Rep. John Cabello

Amends the Illinois Public Aid Code. Provides that any person who possesses for an unlawful purpose another person's Electronic Benefit Transfer card (EBT) or LINK card in order to use or transfer in any manner not authorized by law or the rules and regulations of the Department of Human Services the cash assistance benefits held on that EBT or LINK card is guilty of a violation and shall be subject to certain penalties established under the Code. Effective immediately.

Amends the State aid formula provisions of the School Code. Provides that on days when a school district is celebrating homecoming or prom, the day of attendance for a pupil whose school day is shortened to accommodate any planning or festivity may be less than 5 clock hours and shall be counted towards the 176 days of actual pupil attendance required under the Code. Effective July 1, 2015.

Amends the Criminal Code of 2012. Makes technical changes in a Section concerning the definition of "severely or profoundly intellectually disabled person".

Amends the Fish and Aquatic Life Code. Provides that the fee for all sport fishing licenses shall be waived for resident veterans of the United States Armed Forces that have been honorably discharged. Amends the Wildlife Code. Provides that the fee for a hunting license to hunt all species shall be waived for resident veterans of the United States Armed Forces that have been honorably discharged. Effective immediately.

Creates the Peace Officer Motor Vehicle Pursuit Act. Provides that a peace officer is authorized to initiate a motor vehicle pursuit when the officer is able to articulate a reason to believe the occupant of a fleeing vehicle: (1) has committed or attempted to commit a forcible felony involving the infliction or threatened infliction of great bodily harm; (2) is attempting to escape by use of a deadly weapon or an object or device that the peace officer reasonably believes to be a deadly weapon; or (3) otherwise indicates he or she will endanger human life or inflict great bodily harm unless apprehended immediately. Provides that a peace officer engaged in a motor vehicle pursuit shall activate both the rotating or flashing lights and the siren of his or her police vehicle. Provides that a peace officer who is driving a police vehicle equipped with a video camera shall ensure the camera is activated at all times while engaged in a pursuit or fleeing and eluding incident. Provides for police officer pursuit training. Preempts home rule. Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that neither a local public entity nor a public employee is liable for an injury caused by a peace officer motor vehicle pursuit conducted in good faith under the requirements of the Peace Officer Motor Vehicle Pursuit Act, unless the pursuit was conducted by the peace officer in a willful and wanton manner. Amends the Department of State Police Law of the Civil Administrative Code of Illinois and the Illinois Police Training Act to make conforming changes. Effective January 1, 2017.

Amends the Firearm Owners Identification Card Act. Provides that a resident of any other state who is 18 years of age or older and who is not prohibited by the laws of Illinois, the state of his or her domicile, or the United States from obtaining, possessing, or using a firearm, may purchase or obtain ammunition for a rifle or shotgun in Illinois. Provides that a resident of any other state who is 21 years of age or older and who is not prohibited by the laws of Illinois, the state of his or her domicile, or the United States from obtaining, possessing, or using a firearm, may purchase or obtain ammunition for a handgun in Illinois.

Amends the Illinois Vehicle Code. Provides that if effectuating a written acknowledgment from a person requested to submit to a test for driving under the influence of drugs or alcohol would pose a clear and imminent risk of great bodily harm to the officer, the person requested, or another person, the officer shall document the incident in a police report in lieu of acquiring a written acknowledgement. Provides that if a person requested to submit to a test is incapacitated or unconscious, the officer shall make a written notation that the person was unable to acknowledge in writing and document the incident in a police report.

Amends the Criminal Code of 2012. Increases various penalties for aggravated battery. Provides that aggravated battery by causing great bodily harm or permanent disability or disfigurement to any child under the age of 13 years, or to any severely or profoundly intellectually disabled person is a Class X felony for which a person shall be sentenced to a term of imprisonment of a minimum of 20 years and a maximum of 60 years. Provides that aggravated battery by causing great bodily harm or permanent disability or disfigurement is a Class X (rather than a Class 1) felony when the aggravated battery was intentional and involved the infliction of torture. Increases other penalties for aggravated battery.

Amends the Arsonist Registration Act. Provides that the arsonist registration fees shall be used by the registering agency for paying the costs of police training (rather than official purposes). Provides that the Act applies throughout the State to arsonists who reside, are employed, or attend school anywhere in this State (rather than the City of Chicago until the Department of State Police establishes I-CLEAR throughout the State).

Designates the Centennial Bridge in Rock Island as the "Master Sgt. Stanley W. Talbot Memorial Bridge".
