LIQUOR-ORDERING CLOSURE

Amends the Liquor Control Act of 1934. Provides that, if the local liquor control commissioner in a municipality with a population of 1,000,000 or more inhabitants has reason to believe, based upon the occurrence of criminal activity, that any continued operation of the premises poses an excessive risk to the health, safety, or welfare of the community, then the local liquor control commissioner may order, without notice or hearing, that a licensed premises be closed for up to 30 days, giving the licensee an opportunity to be heard during that period. Provides that if the sale of alcoholic liquor is incidental to the sale of food or other goods and services, then the order shall only apply to the sale of alcoholic liquor. Effective immediately.

HEALTH FACILITIES-VARIOUS

Amends the Illinois Health Facilities Planning Act. Reorganizes the provisions concerning definitions. Authorizes the Health Facilities and Services Review Board ("State Board") to prescribe and provide forms pertaining to the State Board Staff Report. Provides that a State Board Staff Report shall pertain to applications that include, but are not limited to, applications for permit or exemption, applications for permit renewal, applications for extension of the obligation period, applications requesting a declaratory ruling, and applications under the Health Care Worker Self-Referral Act. Further provides that the State Board staff shall submit its State Board Staff Report to the State Board for its approval or denial of a permit. Provides that the State Board shall transcribe each State Board meeting using a certified court reporter and the transcript shall contain the record of the findings and decisions of the State Board. Further provides that State Board members shall provide their rationale when voting on an item before the State Board at a State Board meeting and that the transcript of the State Board meeting shall be incorporated into the Board's final decision. Deletes references to the Department of Public Health and replaces those references with the State Board. Makes other changes. Effective immediately.

CHILD SAFE E-CIGARETTES

Amends the Illinois Poison Prevention Packaging Act. Provides that electronic cigarette cartridges and liquids sold and marketed for the refilling of e-cigarette cartridges may be sold only in special packaging. Provides that the Department of Public Health shall adopt rules establishing the standards for special packaging to be used for e-cigarette products. Effective immediately.

DHS-HOME HEALTH WORKERS

Amends the Illinois Public Labor Relations Act. Removes all references to personal care attendants. Amends the Disabled Persons Rehabilitation Act. In provisions concerning the Department of Human Services' Home Services Program, removes the changes made to those provisions by Public Acts 97-732 and 97-1158 and reinserts and reconciles those changes with the changes made by Public Act 97-1019 as follows: Removes references to personal care attendants. Requires the Department to set rates and fees under the Home Services Program in a fair and equitable manner and to pay the same rate for services identical to those offered by the Department on Aging. Provides that home care and home health workers who function as personal assistants and individual maintenance home health workers under the Department's Home Services Program shall be considered public employees under the Illinois Public Relations Act. Requires the State to engage in collective bargaining with an exclusive representative of home care and home health workers who function as personal assistants and individual maintenance home health workers working under the Home Services Program. Makes other changes. Transfers provisions concerning the Home Services Medicaid Trust Fund from the Mental Health and Developmental Disabilities Administrative Act to the Disabled Persons Rehabilitation Act. Effective immediately.

MOBILE STRUCTURE SAFETY

Amends the Illinois Manufactured Housing and Mobile Home Safety Act. Changes the title of the Act to the Illinois Modular Dwelling and Mobile Structure Safety Act. Changes the definition of "manufactured home" and "mobile home". Provides that nothing in the Act prohibits a city, town, village, township, or county from adopting construction standards for mobile structures or modular dwellings under local ordinances, provided such ordinances incorporate the rules adopted under the Act and are approved by the Department of Public Health. Provides that the Department may impose an administrative penalty against any person who violates the Act or any rule adopted under the Act, or who violates any determination or order of the Department under the Act. Provides that the Department shall establish violations and penalties by rule, with each day's violation constituting a separate offense. Provides that the Department may inspect manufactured homes, require correction of violations, and perform other duties as stated in the federal Manufactured Home Procedural and Enforcement Regulations and the federal Manufactured Housing Construction and Safety Standards of 1974. Provides for civil and criminal penalties for violations of specified federal regulations. Provides that the Director of the Department of Public Health, after notice and opportunity for hearing to an applicant or seal holder, may deny, suspend, or revoke a seal, or assess civil penalties in conformance with the provisions of the Act, in any case in which he or she finds that there has been a substantial failure to comply with the provisions of the Act or the standards, rules, and regulations under the Act. Provides that all fees and penalties collected under the Act shall be deposited into the Facility Licensing Fund. Repeals a provision concerning the advisory council on mobile homes and manufactured housing. Effective immediately.

WAGE PAYMENT PAYROLL CARD

Amends the Illinois Wage Payment and Collection Act. Establishes requirements for the use of payroll cards by employers. Provides that receipt of wages by means of a payroll card may not be a condition of employment. Requires certain disclosures to be made to employees before using payroll cards. Requires the offer of an alternative means of payment to be available. Establishes limits on fees. Effective January 1, 2015.

SCH CD-HEROIN USE TASK FORCE

Amends the School Code. Requires the Young Adults Heroin Use Task Force to conduct a study on the heroin use problem in grades 6 through 12 (instead of in high schools); makes related changes. Effective immediately.

EARLY INTERVENTION SERVICES

Amends the Early Intervention Services System Act. Provides that all early intervention services shall be initiated as soon as possible, but not later than 30 days after parental consent has been obtained for the Individualized Family Service Plan. Provides that services may be initiated later than 30 days after parental consent has been obtained if the multidisciplinary team determines that a later initiation date is necessary in order to meet the individual needs of the child and family, the child's parent provides informed written consent for the later initiation date, and the reasons for the later initiation date are documented by the multidisciplinary team. In provisions concerning procedural safeguards, provides that a child shall continue to receive the appropriate early intervention services during the pendency of any State complaint procedure, due process hearing, or mediation (instead of any proceedings or action) involving a complaint, unless the State agency and the parents or guardian otherwise agree. Effective immediately.

DCFS-CHILD CUSTODY-FICTIVE KIN

Amends the Children and Family Services Act. Expands the definition of "relative" to include a fictive kin. Defines "fictive kin" to mean any individual, whether related or unrelated by birth or marriage, who is shown to have close personal or emotional ties with the child or the child's family prior to the child's placement with the individual. Requires a fictive kin with whom a child is placed to apply for licensure as a foster family home pursuant to the Child Care Act of 1969 within 6 months of the child's placement with the fictive kin. Provides that by January 1, 2015, the Department of Children and Family Services shall promulgate rules establishing criteria and standards for placement, identification, and licensure of fictive kin.

Amends the Beer Industry Fair Dealing Act. Includes within the definition of the term "beer" all beverages brewed or fermented wholly or in part from malt products.
