EPA-GREENHOUSE GASES

Amends the Environmental Protection Act. Reverts provisions regarding greenhouse gases to the language existing before changes made by amendment under P.A. 102-662. Repeals a provision defining "clean energy". Effective immediately.

DCEO-BUSINESS ASSIST REFORM

Amends the Business Assistance and Regulatory Reform Act. Modifies requirements concerning the Office of Business Permits and Regulatory Assistance. Provides that the Office shall implement reforms to improve interagency coordination and encourage expeditious permit issuance. Provides that the Office shall use information technology tools to track project schedules and metrics in order to improve transparency and accountability of the permitting process, reduce uncertainty and delays, and reduce costs and risks to taxpayers. Modifies and adds requirements concerning the expediting of permit reviews. Provides for the creation of an Interagency Permitting Advisory Committee. Provides additional requirements to improve the coordination of permit reviews. Defines terms. Makes other changes.

DATA CENTERS-FOREIGN OWNERSHIP

Creates the Data Center Construction by Foreign Adversaries Act. Provides that no foreign company may construct or cause to be constructed a data center in the State unless the Illinois Commerce Commission, the Illinois Power Agency, and the Department of Commerce and Economic Opportunity conduct a joint study of the energy consumption of the prospective data center and certify to the Governor and the General Assembly that the energy used by the new data center is a new self-generated load and does not affect the load supply of PJM or MISO. Provides that the term "foreign company" means an entity that (i) is at least 51% owned by a foreign adversary or (ii) is headquartered in a country with a government that is a foreign adversary.

ENERGY-GENERATION TASK FORCE

Creates the Illinois Regional Generation Reliability Task Force Act. Sets forth findings of the General Assembly. Creates the Illinois Regional Generation Reliability Task Force. Provides that the Task Force shall monitor the reliability of the Illinois power grid. Contains provisions concerning: the membership of the Task Force; duties of the Task Force; administrative support; and an annual report. Effective immediately.

DIAPER LABELING ACT

Creates the Diaper Labeling Act. Provides that, no later than 12 months after the effective date of the Act, each package or box containing diapers sold in the State shall contain a plain and conspicuous printed list of all ingredients in order of predominance that shall either be printed on the package or box or affixed to the package or box. Provides for a civil penalty of 1% of a violator's total annual in-State sales of diapers not to exceed $1,000 per package or box. Defines "ingredient" and "diaper".

SCH CD-ASTHMA MEDICATION

Amends the School Code. In provisions concerning the administration of asthma medication, epinephrine injectors, opioid antagonists, and oxygen, provides that "trained personnel" includes athletic coaches and trainers. Allows a pupil with asthma to self-administer and self-carry the pupil's asthma medication at a school-sponsored athletic practice or game. Allows a school nurse or trained personnel to administer undesignated asthma medication to a person at a school-sponsored athletic practice or game. Requires a school district, public school, charter school, or nonpublic school to maintain a supply of asthma medication in a secure location that is accessible before, during, and after school where a person is most at risk on account of physical activity. Requires at least one member of an athletic coach's staff at a school and any athletic trainers at that school to complete the training curriculum relating to the administration of undesignated asthma medication.

USE/OCC TX-VENDOR DISCOUNT

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, if the retailer or serviceman reports less than $50,000 in sales during the month for which the return is filed, then the vendor's discount for that retailer or serviceman shall be 3.5% (currently, 1.75%) of the amount collected or $5 per calendar year, whichever is greater. Effective immediately.

INC TX-STANDARD EXEMPTION

Amends the Illinois Income Tax Act. Provides that, for taxable years beginning on or after January 1, 2026, the additional standard exemption for taxpayers who have attained the age of 65 before the end of the taxable year and their spouses is $2,000 (currently, $1,000). Effective immediately.

DCEO-DATA CENTERS

Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. In provisions concerning data center incentives, provides that, as a condition of receiving and maintaining a data center certificate of exemption, the Department of Commerce and Economic Opportunity shall require that the qualified data center operator execute and comply with a community benefit agreement with the host community in which the qualified data center is located. Provides that the community benefit agreement shall require the qualified data center operator to make annual minimum payments to the host community. Provides that the amount of the minimum host community payments may exceed but shall be at least 10% of the property tax that would have been levied against the qualified data center property, irrespective of any exemptions, abatements, or exclusions applicable to the property, for the year immediately preceding the year in which the community benefit agreement is entered into. Provides that not less than 50% of the amounts received from the special payments shall be used to provide payments, credits, rebates, or other financial benefits to eligible homestead property owners for the purpose of offsetting residential tax burdens. Effective immediately.
