Amends the Consumer Deposit Account Act. Requires financial institutions with assets of more than $100,000,000 to extend basic checking services to under-served and low-income residents for direct deposit with the institution by third parties with no service charges, minimum balance, or minimum deposit requirements. Allows institutions to charge for stop payment orders and to deny no cost services to persons who have had a checking account closed, within 3 years, by an institution for insufficient funds. Effective immediately.
Amends the Tobacco Accessories and Smoking Herbs Control Act. Provides that a person may not knowingly sell, distribute, or offer for sale or distribution in this State or to any person in this State any tobacco product or any component part thereof (including but not limited to the tobacco, paper, or filter, and any components for roll-your-own cigarettes), which contains a constituent (including a smoke constituent) or additive or artificial or natural flavoring that produces a characterizing flavor. Provides that a violation is a Class C misdemeanor.
Creates the Cancer Drug Repository Program Act. Requires the Department of Public Health to establish a cancer drug repository program, under which any person may donate a cancer drug or supplies needed to administer a cancer drug for use by an individual who meets eligibility criteria specified by the Department. Sets forth requirements that cancer drugs or supplies must meet in order to be accepted and dispensed under the program. Provides that no drugs or supplies donated under the cancer drug repository program may be resold. Provides that nothing in the Act requires that a medical facility, pharmacy, pharmacist, or practitioner participate in the cancer drug repository program. Provides for civil and criminal immunity for drug and supply manufacturers and individuals in relation to the donation, acceptance, or dispensing of cancer drugs or supplies under the cancer drug repository program. Requires the Department to adopt certain rules to implement the cancer drug repository program. Amends the Pharmacy Practice Act of 1987, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in donating or accepting, or packaging, repackaging, or labeling, prescription drugs to the extent permitted or required under the Cancer Drug Repository Program Act are exempt from provisions of those other Acts that might prohibit or otherwise regulate such activity.
Amends the Illinois Vehicle Code and the State Finance Act. Provides that the Secretary of State, in compliance with the federal REAL ID Act, may issue a driver's certificate that clearly states on its face that it may not be accepted by any federal agency for federal identification or any other official purpose. Provides that the driver's certificate must be distinguishable from a driver's license or permit. Provides that one of these driver's certificates may be issued to an applicant who is an immigrant residing in this State, is ineligible to obtain a social security number, and is ineligible to receive a driver's license. Establishes requirements for the application. Provides that an applicant for one of these certificates must pay an additional fee of not less than $50, to be set by the Secretary of State by rule, to be deposited into the Secretary of State Immigrant Driver's Certificate Fund. Creates the Secretary of State Immigrant Driver's Certificate Fund as a special fund in the State treasury. Provides that moneys deposited into the fund shall, subject to appropriation, be used by the Secretary of State to pay for the additional costs associated with immigrant applicants for driver's certificates. Provides that a person denied a driver's certificate may seek administrative review. Provides that a driver's certificate may not be used to obtain a Firearm Owner's Identification Card or a driver's license from another state. Provides that the Secretary of State shall, in conjunction with the Illinois State Police, establish administrative procedures for determining and identifying ineligible Firearm Owner's Identification Card applicants to ensure compliance with the Firearm Owners Identification Card Act. Provides for severability of the bill's provisions. Effective immediately.
Appropriates $950,000 to the Department of Commerce and Economic Opportunity to develop and administer work therapy pilot programs for homeless adults. Effective July 1, 2008.
Amends the Environmental Protection Act. Makes a technical change in a Section concerning the short title.
Amends the Code of Civil Procedure. Makes a technical change in a Section regarding the short title of the Article concerning mortgage foreclosures.
Amends the Illinois Noxious Weed Law. Makes a technical change in a Section concerning the short title of the Act.
Amends the Electronic Fund Transfer Act. Provides that no person operating a terminal in this State shall impose any surcharge exceeding $2 on a consumer for the usage of that terminal. Provides that no financial institution operating a terminal under the laws of this State, or that serves as a depositary of State funds as authorized by the Deposit of State Moneys Act, shall impose any surcharge exceeding $2 on a consumer for the usage of that terminal. Provides that no surcharge may be imposed unless it is first disclosed to the consumer (i) by a sign that is clearly visible to the consumer on or at the terminal being used and (ii) electronically on the terminal screen. Provides that, as used in the provision, "surcharge" means any charge imposed by the person or financial institution (instead of just the person) operating the terminal solely for the use of the terminal. Effective immediately.
