DPT AGING-IDPH-CRIM HISTORY

Amends the Illinois Act on the Aging and the Nursing Home Care Act. Provides that all persons age 18 or older seeking admission to a nursing facility must be screened for criminal history prior to being admitted. Provides that screening may be done by agencies other than the Department of Public Health as established by administrative rule and shall include the initiation of a background check consistent with established standards for all persons age 18 or older with the results submitted to the Department. Further provides that all background check results received by the Department shall be maintained in such a manner to permit residential and non-residential providers access to the information, and that a facility, except for those licensed as long term care for under age 22 facilities, shall, within 24 hours after admission, request the results from a criminal history background check from the Department. Effective immediately.

PUB AID-AABD PILOT PROGRAM

Amends the Aid to the Aged, Blind, or Disabled Article of the Illinois Public Aid Code. Provides that the General Assembly is committed to a public participatory process in developing any pilot or demonstration program seeking to implement managed care or integrated care for Medicaid eligible adults who are aged, blind, or disabled, and that to assure such a process, the General Assembly and the Governor shall establish a task force to develop the core values of any such program, and to oversee its further development and implementation. Requires the task force to assess Illinois' readiness for developing such a pilot or demonstration program by analyzing lessons learned from other states that have attempted to implement similar programs, and to develop a comprehensive concept paper outlining the core values for the pilot or demonstration program or a comprehensive report outlining the explanations for why Illinois is not sufficiently prepared to develop a pilot or demonstration program. Provides that if the task force determines Illinois is sufficiently prepared to develop a pilot or demonstration program, then the task force shall work collaboratively with the Department of Healthcare and Family Services to plan, design, and implement the program. Contains provisions regarding the composition of the task force; the task force's duration; the frequency of task force meetings; and public hearings. Further provides that the Department on Aging, the Department of Healthcare and Family Services, and the Department of Human Services shall provide necessary staff support to operate the task force. Effective immediately.

ABUSED CHILD-DEFINITION

Amends the Abused and Neglected Child Reporting Act. Provides that "abused child" means a child with respect to whom any person inflicts injury or commits other specified acts (instead of meaning a child whose parent or immediate family member, or any person responsible for the child's welfare, or any individual residing in the same home as the child, or a paramour of the child's parent, commits any of those acts).

SCH CD-MEDICATION MGMT PLAN

Amends the School Code. Provides that when a student needs to receive any medication in school or during school activities, a medication management plan must be established if the parent or guardian of the student submits a signed request accompanied with sufficient proof of diagnosis of a condition or illness necessitating assistance with administering any medication to the student. Provides that the school principal and the parents or guardian must develop and agree on a plan. Provides that absent a full-time school nurse, the school principal must appoint, supervise, and coordinate the training of a designated health care aide to perform the tasks necessary to assist a student in accordance with the plan. Provides that a school must provide a one-page information sheet regarding a student's plan to each employee providing transportation for the student or supervising the student during a school-sponsored activity. Provides that a school district may not restrict the assignment of a student with a plan to a particular school on the basis that the school does not have a full-time nurse or a designated health care aide, nor may a school deny access to a student on the basis that the student requires a plan. Exempts the school and school employees from civil liability for conduct related to the care of a student in accordance with a plan, except for willful or wanton misconduct. Amends the Nurse Practice Act to allow persons to be employed as unlicensed assistive personnel in schools. In a Section concerning nursing delegation, provides that a school nurse, a registered professional nurse, or an advanced practice nurse may teach or train other persons in first aid, emergency care, or cardiopulmonary resuscitation. Effective January 1, 2010.

Amends the Firearm Owners Identification Card Act. Requires a person who is not a federally licensed importer, manufacturer, or dealer and who desires to sell or transfer a firearm of a size that may be concealed upon the person to another person, who is not a federally licensed importer, manufacturer, or dealer, to do so only at the place of business of a federally licensed firearm dealer. Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus any applicable fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or a grandparent and grandchild, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show. Amends the Criminal Code of 1961. Provides that a person who knowingly sells or gives any firearm to any person who is a street gang member is guilty of a Class 1 felony. Effective immediately.

CREDIT CARDS-UNSOLICITED

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it shall be an unlawful practice to knowingly mail, send, or cause to be mailed an unsolicited application for a credit card to a recipient in the State unless the front of the envelope in which the application was sent contains language that allows a recipient to opt out of future unsolicited applications from the sender. Provides that it shall be an unlawful practice under the Act for a sender who has already received an opt out request from a recipient in the State to knowingly mail, send, or cause to be mailed an unsolicited application for a credit card to that recipient.

CHILD-SAFE CHEMICALS ACT

Creates the BPA-Free Kids Act. Beginning June 1, 2011, prohibits the sale or distribution of certain products containing bisphenol-A. Requires a label to be affixed to the exterior of certain food products. Beginning June 1, 2011, prohibits the sale of products that must be, but are not, labelled. Authorizes the Illinois Environmental Protection Agency and the Illinois Department of Public Health to participate in an interstate chemical safety clearinghouse. Requires certain notifications and imposes penalties. Provides for enforcement by the Attorney General. Defines "Agency", "baby food", "Department", "infant formula", "manufacturer", "person", and "reusable food or beverage container".
