HLTH CARE JUSTICE-TASK FORCE

Creates the Health Care Justice Act. Provides that by July 1, 2007, the State of Illinois shall implement a health care access plan that provides access to a full range of preventive, acute, and long-term health care services and contains other features. Establishes the Adequate Health Care Task Force with members appointed by the Governor. Provides for public hearings and requires a final report from the Task Force by March 15, 2006. Requires enactment of legislation by December 31, 2006. Effective July 1, 2004.

CD CORR-SENTENCE/PROSTITUTION

Amends the Unified Code of Corrections. Requires the court, at the sentencing hearing of the defendant, to afford certain persons affected by any of the following offenses committed by the defendant an opportunity to make a statement concerning the impact of the offense on the victim and to offer evidence in aggravation or mitigation: Class 4 felony violations of prostitution, soliciting for a prostitute, keeping a place of prostitution, patronizing a prostitute, patronizing a juvenile prostitute, or pimping.

CRIM CD CORR-DEFACEMENT

Amends the Criminal Code of 1961 and the Unified Code of Corrections. Requires that the parent or guardian of a child who commits criminal defacement of property perform community service simultaneously with the child to cleanup and repair the damage to property that was defaced.

UTILITIES-REPORT TO ICC

Amends the Public Utilities Act. Provides that every public utility that provides gas or electric service to residential customers as primary or secondary sources of heating or cooling must report all of the following information annually in writing to the Illinois Commerce Commission: (1) the number of accounts that are past due each month, (2) the aggregate amount of past due balances each month, (3) the number of disconnection notices issued to residential customers each month, (4) the number of residential customers disconnected each month, (5) the number of residential customers eligible for emergency services under the Energy Assistance Act each year, and (6) the aggregate amount of arrears that are written off as bad business debt each year. Effective January 1, 2005.

SEX OFFENDER INFO

Amends the Sex Offender and Child Murderer Community Notification Law. Provides that a manager of a condominium or of an apartment building shall post in a conspicuous place in the common areas of the condominium or apartment building a notice as to how a unit owner or renter can obtain information about persons who are registered as sex offenders under the Sex Offender Registration Act, including how to access information maintained in the Statewide Sex Offender Database that is posted on the Department of State Police Web site. Effective immediately.

CRIM CD-TRANSFER-FIREARMS

Amends the Criminal Code of 1961. Changes references in the statute on unlawful sale of firearms from "sell" or "give" to "transfer". Prohibits multiple sales of handguns within a 30-day period. Creates the offense of unlawful acquisition of handguns. Prohibits a person, other than a person holding a license under the Federal Gun Control Act of 1968, from acquiring more than one handgun within a 30-day period. Provides exemptions and affirmative defenses. Penalty is a Class A misdemeanor for a first offense and a Class 4 felony for a second or subsequent offense.

RESIDENTIAL RENTERS RIGHTS ACT

Creates the Residential Renters' Rights and Responsibilities Act. Applies to residential tenancies. Contains provisions regarding: creation of tenancies; rights and responsibilities of landlords and tenants; the rights of tenants to organize; changes in the terms of tenancies; termination of tenancies; security deposits; court actions; and other matters.

HOUSING-NEW TEACHERS

Amends the Illinois Housing Development Act. Authorizes the Illinois Housing Development Authority to develop and implement a program of financial assistance to recently hired Illinois teachers purchasing their first primary residence. Limits the program to teachers employed by school districts defined by the State Board of Education as financially needy or experiencing a teacher shortage. Limits eligibility to public school teachers with no more than 2 years of employment as teachers who commit to teach in their school district for at least 3 years after their closing date. Effective July 1, 2003.

DCFS-PHOTOGRAPH CONDITIONS

Amends the Children and Family Services Act. Requires that photographs of the physical conditions of a potential foster or adoptive home must be included in any final recommendation submitted by the Department of Children and Family Services for judicial determination of placement of a child. Requires that Department personnel must be provided with the necessary cameras and training.

CHILDHOOD HUNGER RELIEF

Creates the Childhood Hunger Relief Act and amends the School Breakfast and Lunch Program Act. Requires the board of education for certain school districts to utilize available federal funding to establish a school breakfast program and a summer food service program. Provides that applications for participation in the school food programs shall be filed with the State Board of Education and information about the child's status shall be provided by the Department of Human Services upon written request. Makes changes concerning the breakfast incentive program. Effective immediately.
