Sen. Dave Syverson

Amends the Criminal Code of 1961 relating to disorderly conduct. Provides that engaging in any loud protests of singing, chanting, whistling, or yelling with or without noise amplification, displaying any visual images that convey fighting words or actual or veiled threats against any other person, engaging in a directed protest march or picket at any public location when any of these activities are conducted within 300 feet of any entrance to a facility being used for a funeral or memorial service, or blocking access to such facility at any time during the period starting 30 minutes before any funeral or memorial service is scheduled to begin and ending 30 minutes after the funeral or memorial service terminates is disorderly conduct in which the penalty is a Class C misdemeanor. Provides that the provisions of the Act are severable. Effective immediately.

Appropriates $1 from the General Revenue Fund to the Department of Healthcare and Family Services for any initial costs associated with implementing managed care principles in the Illinois Medicaid Program. Effective July 1, 2005.

Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides for the transfer of $170,000,000 from the General Revenue Fund to the Road Fund in each of Fiscal Years 2007, 2008, and 2009. Directs the Department of Transportation to use this money to make grants to certain counties for the mitigation and relief of traffic congestion and for road or other transportation projects relating to business development. Bases eligibility for grants on county population growth and, for one class of grants, on county unemployment rates. Apportions 40% of available grant funds on the basis of county population; apportions 40% of available grant funds on the basis of population growth; and apportions 20% of available grant funds equally among eligible counties with high unemployment. Directs the Department to distribute the grants to the eligible counties as quickly as may be practical. Provides that an eligible county must establish its eligibility to the satisfaction of the Department, but need not specify the grant projects or other proposed uses of the grant at the time of application for the grant or before receiving the grant money. Amends the State Finance Act to exempt the grant funds from any limitations on the use of moneys from the Road Fund. Effective July 1, 2006.

Creates the Employment Impact Note Act. Requires that a note be prepared for a bill before second reading in the house of introduction concerning the impact of the bill on employment opportunities in Illinois. Also, requires a note for administrative rules before approval by JCAR. Requires the Commission on Government Forecasting and Accountability to prepare the notes.

Amends the Illinois Business Regulatory Review Act. In a Section concerning the regulatory policy responsibilities of the Business Regulatory Review Committee, provides that the Committee shall identify effective and efficient ways of notifying small business about proposed and newly adopted rules.

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no person may sell consumer identification or purchasing information of Illinois residents to other persons without providing written notice to the Illinois resident before doing so and giving the resident 30 days after the resident receives the notice to refuse permission to sell his or her information. Provides that a notice must give the resident the option to refuse all sales or transfers of his or her information by that person. Makes it an unlawful practice to violate these provisions.

Amends the Associate Judges Act. Provides that the chief judge of any circuit may petition the Supreme Court to appoint temporary contractual judges. Provides that if the listed factors are met and there has been shown to be adequate local or State funding, then the Supreme Court may authorize the appointment of one or more temporary contractual judges to help with the backlog of cases. Provides that the temporary contractual judge appointments shall be made from persons who have previously served as associate judges and whose terms have expired. Excepts temporary contractual judges from the retirement age provisions. Amends the Pension Code. Exempts associate judges who have been appointed as temporary contractual judges from the suspension of their retirement annuity payments. Effective immediately.

Creates the Consumer Protection Against Computer Spyware Act. Sets forth provisions for unauthorized collection or culling of personally identifiable information, unauthorized access to or modifications of computer settings and computer damage, unauthorized interference with installation or disabling computer software, and other prohibited conduct. Provides that certain persons may bring a civil action against a violator of the Act. Provides a civil penalty for violations of the Act. Permits the Attorney General to obtain a restraining order or injunction for violations of the Act.

Amends the State Finance Act. Exempts the Underground Storage Tank Fund from the Act's administrative charge-back provisions. Effective immediately.

Creates the Pension Funding and Investments Act. Requires pension plan providers to provide statements to members of a plan that include (1) the actuarial value of the assets and liabilities of the plan, (2) the extent to which the plan is funded, (3) the plan's funding policy, and (4) asset allocations based on the percentage of overall plan assets. Provides that, if a request is made by a contributing employer or labor organization, then a pension plan provider must make available (1) copies of all actuary reports received by the pension plan provider for a plan year and (2) copies of all financial reports prepared by fiduciaries of the pension plan provider. Amends the Illinois Pension Code. Requires a retirement system or pension fund established under the Code to provide a statement to each member and annuitant that includes (1) the actuarial value of the assets and liabilities of the system or fund, (2) the extent to which the system or fund is funded, (3) the extent to which funding is required under this Code, and (4) asset allocations based on the percentage of overall assets of the system or fund. Provides that, if a request is made by a contributing employer or labor organization, then a retirement system or pension fund must make available (1) copies of all actuary reports received by the system or fund for the State fiscal year and (2) copies of all financial reports prepared by fiduciaries of the retirement system or pension fund. Effective immediately.
