ENERGY EFFICIENCY-RESIDENTIAL

Amends the Energy Efficient Commercial Building Act. Changes the short title to the Energy Efficient Building Act. Provides a definition of "building". Applies the Act to residential and commercial buildings (now, all commercial buildings). Provides that the Capital Development Board must adopt the specified energy conservation code as the minimum requirements for commercial buildings and as the minimum and maximum requirements for the construction of residential buildings. Provides that units of local government may not regulate energy efficient building standards for residential buildings in a manner that is either less or more stringent than the standards in the Act. Provides that units of local government may not enact any annexation ordinance or resolution, or require or enter into any annexation agreement, that imposes energy efficiency building standards for residential buildings that are either less or more stringent than the energy efficiency standards in effect throughout the unit of local government. Provides that any unit of local government that has adopted any previously published editions of the International Energy Conservation Code on or before January 1, 2009 may continue to regulate energy efficient building standards under that Code and any supplements the unit of local government has adopted prior to January 1, 2009. Preempts home rule powers. Effective immediately.

Amends the Children's Privacy Protection and Parental Empowerment Act. Makes a technical change in a Section concerning information brokers.

CRIM CD-STALKING&CYBERSTALKING

Amends the Criminal Code of 1961. Changes the elements of the offenses of stalking and cyberstalking. Provides that a person commits stalking when he or she knowingly engages in a course of conduct directed at a specific person, and he or she knows or should know that this course of conduct would cause a reasonable person to: (1) fear for his or her safety or the safety of a third person; or (2) suffer other emotional distress. Provides that if the conduct is committed using electronic communication, the offense is cyberstalking. Provides that a person also commits aggravated stalking when he or she, in conjunction with committing the offense of stalking, violates a stalking no contact order or a civil no contact order. Retains the same penalties for the offenses.

EPA-USED TIRE CITATIONS

Amends the Environmental Protection Act. Authorizes the Environmental Protection Agency to issue an administrative citation and impose a civil penalty if any person (i) causes or allows water to accumulate in used tires, (ii) fails to collect the new or used tire fee as required by Section 55.8, (iii) fails to file a State tax return listing, among other things, the number of tires sold at retail during the past calendar year as required by Section 55.10, or (iv) transports used or waste tires in violation of the registration and vehicle placarding requirements adopted by the Pollution Control Board. Effective immediately.

DHS-COMMUNITY SRVCS-COMMISSION

Amends the Community Services Act. Requires the Governor to create a commission by July 1, 2009 (instead of 2007) to review various matters in connection with funding for community services. Provides that if the Governor does not make appointments to the commission by July 1, 2009, then the Speaker and Minority Leader of the House of Representatives and the President and Minority Leader of the Senate shall make appointments to the commission. Provides that the commission must issue a final report no later than December 31, 2010 (instead of September 1, 2008). Adds 3 directors of Department of Human Services (DHS) divisions as commission members. Requires DHS to provide staff support for the commission. Effective immediately.

DHS-DRUG OVERDOSE PREVENTION

Amends the Alcoholism and Other Drug Abuse and Dependency Act. Provides that the Director of the Division of Alcoholism and Substance Abuse within the Department of Human Services may publish an annual report on statewide drug overdose trends, may establish a program to provide for the publication of drug overdose prevention, recognition, and response literature, may provide advice to State and local officials concerning drug overdose problems, and may award grants to create or support local drug overdose prevention, recognition, and response projects. Requires a health care professional prescribing an opioid antidote to a patient to ensure that the patient receives certain patient information; provides for immunity from disciplinary or other adverse administrative action; and provides for administration of an opioid antidote in an emergency. Requires the Director of the Division of Alcoholism and Substance Abuse, in consultation with statewide organizations, to develop and disseminate to health care professionals, community-based organizations, substance abuse programs, and other organizations training materials in video, electronic, or other formats to facilitate the provision of the required patient information. Effective January 1, 2010.

NURSING HOME-INTERMEDIATE CARE

Creates the MR/DD Community Care Act and amends the Nursing Home Care Act. Provides that all intermediate care facilities for the developmentally disabled and long-term care for under age 22 facilities shall be licensed by the Department of Public Health under the MR/DD Community Care Act instead of under the Nursing Home Care Act. Makes the provisions in the MR/DD Community Care Act substantially the same as those in the Nursing Home Care Act, including provisions for the rights of residents and responsibilities of facilities, licensing, violations and penalties, and transfer or discharge of residents. Amends the Department of Human Services Act, the Illinois Health Facilities Planning Act, the Illinois Income Tax Act, the Nursing Home Administrators Licensing and Disciplinary Act, the Illinois Public Aid Code, the Nursing Home Grant Assistance Act, and the Unified Code of Corrections and other Acts to make conforming changes. Effective immediately.

DCFS-ABANDONED NEWBORN INFANT

Amends the Illinois Public Aid Code and the Abandoned Newborn Infant Protection Act. Provides that for purposes of the Abandoned Newborn Infant Protection Act, "fire station" means a fire station with at least one staff person (instead of that is staffed with at least one full-time emergency medical professional). Provides that "newborn infant" means a child who a licensed physician reasonably believes is 30 (instead of 7) days old or less. Defines "safe haven" to mean a hospital, fire station, police station, or emergency medical facility at which a newborn infant may be relinquished. Provides that any public reporting of information required in connection with the relinquishment of a newborn infant, including, but not limited to, reporting required under the Vital Records Act or under any other law, shall identify the mother of the relinquished newborn infant and the infant as "unknown". Makes changes concerning the information packet that a hospital or other facility must offer to a person who relinquishes a newborn infant. Provides that a relinquished newborn infant's mother, as well as the infant, are eligible for medical assistance under the Illinois Public Aid Code. Provides that the Department of Children and Family Services shall notify a hospital to whom a newborn infant has been relinquished of the name of the child-placing agency authorized by the Department to take custody of the infant from the hospital. Provides that if a relinquished newborn infant was born in a hospital and was relinquished to the hospital without having left the hospital, the Department need not verify that the infant is not a missing child before filing a petition for termination of parental rights.
