Rep. Natalie Manley

Amends the Illinois Pension Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, the Voluntary Health Services Plans Act, the Illinois Public Aid Code, the Crime Victims Compensation Act, the Illinois Marriage and Dissolution of Marriage Act, the Emancipation of Minors Act, the Adoption Act, the Probate Act of 1975, and the Line of Duty Compensation Act. Replaces references to children born out of wedlock with references to nonmarital children and a reference to children born in wedlock with a reference to marital children. Prohibits the use of the word "nonmarital" in an adoption proceeding.

Amends the Criminal Code of 2012. Makes it a Class 1 felony aggravated battery when, in committing a battery, other than by the discharge of a firearm, a person knowingly causes great bodily harm or permanent disability or disfigurement to a victim whom the person knows to be a State's Attorney or Assistant State's Attorney. Makes it a Class X felony (mandatory 12 to 45 years imprisonment) aggravated battery when, in committing a battery, other than by the discharge of a firearm, a person knowingly causes severe and permanent disability which renders the victim incapable of independently performing basic life-sustaining functions. Makes it a Class 3 felony aggravated battery when, in committing a battery, other than by discharge of a firearm, a person knows the victim battered to be a State's Attorney or Assistant State's Attorney: (1) performing his or her official duties; (2) battered to prevent performance of his or her official duties; or (3) battered in retaliation for performing his or her official duties.

Amends the Property Tax Code. Provides that the Department shall not include compulsory sales occurring on or after January 1, 2013 in its sales ratio studies, unless the compulsory sale would otherwise be considered an arm's length transaction, based on existing sales ratio study standards. Effective immediately.

Amends the Code of Criminal Procedure of 1963. Provides that notwithstanding Illinois Supreme Court Rules, in a criminal proceeding, any property or material that constitutes child pornography shall remain in the care, custody, and control of either the State or the court. Provides that a court shall deny, in any criminal proceeding, any request by the defendant to copy, photograph, duplicate, or otherwise reproduce any property or material that constitutes child pornography, so long as the prosecution makes the property or material reasonably available to the defendant. Provides that property or material shall be deemed to be reasonably available to the defendant if the prosecution provides ample opportunity for inspection, viewing, and examination at a government facility of the property or material by the defendant, his or her attorney, and any individual the defendant may seek to qualify to furnish expert testimony at trial.

Amends the Tax Shelter Voluntary Compliance Law. Makes a technical change in a Section concerning the short title.

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice to claim that another has infringed upon a United States patent if the claim falsely threatens adverse administrative or judicial action, the assertions lack a reasonable basis in fact or law, the person making the assertion is not, or does not represent, a person with a current right to license the patent, or the claim fails to make certain other disclosures. Effective January 1, 2015.

Amends the Illinois Vehicle Code. Provides that person with disabilities parking placards or decals that are issued to veterans with a permanent disability shall not require evidence of disability for renewal.

Amends the Code of Civil Procedure. Provides that if a person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address, service of process may be effectuated by having the person serving the process mail a copy of the process via both regular and certified mail. Provides that service of the process shall meet the requirements of the Code set forth in Sections concerning forms of process and persons authorized to serve process; place of service; and failure to make return. Provides that the person serving the process shall execute and submit an affidavit confirming that the person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address and that the person serving the process has served the process in accordance with the new provisions.

Amends the Illinois Income Tax Act. Makes a technical change in a Section concerning the short title.

Amends the School Code. Requires the Young Adults Heroin Use Task Force to conduct a study on the heroin use problem in grades 6 through 12 (instead of in high schools); makes related changes. Effective immediately.
