INC TX-RATE DECREASE

Amends the Illinois Income Tax Act. Decreases the rate of tax on individuals and on trusts and estates from 3% to 2.85% in 2008, 2.7% in 2009, and 2.5% in 2010 and thereafter. Decreases the rate of tax on corporations from 4.8% to 4.56% in 2008, 4.32% in 2009, and 4% in 2010 and thereafter. Makes corresponding changes. Effective immediately.

CNTY CD-TOWNSHIP DISCONNECT

Amends the Counties Code. Provides that, in Cook County, one or more contiguous townships may be disconnected from the county and may form a new county. Provides that the disconnection must be approved by referendum. Preempts home rule powers. Effective immediately.

CD CORR-GOOD CONDUCT CREDIT

Amends the Unified Code of Corrections. Provides that a prisoner who is serving a term of imprisonment for being an armed habitual criminal shall receive no good conduct credit and shall serve the entire sentence imposed by the court (rather than no more than 4.5 days of good conduct credit for each month of his or her sentence of imprisonment).

CON AMEND-REDISTRICTING

Proposes to amend the Legislature Article of the Illinois Constitution. Provides that the State Board of Elections shall produce a redistricting plan using a computer program. In the year following each Federal decennial census year, requires the State Board of Elections to designate its computer program by April 15 and to file the redistricting plan by June 1, which is presumed valid and has the force and effect of law. The computer program designated by the State Board of Elections must disregard specified data and must consider certain prioritized factors; the computer program shall otherwise produce districts in a random manner. Effective beginning with redistricting in 2011 and applies to members elected in 2012 and thereafter.

VEH CD-TRAFFIC SIGNAL PREEMPT

Amends the Illinois Vehicle Code. In provisions prohibiting installation of a traffic control signal preemption device on a motor vehicle, transportation of such a device in the passenger compartment of a motor vehicle, or operation of such a device by the driver or passenger of a motor vehicle, except as permitted by statute, increases the penalty from a Class A misdemeanor to a Class 4 felony and the fine from $1,000 to $2,000. In provisions prohibiting a retailer or manufacturer from selling a traffic control signal preemption device for any intended use, other than those permitted by statute, increases the penalty from a Class A misdemeanor to a Class 4 felony and the fine from $5,000 to $10,000.

CUSTODY-GAL,EVALUATOR-TRAINING

Amends the Illinois Marriage and Dissolution of Marriage Act. Requires 3 hours of domestic violence training for: a guardian ad litem in a custody proceeding; a professional from whom the court seeks advice; and an evaluator in a proceeding for custody, visitation, or removal of a child from Illinois. Provides that the training in domestic violence and its effects shall be provided by a State-certified local domestic violence shelter or domestic violence counselor. Provides that after completion of the training, the participant shall file a training certificate with the clerk of the court. Effective immediately.

EPA-LUST-CORRECTIVE ACTION

Amends a Section of the Environmental Protection Act involving Petroleum Underground Storage Tanks. Provides that site investigation completion reports must be made available, upon request, to any person with an ownership interest in a remediation site or the property on which the remediation site is located. Makes changes to the remediation process, including requiring public hearings, when remediation objectives have not been achieved within the specified time period. Provides that if all applicable remediation objectives have not been achieved at a site within 10 years after completion of the site investigation, the Illinois Environmental Protection Agency, in collaboration with the Pollution Control Board, must hold a public hearing to determine whether the responsible owner or operator will either (i) pay the Agency to conduct the proper corrective action or (ii) purchase the site from the current site owner for the site's fair market value. Effective immediately.

STATEWIDE GANG DATABASE

Amends the Statewide Organized Gang Database Act. Provides for reports of police contact with organized gang members or organized gang affiliates. Allows all State's Attorneys to access the database. Authorizes intergovernmental agreements. Requires all local law enforcement agencies to become members of the SWORD system.

Amends the General Assembly Operations Act. Provides that if a bill or other legislative measure is sponsored or co-sponsored by a majority of the members elected to the chamber in which the bill or other legislative measure then resides, then that bill or other legislative measure must be referred by the Rules Committee of that chamber to a standing committee and a vote on that bill or other legislative measure must be taken by that standing committee within 6 session days or prior to any committee action or floor action deadline that has been imposed in that chamber, whichever is sooner.
