to notify the coroner or medical examiner within 24 hours of the death of a nursing home resident; makes a failure to do so a Class A misdemeanor. Provides for a single Residential Health Care Facility Resident Sexual Assault And Death Review Team instead of multiple review teams. Requires the Review Team to review a nursing home resident's death (i) if the resident's death results in the Department of Public Health issuing a notice of violation under the Nursing Home Care Act (instead of if the Department found that the resident's care violated federal or State standards within the 6 months preceding the resident's death) or (ii) if the resident's death was reported to the coroner or medical examiner as required under certain provisions of the Nursing Home Care Act (instead of if the resident's care was the subject of a complaint to the Department). Requires the Department to include the Review Team's activities in its annual Long-Term Care Report to the General Assembly. Extends the repeal of the Abuse Prevention Review Team Act from July 1, 2006 to July 1, 2011. Makes other changes. Amends the Open Meetings Act and the Freedom of Information Act to make conforming changes. Effective immediately.

USE & OCC TAX-EXEMPTIONS

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that tax exemptions for certain food and medical supplies for long-term care residents receiving medical assistance are exempt from the sunset provisions of the Acts. Effective immediately.
