SEX OFFENDER INFO

Amends the Sex Offender and Child Murderer Community Notification Law. Provides that a manager of a condominium or of an apartment building shall post in a conspicuous place in the common areas of the condominium or apartment building a notice as to how a unit owner or renter can obtain information about persons who are registered as sex offenders under the Sex Offender Registration Act, including how to access information maintained in the Statewide Sex Offender Database that is posted on the Department of State Police Web site. Effective immediately.

LOCGOV-PRIORITY & PLANNING

Amends the Local Planning Technical Assistance Act. Requires the Department of Commerce and Economic Opportunity, through the Opportunity Returns Economic Development Regions established by the Governor, to designate certain units of local government and areas of the State as regional priority funding areas in which State infrastructure resources should be focused. Requires the Department to give preference to certain units of local government and areas of the State. Authorizes the Department to make grants to units of local government designated as, or within areas designated as, regional priority funding areas for the expansion or improvement of public infrastructure. Authorizes a unit of local government designated as, or within an area designated as, a regional priority funding area to impose reasonable impact fees on private developers for public infrastructure outlays and to share in infrastructure maintenance costs. Authorizes the Department to promulgate rules necessary to implement and administer these provisions. Amends the Governor's Office of Management and Budget Act. Provides that if a Department or Agency of the State has received negative interagency review comments or findings, then the Office must review those comments and findings before funding may be authorized for the proposed project or activity. Amends the Regional Planning Commission Act and the Counties Code. Authorizes a county board to establish an Intergovernmental Cooperation Council to develop and recommend various plans for the coordination of land use, transportation, and infrastructure. Authorizes the Council to (i) serve as a county's regional planning commission, (ii) recommend future municipal boundaries, and (iii) recommend an intergovernmental review process for land use and a voluntary, non-binding resolution process for intergovernmental disputes over land use. Provides that a unit of local government in a county that has established a Council and has met other qualifications shall be given priority for State grants and State programs.

FIRE PROTECT DIST-OPEN BURNING

Amends the Fire Protection District Act. Provides that a fire protection district may not enforce an open burning ordinance (i) within the City of Chicago, (ii) within the boundaries of a farm that consists of more than 50 acres, and (iii) in a forest preserve district if the district personnel perform the open burning. Deletes the provision that a fire protection district may not enforce an open burning ordinance within the corporate limits of a county with a population of 3,000,000 or more or a municipality with a population of 1,000,000 or more.

PASSENGER RAIL COMPACT

Creates the Midwest Interstate Passenger Rail Compact Act. Provides for a Commission composed of 4 members from each participating state and meeting at least once a year. Provides that the Commission is empowered to perform certain duties concerned with interstate passenger rail improvements. Provides that the Commission shall receive moneys necessary to carry out its functions as appropriated by the participating states. Provides that Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Nebraska, North Dakota, Ohio, South Dakota, and Wisconsin are eligible to join the compact as well as for a method for other states to join. Provides for a method of withdrawal and default from the compact.

CHILD PRODUCT SAFETY-RECALLS

Amends the Children's Product Safety Act. Provides that a "children's product" is one designed or intended for the care of or use by a child under age 12 (instead of under age 6). Replaces the definition of "commercial user" with a definition of "commercial dealer", which includes one who manufactures children's products. Imposes requirements on commercial dealers in children's products with respect to product recalls. Provides that a commercial dealer who violates the Act is subject to a civil penalty not to exceed $1,000 for each day the violation continues (instead of providing that a commercial user who willfully and knowingly violates the Act is guilty of a Class C misdemeanor). Provides that nothing in the Act relieves a commercial dealer from compliance with stricter requirements imposed by a federal agency. Makes other changes. Effective immediately.

HOUSING-NEW TEACHERS

Amends the Illinois Housing Development Act. Authorizes the Illinois Housing Development Authority to develop and implement a program of financial assistance to recently hired Illinois teachers purchasing their first primary residence. Limits the program to teachers employed by school districts defined by the State Board of Education as financially needy or experiencing a teacher shortage. Limits eligibility to public school teachers with no more than 2 years of employment as teachers who commit to teach in their school district for at least 3 years after their closing date. Effective July 1, 2003.

IDPH-SEWAGE DISPOSAL LICENSING

Amends the Private Sewage Disposal Licensing Act. Provides that any person who constructs, installs, modifies, repairs, maintains, operates, or services a private sewage disposal system or transports and disposes of waste removed from the private sewage disposal system is subject to the Environmental Protection Act and its rules in addition to the Private Sewage Disposal Licensing Act and the private sewage disposal code. Provides that no person or private sewage disposal system contractor may install a surface discharging private sewage disposal system, unless the Department of Public Health determines that no feasible alternative to the surface discharging private sewage disposal system is available and the owner of the system fulfills specified requirements. Requires the Department to amend the private sewage disposal code. Provides that no person may operate a surface discharging private sewage disposal system, unless specified conditions are met. Provides for deposit of fees collected under the Act into the Private Sewage Disposal Program Fund. Prohibits the Department from issuing approval of a new surface discharge system on a property platted or recorded after July 1, 2005, unless the Department of Public Health determines that no feasible alternative to the surface discharging private sewage disposal system is available and the owner of the system fulfills specified requirements. Adds to and amends the list of powers and duties of the Department of Public Health under the Act. Amends the State Finance Act to create the Private Sewage Disposal Program Fund as a special fund in the State treasury. Effective immediately.
