CRIMINAL CODE-DEATH PENALTY

Amends the Criminal Code of 1961. Provides that before a jury makes a determination with respect to the imposition of the death penalty, the court shall instruct the jury of the applicable alternative sentences that the court may impose for first degree murder if the jury precludes the death sentence. Provides that the jury shall weigh the factors in aggravation and mitigation to decide if death is the appropriate sentence (instead of determining that there are no mitigating factors sufficient to preclude the imposition of the death sentence.) Provides that in cases where there is no jury, the court shall weigh the factors in aggravation and mitigation, to decide if death is the appropriate sentence (instead of determining that there are no mitigating factors sufficient to preclude the imposition of the death sentence.) Provides that if the court does not concur with the jury determination that death is the appropriate sentence, the court shall set forth reasons in writing and shall impose a term of natural life imprisonment.

IL SPORTS FACIL AUTH-EMPLOYMNT

Amends the Illinois Sports Facilities Authority Act. Provides that any contract extended or renewed by the Illinois Sports Facilities Authority for services provided at a sports facility constructed or financed under the Act shall require the contractor to recognize an exclusive representative for purposes of collective bargaining when the representative demonstrates a showing of majority interest by employees in a unit of eligible employees performing labor for the contractor under the contract on the basis of dues deduction authorizations (except in the case of dues deduction authorizations that are fraudulent or obtained through coercion). Effective immediately.

MEDICAID-RX DRUGS-PRIOR APPROV

Amends the Illinois Public Aid Code. In provisions concerning pharmacy payments under the Medicaid program, provides that the Department of Public Aid may not impose prior approval requirements for antidepressants or other drugs used in treating serious mental illnesses (deletes the provision allowing imposition of such requirements after conducting an impact study). Requires continuous access to medications. Makes other changes, and makes the provisions concerning prior approval inoperative after December 31, 2006. Effective immediately.

MEDICAID-RX DRUG THERAPEUTICS

Amends the Illinois Public Aid Code. With respect to the Medicaid program, directs the Department of Public Aid to establish a Prescription Drug Therapeutics Committee to review and either approve or reject the Department's prescription drug policies and management practices.

PROFESSNL TCHR STANDARDS BOARD

Amends the School Code. Creates the Professional Teacher Standards Board consisting of 11 members appointed by the Governor to administer the Article of the School Code governing the certification of teachers and other certificated school personnel and the approval of teacher and administrator preparation programs. Gives the Professional Teacher Standards Board all powers and duties currently exercised by the State Board of Education and the State Teacher Certification Board with respect to administration of the certification and program approval process, and abolishes the State Teacher Certification Board. Authorizes the Professional Teacher Standards Board to employ an Executive Director and such other staff members as are necessary to exercise its powers and duties and carry out its functions. Provides that a Standard Certificate may be renewed based on proof of professional development (instead of on proof of continuing education or professional development). Makes other changes. Effective July 1, 2003.

SCH AID FORMULA-CONTINU APPROP

Amends the State Aid Continuing Appropriation Law. Makes the Law applicable to fiscal year 2004 and each fiscal year thereafter. Provides that if the General Assembly fails to make Common School Fund appropriations to the State Board of Education in fiscal year 2004 and in each fiscal year thereafter sufficient to fund the general State aid, supplemental general State aid, and supplementary grants in aid provisions of the State aid formula, the Law shall constitute an irrevocable and continuing appropriation from the Common School Fund of all amounts necessary for those purposes. Removes a provision that provides for the Law's repeal on June 30, 2003. Effective immediately.

MEDICAID-MANAGED CARE-CHOICE

Amends the Illinois Public Aid Code. Provides that by January 1, 2005, the Department of Public Aid must implement enhancements to the managed care portion of the Medicaid program so that it contains (i) a requirement to choose between enrollment in a managed care plan and enrollment in the fee-for-service program, (ii) an annual 30-day open enrollment period, and (iii) provisions for a default assignment to a managed care plan (in counties with 2 or more managed care plans accepting Medicaid recipients as enrollees) or the fee-for-service program (in counties with fewer than 2 such managed care plans). Effective immediately.
