Amends the Children and Family Services Act. Creates the DCFS Children's Mental Health Services Trust Fund. Provides that beginning on the effective date of this amendatory Act, any funds paid to the State by the federal government under Title XIX and Title XXI of the Social Security Act for child welfare services delivered by community mental health providers, certified as Medicaid providers by the Department of Children and Family Services pursuant to specified provisions in the Illinois Administrative Code, for child welfare services relating to Medicaid-eligible clients and families served consistent with the purposes of the Department of Children and Family Services, including services delivered as a result of the conversion of such providers from a comprehensive rate to a fee-for-service payment methodology, and any subsequent revenue maximization initiatives performed by such providers, and any interest earned thereon, shall be deposited directly into the DCFS Children's Mental Health Services Trust Fund. Provides that the Trust Fund shall not be subject to sweeps, administrative charge-backs, including but not limited to, those authorized under specified provisions of the State Finance Act, or any other fiscal or budgetary maneuver that would in any way transfer funds from the Trust Fund into any other fund of the State, except as otherwise provided. Provides that the Department of Children and Family Services shall satisfy certain reporting requirements. Effective immediately.
Appropriates $10,000,000 from the General Revenue Fund to the Local Health Protection Grant Fund. Effective July 1, 2009.
Appropriates the amount of $950,000 from the General Revenue Fund to the State Board of Education to support the launch of a new statewide toll-free Parent Helpline administered by the agency designated by the Governor pursuant to the Protection and Advocacy for Developmentally Disabled Persons Act. Effective July 1, 2010.
Creates the Retail Consumer Protection Act. Provides that certain businesses engaged in retail commerce must make best efforts to have at least one designated employee responsible for ensuring the accuracy of posted and advertised prices and resolving customer complaints related to the accuracy of prices. Provides that any person engaged in retail commerce who is alerted by a customer of overcharging must immediately report the overcharge to their on-site management or supervisor, who then must investigate the alleged error and keep a record of the incident. Limits the concurrent exercise of home rule powers.
Amends the Ambulatory Surgical Treatment Center Act, the Home Health, Home Services, and Home Nursing Agency Licensing Act, the Hospital Licensing Act, and the State Finance Act. Increases the licensure fee to $1500 for ambulatory surgical treatment centers and home health agencies. Establishes a $50 licensure fee per bed for hospitals applying for a license. Changes the name of the Home Care Services Agency Licensure Fund to the Home Health, Health Services, and Home Nursing Agency Licensure Fund. Creates the Ambulatory Surgical Treatment Center Fund and the Hospital Licensure Fund. Effective immediately.
Amends the MR/DD Community Care Act. Includes the size of the facility licensed under the Act to the list of factors the Director of Public Health is to consider when making a determination as to possible penalties for a violation. Effective July 1, 2010.
Amends the State Finance Act. Provides that certain payments for medical, pharmaceutical, and child care services may be paid out of appropriations for those purposes for a fiscal year if the services were rendered in that fiscal year (now, without regard to the fiscal year in which rendered). Allows payment during a 4-month lapse period after the end of the fiscal year.
Amends the Nursing Home Care Act. Makes a technical change in a Section concerning facilities for persons with disabilities or disorders.
Appropriates $300,000 from the General Revenue Fund to the State Board of Education for the assessment of physical fitness levels of students. Effective July 1, 2009.
