VEH CD DRIVER ED OMNIBUS

Amends the Illinois Identification Card Act. Provides that the card prepared by the Secretary of State shall include the signature or mark of the applicant. Amends the School Code. Deletes language providing that a school district may provide an equivalent alternative to 6 hours of individual behind-the-wheel instruction in its driver education course. Amends the Illinois Vehicle Code. Provides that the fact that a vehicle does or does not qualify as a charitable vehicle does not determine whether or not the driver is required to have a commercial driver's license. Provides that the Secretary of State (rather than the circuit court) imposes a statutory summary suspension of a driver's privileges for violations relating to alcohol or other drugs. Provides that a graduated driver's license or permit shall not be issued to a person under the age of 18 years who has committed the offense of driving without a valid license or permit in another state or who has been convicted of or adjudicated delinquent based upon a violation of the Use of Intoxicating Compounds Act. Provides that the driver's license issued to an applicant shall bear the applicant's signature. Provides that the photograph and signature on a driver's license, permit, or identification card may be disclosed to out of state law enforcement officials. Provides that the Secretary shall revoke the license of any person convicted a second or subsequent time of driving while his or her license was revoked for the offense of reckless homicide. Makes other changes. Amends the Child Passenger Protection Act with regard to which persons are required to secure a passenger under the age of 19 in a seat safety belt or child restraint system. Effective July 1, 2008.

CRIM PRO-BAIL DEPOSITS

Amends the Code of Criminal Procedure of 1963. Provides that when the conditions of the bail bond have been performed and the accused has been discharged from all obligations in the cause, the clerk of the court shall return to the accused or to the defendant's designee, 80% (rather than 90%) of the sum which had been deposited and shall retain as bail bond costs 10% of the amount deposited. Provides that the county sheriff shall retain the remaining 10% of the amount deposited for sheriff's office operations. Provides that in no event shall the amount retained by the sheriff as sheriff's office operations be less than $5. Effective immediately.

INTERNET CRIMES

Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Creates in the Department of State Police the Internet Crimes Enforcement Unit to investigate criminal offenses committed by use of the Internet. Provides that the Department of State Police shall establish a toll-free hotline for members of the public to report alleged Internet crimes to be investigated by the Internet Crimes Enforcement Unit. Amends the State Finance Act. Creates the Internet Predator Investigation and Prosecution Fund in the State treasury. Amends the Criminal Code of 1961. Extends the prohibition of posting identifying information on an adult obscenity or child pornography site without the consent of the person to all Internet sites. Prohibits the use of encryption to commit or assist in committing a criminal offense. Prohibits contacting a child under 16 years of age by means of the Internet and the contact involves explicit verbal descriptions or narrative accounts of a sexual nature. Amends the Harassing and Obscene Communications Act and the Unified Code of Corrections. Provides enhanced penalties for harassment by electronic communications and child pornography. Provides that a defendant who commits a crime using the Internet shall be assessed an additional $200 fine which shall be deposited into the Internet Predator Investigation and Prosecution Fund and shall be used by the Illinois Child Exploitation Task Force to assist in the training, investigation, and prosecution of Internet crime.

CRIM CD-SALE FIREARMS

Amends the Criminal Code of 1961. Provides that a person 18 years of age or older convicted of unlawful sale of firearms by selling or giving a concealable firearm to a person under 18 years of age or by selling or giving a firearm of any size to a person under 18 years of age who does not possess a valid Firearm Owner's Identification Card, when the firearm that was sold or given to another person under 18 years of age was used in the commission of or attempt to commit a forcible felony, shall be fined or imprisoned, or both, not to exceed the maximum provided for the most serious forcible felony so committed or attempted by the person under 18 years of age who was sold or given the firearm. Effective immediately.

MOTOR VEHICLE-RELEVANT MARKET

Amends the Motor Vehicle Franchise Act. Changes the definition of "relevant market area" to remove language allowing for the area of responsibility to be defined in the franchise agreement. Effective immediately.

VEH CD-SUPPORT TROOPS PLATES

Amends the Illinois Vehicle Code and the State Finance Act. Provides for the issuance of Support Our Troops license plates for an additional fee of $40 at original issuance and $27 at renewal. Provides that $25 of these fees shall be deposited into the Support Our Troops Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Creates the Support Our Troops Fund as a special fund in the State treasury. Provides that all moneys in the Support Our Troops Fund shall be paid as grants to Illinois Support Our Troops, Inc., for charitable assistance to the troops and their families in accordance with its Articles of Incorporation. Provides that the State Finance Act provision allowing the transfer of moneys from other funds into the General Revenue Fund does not apply to moneys deposited into the Support Our Troops Fund. Effective immediately.
