MUNI CD-RECYCLED MATERIALS

Amends the Illinois Municipal Code. Provides that material that is intended or collected to be recycled is not garbage, refuse, or ashes. Effective immediately.

DCFS-VOLUNTARY PLACEMENT

Amends the Children and Family Services Act. Requires the Department of Children and Family Services to develop, by rule, criteria for determining when a child may be voluntarily placed in out-of-home care funded by the Department for the purpose of obtaining mental health treatment for the child or treatment for the child's developmental disability. Provides that relinquishment of custody of a child shall not be a condition for receipt of services or care delivered or funded by the Department. Provides that a child voluntarily placed in out-of-home care shall be placed pursuant to a voluntary placement agreement voluntarily entered into by the parent or legal guardian of the child. Provides that for a child to remain in out-of-home care for longer than 180 days, a juvenile court must make a judicial determination within the first 180 days of the placement that the placement is in the best interests of the child. Provides that the inability of a parent or legal guardian to care for a child with a serious mental illness, serious emotional disturbance, or developmental disability shall not in itself be the basis for a finding of abuse or neglect of the child. Effective immediately.

REHABILITATION TAX CREDIT

Creates the Illinois Rehabilitation and Revitalization Tax Credit Act. Creates a credit against taxes imposed under the Illinois Income Tax Act and the Illinois Insurance Code in an aggregate amount equal to 20% of qualified expenditures incurred by a qualified taxpayer pursuant to a qualified rehabilitation plan on a qualified structure, provided that the total amount of such qualified expenditures exceeds the greater of $5,000 or the adjusted basis of the property. Contains provisions concerning the transfer of credits. Sets forth the maximum annual amount of credits that may be approved by the Department. Amends the Illinois Income Tax Act and the Illinois Insurance Code to make conforming changes. Effective January 1, 2017.

ELECTRONIC PRODUCTS RECYCLING

Amends the Electronic Products Recycling and Reuse Act. Provides that, if manufacturers meet their recycling goals prior to the end of the year and recyclers no longer pick up CEDs and EEDs without charge, municipalities, townships, and other units of local government that are acting as collectors shall be allowed to collect a fee from consumers who drop off CEDs and EEDs for recycling. Effective immediately.

TWP CD-DISCONTINUE TOWNSHIP

Amends the Township Code. Removes a requirement that a township must be located within a county with a population of 3,000,000 or more and that it must contain a territory of 7 square miles or more in order to discontinue and abolish a township organization within a coterminous municipality. Effective immediately.

PREV WAGE FALSE CLAIM DAMAGES

Amends the Prevailing Wage Act. Defines "compensatory damages" and "actual damages" as the sum of economic and non-economic damages. Provides that any individual, contractor, or subcontractor who has been aggrieved by a filed false complaint may institute a civil action for damages, including, but not limited to, compensatory damages, legal fees, administrative fees, penalties assessed by the Department of Labor pursuant to the complaint, injunctive relief, and other appropriate equitable relief. Provides that no public body, including a home rule unit, is authorized to use as a basis for denying a contract to a contractor or subcontractor any complaint filed with the Department or any determination by the Department that the contractor or subcontractor has committed a violation under this Act, unless the contractor or subcontractor is debarred at the time of the bid. Effective immediately.

FINANCE-INTRAFUND TRANSFERS

Amends the State Finance Act. Provides that any agency receiving less than $10,000,000 in any fiscal year in funding from the General Revenue Fund for operations may transfer amounts among its respective appropriations contained in operational line items within the same treasury fund. Provides that the transfers may be made in an amount not to exceed 4% of the aggregate amount appropriated to the agency within the same treasury fund. Defines "agency". Effective immediately.

ESTATE TAX-EXCLUSION AMOUNT

Amends the Illinois Estate and Generation-Skipping Transfer Tax Act. Provides that, for persons dying on or after January 1, 2017, the exclusion amount shall be the applicable exclusion amount under the Internal Revenue Code. Effective immediately.

PUBLIC LABOR ARBITRATION

Amends the Illinois Public Labor Relations Act. Provides that an arbitration hearing shall be open to the public and held within the district or boundaries of the security, peace officer, or fire fighter public employer, unless both parties agree to close the hearing to the public. Provides that in no event shall the decision of the arbitration panel regarding economic issues exceed the financial ability of the employer to fund the award based upon the current revenues and expenses of the employer, including annual pension funding requirements, and without consideration of the ability of the employer to increase tax levels prospectively.
