DCFS-GROUP HOME-ABUSE REPORTS

Amends the Children and Family Services Act. Provides that beginning on the effective date of this amendatory Act, the Department of Children and Family Services shall investigate reports of abuse or neglect of any person between the ages of 18 and 21 years who is identified as having a developmental disability or a mental illness, as defined in the Mental Health and Developmental Disabilities Code, and is receiving services in a residential setting licensed by the Department of Children and Family Services. Effective immediately.

INS CD-CREDIT IN UNDERWRITING

Amends the Use of Credit Information in Personal Insurance Act. In the provision concerning scope, includes non-commercial farm owners insurance policies and personal umbrella policies in the definition of "personal insurance". Makes changes in the provision concerning definitions. Makes changes in the provision concerning the use of credit information. Sets forth the methods that an insurer may use in its credit-related underwriting and rating of consumers. Sets forth disclosure requirements. Adds military deployment of a consumer to the definition of "extraordinary life event". Provides that an insurer must file language in its underwriting guidelines acknowledging the requirement to review and consider extraordinary life events. Provides that an insurer shall re-underwrite the consumer within 30 days if it is determined through any dispute resolution process (instead of the dispute resolution process set forth in the federal Fair Credit Reporting Act) that the credit information of a consumer was incorrect. Provides that scoring models filed by third parties are considered as filed by insurers and subject to the requirements of the Act. Provides that all rate, rating rule, underwriting guideline, and scoring model filings relating to credit information will be deemed to be public information and not considered to be a trade secret under the Illinois Trade Secrets Act. Makes other changes. Effective immediately.

COLLEGE TEXTBOOK PUBLISHING

Creates the Transparency in College Textbook Publishing Practices Act. Provides that when contacting or being contacted by prospective clients, each publisher of college textbooks shall disclose, at that time and in writing, to the faculty member or, if applicable, the other adopting entity in charge of selecting textbooks for courses taught at a public institution of higher education (1) the copyright dates of the 3 previous editions of the textbook, if any; (2) a description of the substantial content changes made between the current edition of the textbook or supplemental materials and the previous edition, if any; and (3) the existence and price of alternative formats of the textbook or supplemental materials. Provides that publishers of college textbooks are required to offer all bundled textbooks for sale as individual unbundled textbooks and supplemental materials. Contains a provision concerning institutional autonomy and academic freedom. Effective July 1, 2010.

LUPUS EDUCATION AWARENESS ACT

Creates the Lupus Education and Awareness Act. Establishes the Lupus Education and Awareness Program within the Department of Public Health subject to appropriation. Provides that the Program shall raise public awareness, educate consumers, and educate and train health professionals, human service providers, and other audiences. Sets forth the responsibilities of the Director of the Department of Public Health concerning the Program. Provides that the Department shall establish and coordinate the Interagency and Partnership Advisory Panel on Lupus. Sets forth the membership guidelines and duties of the Panel. Provides that subject to appropriation, the Department may make expenditures of up to $2,500 for the fiscal year 2010 for use toward providing educational materials to clinics. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code. Repeals the Section concerning lupus education and outreach.

ELDER ABUSE-MANDATED REPORTER

Amends the Elder Abuse and Neglect Act. Provides that a "mandated reporter" under the Act includes (i) any bank, savings and loan, or credit union officer, trustee, or employee and (ii) any ambulatory currency exchange or community currency exchange, as defined in the Currency Exchange Act, or an employee of such a currency exchange.

SAFETY-TECH

Creates the Mercury Thermostat Collection Act. Requires certain thermostat manufacturers, not later than October 1, 2011, to submit to the Illinois Environmental Protection Agency a plan that describes a collection and financial incentive program for mercury thermostats. Requires these manufacturers, no later than January 1, 2012, to implement the Agency-approved plan and to report certain information about their collection efforts by April 1, 2012 and April 1 of each year thereafter. Prohibits, beginning on April 1, 2011, a thermostat wholesaler from selling or distributing thermostats unless it acts as a collection site for thermostats that contain mercury, participates in an education and outreach program to educate consumers on the collection program for mercury thermostats, and meets other requirements. Provides that manufacturers, thermostat wholesalers, and thermostat retailers are subject to certain sales prohibitions beginning on April 1, 2011. Provides for public comment on manufacturer plans. Requires the Agency to post certain information on its website, conduct an educational program, and report certain information about the program to the legislature. Authorizes the Agency to modify manufacturer plans and conduct certain investigations. Defines "Agency", "Board", "out-of-service mercury thermostat", "person", "thermostat manufacturer", "thermostat retailer", and "thermostat wholesaler". Effective immediately.
