CLEAN CAR ACT

Creates the Illinois Clean Car Act. Provides that the Environmental Protection Agency shall propose and the Pollution Control Board shall establish by rule a Clean Car Program that is (i) authorized by Section 177 of the federal Clean Car Act, and (ii) applicable to vehicles of the 2012 model year and every subsequent model year. Provides that the Agency shall establish new motor vehicle emission standards and compliance requirements for vehicles under the Program. Provides that the Agency may work in collaboration with other states in developing the Program. Provides that the Secretary of State shall not, with certain exceptions, register or issue a title for a new motor vehicle that is subject to the provisions of this Act if the motor vehicle is not in compliance with the provisions of this Act or rule adopted under this Act. Provides that the Secretary of State, in consultation with the Agency, shall adopt rules to prohibit the transfer of new motor vehicles or new motor vehicle engines that are not in compliance with the provisions of this Act. Effective immediately.

USE & OCC TAXES-MANUFACTURING

Amends the Use Tax Act and the Retailers' Occupation Tax Act. Provides that the manufacturing and assembling machinery and equipment exemption also includes production related tangible personal property. Defines "production related tangible personal property" as all tangible personal property used or consumed by the purchaser in a manufacturing facility in which a manufacturing process takes place, including tangible personal property purchased for incorporation into real estate within a manufacturing facility and including, but not limited to, tangible personal property used or consumed in activities such as research and development, preproduction material handling, receiving, quality control, inventory control, storage, staging, and packaging for shipping and transportation purposes. Provides that "production related tangible personal property" does not include (i) tangible personal property used, within or without a manufacturing facility, in sales, purchasing, accounting, fiscal management, marketing, personnel recruitment or selection, or landscaping or (ii) tangible personal property required to be titled or registered with a department, agency, or unit of federal, state, or local government. Effective immediately.

DHS-TANF-GRANT INCREASE

Amends the Illinois Public Aid Code. Provides that beginning July 1, 2007, the Department of Human Services shall increase TANF grant amounts in effect on June 3, 2007 by 15%. Effective immediately.

PROP TX-HOMESTEAD EXEMPTIONS

Amends the Property Tax Code. In the alternative general homestead exemption, increases the maximum amount of the exemption to $40,000 for taxable years 2007 and thereafter. In the long-time occupant homestead exemption, deletes a provision that the property's base homestead value is increased by 10% for each taxable year after the base year for qualified taxpayers with a household income of more than $75,000 but not exceeding $100,000. Provides, instead, that the property's base homestead value is increased by 7% for each taxable year after the base year for qualified taxpayers with a household income of $100,000 or less. Effective immediately.

UTILITIES-PROHIBITED INSTALLS

Amends the Public Utilities Act. Provides that the Illinois Commerce Commission, for reasons of safety and reliability, shall adopt rules to prohibit residential, commercial, and industrial customers from installing their own distribution facilities and equipment. Provides that the Commission shall have the authority to impose significant penalties to customers and electric utilities for a violation of the rules. Effective immediately.

CIRCUIT BREAKER-INCOME-DRUGS

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In connection with the pharmaceutical assistance program, provides eligibility for persons who have a maximum household income at or below 225% of the Federal Poverty Level if they qualify under certain conditions. Eliminates an Eligibility Group consisting of persons who are disabled and under age 65, or age 65 or older with incomes related to 200% of the Federal Poverty Level, and who are eligible for Medicare Part D coverage. Provides that for persons who have a diagnosis of HIV or AIDS, "covered prescription drug" means those drugs covered by the Medicare Part D Prescription Drug Plan in which the beneficiary is enrolled (eliminates a reference to drugs included in the formulary of the Illinois AIDS Drug Assistance Program operated by the Illinois Department of Public Health). Provides that in defining countable income for purposes of the pharmaceutical assistance program, the Department of Healthcare and Family Services or the Department on Aging must disregard the cost-of-living increase to any benefit administered by the Social Security Administration in any year that the percentage increase of the Social Security Administration cost-of-living adjustment is higher than the percentage increase in the Federal Poverty Level. Adds provisions concerning the effective date of eligibility for the pharmaceutical assistance program. Effective immediately.

PHARM TECH-WHOLESALE DIST BOND

Amends the Pharmacy Practice Act. Includes registered pharmacy technicians in provisions concerning license and certificate expiration, renewal, and restoration and licensee and registrant military service. Sets forth continuing education requirements for pharmacy technicians. Amends the Wholesale Drug Act to repeal a Section that requires wholesale distributors to submit a bond to the Department. Effective immediately.
