AQUIFER PROTECTION ACT

Creates the Data Center Water Transparency and Aquifer Protection Act. Provides that, beginning January 1, 2027, no data center operating within the State shall use water from the Mahomet Aquifer. Prohibits State agencies from issuing or renewing a permit authorizing a data center to withdraw groundwater from the Mahomet Aquifer. Requires existing data centers to transition to alternative water sources and cease all groundwater withdrawals from the Mahomet Aquifer by no later than January 1, 2028. Provides that a unit of local government may not enter into, enforce, or renew any nondisclosure agreement, confidentiality clause, or similar contractual provision with a data center that restricts the disclosure of information related to the data center's water use. Contains provisions concerning data confidentiality and public access. Establishes penalties for violations. Grants the Illinois Environmental Protection Agency rulemaking powers.

INC TX-EDUCATION

Amends the Illinois Income Tax Act. Creates an income tax credit for taxpayers who are the custodians of one or more children who attend an eligible preschool program in the State during the taxable year. Provides that the amount of the credit shall be 100% of the eligible expenses incurred by the taxpayer during the taxable year in sending the child to the eligible preschool program, but not to exceed $1,500 per child. Effective immediately.

PROP TX-TIF INFO ON BILL

Amends the Property Tax Code. Provides that each tax bill shall contain a statement for each tax increment financing (TIF) district in which the property is located setting forth the amount that each taxing district that contains all or part of the TIF district would have received for the taxable year in the absence of the TIF district. Effective immediately.

PROHIBITED FOOD ADDITIVES

Amends the Illinois Food, Drug and Cosmetic Act. Provides that, beginning January 1, 2027, a person or entity shall not manufacture a food product for human consumption that contains brominated vegetable oil, potassium bromate, propylparaben, or red dye 3. Provides that, beginning January 1, 2028, a person or entity shall not sell, deliver, distribute, hold, or offer for sale a food product for human consumption that contains any of those substances. Provides that a person or entity that violates the prohibition shall be liable for a civil penalty not to exceed $5,000 for a first violation and not to exceed $10,000 for each subsequent violation, with enforcement by the Attorney General or a State's Attorney. Makes a conforming change.

CONTROLLED SUB-FENTANYL

Amends the Illinois Controlled Substances Act. Makes structural and other changes to the list of controlled substances. Adds xylazine as a Class III controlled substance. Defines "isomer". Effective January 1, 2026.

INS-GENETIC TESTING & SCREEN

Amends the Illinois Insurance Code. Makes changes to defined terms. Provides that a group policy of accident and health insurance or managed care plan that is amended, delivered, issued, or renewed after January 1, 2026 shall provide coverage for evidence-based cancer imaging for individuals with an increased risk of cancer as recommended by the current National Comprehensive Cancer Network clinical practice guidelines. Provides that this coverage shall be provided without cost-sharing, and the requirements of the Act shall not apply to the extent that providing coverage would disqualify a high-deductible health plan from eligibility for a health savings account.

WELL SEPTIC HOUSING TASK FORCE

Creates the Private Well, Septic, and Water Infrastructure Housing Impact Task Force Act. Establishes a Task Force to study the impacts of new residential development on private wells, septic systems, groundwater quality, drinking water safety, and related environmental and public health concerns. Provides for membership appointed by legislative leaders and the Governor, including members representing local government interests, environmental and development sectors, technical experts, and relevant State agencies. Requires the Task Force to examine issues including septic capacity, groundwater protection, contamination risks, intergovernmental coordination, and homeowner education. Requires the Environmental Protection Agency and the Department of Public Health to provide administrative support. Directs the Task Force to submit a report with findings and recommendations to the Governor and the General Assembly by December 31, 2027. Dissolves the Task Force and repeals the Act on January 1, 2029.

Declares October 2026 as Youth Substance Use Prevention Month in the State of Illinois to bring awareness to youth substance use and to provide the youth of Illinois with the support they need to lead healthy lives and achieve their dreams.

INC TX-HEALTH INSURANCE CREDIT

Amends the Illinois Income Tax Act. Creates an income tax credit for a qualified employer who makes a qualified contribution toward a health reimbursement arrangement for the qualified taxpayer's employees. Provides that the amount of the credit is $400 per covered employee in the first taxable year and $200 per covered employee in the second taxable year. Effective immediately.

Declares September 2026 as Muscular Dystrophy Awareness Month in the State of Illinois to raise awareness of all forms of muscular dystrophy and to encourage education, public understanding, and continued research related to the many subtypes of muscular dystrophy.
