LONG TERM CARE INSURANCE-STUDY

Amends the Department of Insurance Law of the Civil Administrative Code of Illinois. Requires the Department of Insurance, the Department on Aging, and the Department of Central Management Services to conduct a study concerning the failure of Illinois residents to purchase long-term care insurance. Requires those departments to take steps to encourage the purchase of long-term care insurance through the private sector. Requires CMS to encourage State employees to purchase the optional long-term care insurance coverage offered by the Department. Requires the departments to report annually to the Governor and the General Assembly. Effective immediately.

HYPNOSIS CONSUMER PROTECT ACT

Creates the Hypnosis Consumer Protection Act. Provides that an unlicensed practitioner providing hypnotism services shall be guilty of a petty offense and subject to a fine not to exceed $500 plus other fees if he or she: 1) willfully diagnoses or independently treats a physical or mental illness of any person, 2) conducts surgery or any other procedure on any person that punctures the skin, 3) prescribes or administers x-ray radiation to any person, 4) prescribes or administers legend drugs or controlled substances, 5) recommends to any person discontinuance of medication prescribed by a physician, or 6) implies that he or she is an Illinois licensed health care practitioner. Provides that an unlicensed person providing hypnotism services shall disclose to the client in a written statement, information relating to the nature of the services provided and his or her academic and professional experience, and he or she shall obtain written acknowledgment from the client that such information was provided.

POISON CONTROL SYSTEM-FUNDING

Amends the Poison Control System Act. Requires the Department of Public Health to establish a funding formula for the Poison Control System. Provides that the formula must increase or decrease the annual funding amount to match any increase or decrease in the consumer price index as reported on January 1 of each year. Provides that the State shall continue to provide funding to the Illinois Poison Control System on an annual basis in furtherance of the goals of the funding formula. Effective immediately.

INS CD-DEFERRED ANNUITIES

Amends the Illinois Insurance Code. In provisions pertaining to the minimum values, as specified in the Section, of any paid-up, cash surrender or death benefits available under an annuity contract be based upon minimum nonforfeiture amounts as defined, modifies the definition determining the minimum nonforfeiture amount. Provides that the interest rate used in determining minimum nonforfeiture amounts to be an annual rate of interest determined as the lesser of 3% per annum and the following, which shall be specified in the contract if the interest rate will be reset, (i) the 5-year Constant Maturity Rate reported by the Federal Reserve, (ii) reduced by 125 basis points, (iii) the resulting interest rate is not less than 1%, and (iv) the interest rate applies for an initial period and may be redetermined for additional periods. Clarifies existing language and makes other changes. Effective July 1, 2006.

PEN CD-SURS-POLICE FORMULA

Amends the State Universities Article of the Illinois Pension Code. Increases the retirement formula for a participant who has 20 or more years of service as a police officer or firefighter. Also increases the employee contributions for participants who are police officers or firefighters by a total of 3% of earnings, in 3 annual increments. Effective immediately.

INS CD-VEHICLE COVERAGE

Amends the Illinois Insurance Code. In provisions giving an applicant's the right to reject additional uninsured motorist coverage, provides the same right to insureds. Provides that a rejection of additional uninsured motorist coverage in excess of the limits set forth in the Illinois Vehicle Code must be executed by the applicant or insured before the policy is issued by the insurer or within 60 days after the issuance of the policy. Effective immediately.
