WORKERS COMPENSATION-VARIOUS

Amends the Workers' Compensation Act and the Workers' Occupational Diseases Act. Makes numerous changes as follows: provides that an injury by accident is compensable only if the accident was the prevailing factor in causing both the resulting medical condition and disability; makes changes regarding notice of accidents; makes changes in computation of compensation paid to certain employees who, before the accident for which an employee claims compensation, had sustained an injury; makes changes regarding review of awards; limits certain cumulative awards for partial disability; provides for certification of permanent partial or total disability by physicians; provides that no compensation is payable for certain injuries involving alcohol or drugs; changes qualifications for Illinois Workers' Compensation Commission commissioners and arbitrators; contains provisions regarding evidentiary matters and statutory construction; makes changes regarding the duties of the Workers' Compensation Advisory Board; requires performance audits of arbitrators; and provides that an employer and the exclusive representative of its employees may agree to establish binding obligations and procedures relating to workers' compensation. Makes other changes. Effective immediately.

UTILITIES-RENEWABLE ENERGY

Amends the Public Utilities Act. Requires an electric utility to procure or obtain renewable energy resources in amounts equal to provided quantities. Requires an electric utility to report to the Illinois Commerce Commission regarding compliance with renewable energy resource standards by April 1 of each year beginning in 2008. Provides penalties for an electric utility that fails to procure or obtain the full amount of renewable energy resources as required by specified provisions. Provides that the Commission shall adopt rules as necessary within 12 months after the effective date of the amendatory Act to assist in implementing methods of procurement, accounting, tracking, and reporting in order to achieve the stated objectives. Provides that electric utilities may enter into long-term contracts of up to 20 years with providers of renewable energy resources. Provides that the provisions shall not prohibit an electric utility from issuing a competitive solicitation for renewable energy resources in order to meet the required standards. Effective immediately.

PUB LABR-CONFIDENTIAL EMPLOYEE

Amends the Illinois Public Labor Relations Act. In the definition of a "confidential employee", provides that (i) a secretary, assistant, or one of like position to a person who formulates, determines, and effectuates labor relations policy is presumed to be a confidential employee and (ii) specified elected and appointed executive officers, managers, and administrators of units of local government are persons who formulate, determine, and effectuate labor relations policy.

DISABILITY SAVINGS POOL

Creates the Developmental Disability Savings Pool Act and amends the Illinois Income Tax Act. Requires the State Treasurer to establish and administer a Developmental Disability Savings Pool to supplement and enhance the investment opportunities otherwise available to persons seeking to finance the future care and maintenance of a beneficiary who suffers from a developmental disability. Sets forth requirements for the savings pool. Provides that assets of the Developmental Disability Savings Pool and its income are exempt from all taxation by the State of Illinois and any of its subdivisions and the distributions from the savings pool are exempt so long as they are used for the qualified care and maintenance of the designated beneficiary. Amends the Illinois Income Tax Act to create deductions for taxpayers who are individuals or trusts or estates for contributions to, interest earned on, and distributions from the Developmental Disability Savings Pool. Exempts these deductions from the Act's sunset provisions. Effective immediately.

Amends the State Employee Indemnification Act. Includes as "employees" for State indemnification purposes Department of Children and Family Services contractors providing child welfare services. Effective immediately.
