PEN CD-ART 3 & 4 INVESTMENTS

Amends the Illinois Pension Code. Provides that no more than 30% of a downstate police or downstate fire pension fund's assets may be invested in debt obligations of corporations subject to specified conditions. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

GOMB-FY10 BUDGET SAME FY03

Amends the State Finance Act. Provides that, within 15 days after the effective date of this amendatory Act, the Governor's Office of Management and Budget shall prepare, and submit to all 4 legislative leaders, as one or more appropriation bills a budget for fiscal year 2010 that proposes appropriations that total no more than the total appropriations made for fiscal year 2003 from State funds, net of vetoes, except for appropriations for education and for developmental disabilities services, and that proposes appropriations that total no more than the total appropriations made for fiscal year 2009 from State funds, net of vetoes, for education and for developmental disabilities services. Effective immediately.

SMK FREE IL ACT-COMPLAINTS

Amends the Smoke Free Illinois Act. Provides that any person who registers a complaint under the Act must disclose his or her name. Effective immediately.

SCH CD-AUTISM SCHOLARSHIP PROG

Amends the School Code. Establishes the Autism Scholarship Program to permit the parent of a qualified special education child the choice to send the child to a special education program, instead of the one operated by or for the school district in which the child is entitled to attend school, to receive the services prescribed in the child's individualized education program once the individualized education program is finalized. Requires the State Board of Education to pay a scholarship of up to $20,000 to the parent of each qualified special education child upon application. Provides that each scholarship shall be used only to pay tuition for the child on whose behalf the scholarship is awarded to attend a special education program that implements the child's individualized education program and that is operated by an alternative public provider or by a registered private provider. Contains provisions concerning limitations on the amount, award, and use of a scholarship, transportation costs, payments, approval of private providers, and rules. Effective immediately.

NO OSLAD GRANTS FOR DEMOLITION

Amends the Open Space Lands Acquisition and Development Act. Provides that grants under the Act may not be used for the purpose of demolishing residential or commercial buildings that are fit for human occupancy. Effective immediately.

ZERO-BASED BUDGETING

Amends the State Budget Law of the Civil Administrative Code of Illinois. Defines "zero-based budgeting" as a method of setting budgets that requires a justification of all expenditures, not only those that exceed the prior year's allocations. Thus, each budget line begins at a zero base and must be funded according to merit rather than according to the level approved for the preceding year, when circumstances were probably different. For fiscal year 2010, Provides that the budgets submitted by the Governor and appropriations made by the General Assembly for the following agencies must adhere to the principles of zero-based budgeting: the Department of Labor, the Historic Preservation Agency, the Department of Human Rights, the Department of Agriculture, and the Environmental Protection Agency. For fiscal year 2011 and thereafter, provides that the budgets submitted by the Governor and appropriations made by the General Assembly for all agencies under the jurisdiction of the Executive Ethics Commission must adhere to the principles of zero-based budgeting. Effective immediately.
