VEH CD-INSRUANCE: LIABILITY

Amends the Illinois Vehicle Code. Provides that if it is established that the renter or an authorized driver is not able to return the original keys to the vehicle (instead of "failed to exercise ordinary care while in possession of the vehicle"), damages for the loss of a rental vehicle due to theft shall be the actual and reasonable costs of the rental vehicle up to its fair market value.

DNR POLICE-IRAQ AFGHAN VET

Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois. Provides that the requirement that a Conservation Police Officer have certain collegiate educational requirements is deemed to be satisfied if the applicant has been honorably discharged and has been awarded an Afghan or Iraqi campaign medal by one of the United States armed forces. Effective immediately.

CRIM CD, CRIM PRO-RICO

Amends the Criminal Code of 1961. Adds the Illinois Street Gang and Racketeer Influenced and Corrupt Organizations Law (RICO) as a new Article of the Code. Provides that it is unlawful for any person: (1) who is employed by or associated with any enterprise, knowingly to conduct or participate, directly or indirectly, in such enterprise's affairs through either a pattern of predicate activity (specified criminal offenses) or the collection of unlawful debt; or (2) knowingly to acquire or maintain, directly or indirectly, through either a pattern of predicate activity or the collection of unlawful debt, any interest in, or control of, to any degree, of any enterprise, real property, or personal property of any character, including money. Establishes criminal penalties and civil remedies. Provides that any violation of the Article is subject to the remedies, procedures, and forfeiture as set forth in the money laundering statute. Effective immediately.

CRIM PRO - STATE APP. DEFENDER

Amends State Appellate Defender Act. Deletes the discretionary duty of the State Appellate Defender to provide assistance to trial counsel in capital cases. Adds the discretionary duty to provide training, assistance of expert witnesses, and investigators to public defenders from funds appropriated for those purposes. Prohibits the State Appellate Defender from being appointed as trial counsel. Deletes authority of investigators for the Capital Trial Assistance Unit and Capital Post Conviction Unit to access the Law Enforcement Agencies Data System (LEADS) for witness background checks. Deletes the authority for the State Appellate Defender to request appropriations from the Capital Litigation Trust Fund for capital case expenses in assisting trial counsel, representing petitioners in post-conviction proceedings, and in defending cases in counties other than Cook County. Effective immediately.
