Rep. John Cabello

Amends the State aid formula provisions of the School Code. Provides that on days when a school district is celebrating homecoming or prom, the day of attendance for a pupil whose school day is shortened to accommodate any planning or festivity may be less than 5 clock hours and shall be counted towards the 176 days of actual pupil attendance required under the Code. Effective July 1, 2016.

Amends the State Finance Act. Changes the repeal date of provisions concerning the Capital Development Board Revolving Fund to July 1, 2020 (currently, July 1, 2016). Amends the Capital Development Board Act. Makes a conforming change. Effective immediately.

Amends the Illinois Public Aid Code. Provides that any person who possesses for an unlawful purpose another person's Electronic Benefit Transfer card (EBT) or LINK card in order to use or transfer in any manner not authorized by law or the rules and regulations of the Department of Human Services the cash assistance benefits held on that EBT or LINK card is guilty of a violation and shall be subject to certain penalties established under the Code. Effective immediately.

Amends the Illinois Identification Card Act. Provides that for those who apply for a standard Illinois Identification Card upon release as a committed person on parole, mandatory supervised release, aftercare release, final discharge, or pardon from the Department of Corrections or Department of Juvenile Justice, the Secretary of State shall issue a standard Illinois Identification Card at the time of release (rather than after submission of an identification card issued by the Department of Corrections or the Department of Juvenile Justice) to all released eligible individuals. Defines "released eligible individuals". Amends the Unified Code of Corrections. Provides that the Department of Corrections or the Department of Juvenile Justice shall verify a released person's full name, date of birth, and social security number, and provide that information to the Secretary of State for the purpose of issuing standard Illinois Identification Cards to released eligible individuals under the Illinois Identification Card Act. Provides that the Department of Corrections or the Department of Juvenile Justice shall report annually to the Governor and the General Assembly the percentage of persons released from custody without a valid standard Illinois Identification Card. Discontinues the issuance of identification cards by the Department of Corrections or the Department of Juvenile Justice to recently released persons. Makes conforming changes.

Amends the Criminal Code of 2012. Provides that a person commits criminal street gang recruitment when he or she recruits, solicits, or induces another person to join or remain a member of a criminal street gang. Provides that the penalty is a Class 4 felony. Provides that if the person recruited, solicited, or induced is a minor, the offense is a Class 3 felony. Defines "criminal street gang".

Amends the Criminal Code of 2012. Eliminates provision that prohibits the sale, manufacture, purchase, possession, or carrying of any weapon made from a rifle or shotgun, whether by alteration, modification, or otherwise, if such a weapon as modified has an overall length of less than 26 inches. Effective immediately.

Creates the Bone Marrow and Organ Donor Leave Protection Act. Provides that employees of private employers having 51 or more employees, units of local government, boards of election commissioners, school districts, any subdivisions thereof must permit employees to take leave for purposes of donating organs or bone marrow. Prohibits retaliation for taking leave. Authorizes 30 days of leave for organ donation and 5 days leave for bone marrow donation. Defines terms. Amends the Organ Donor Leave Act to prohibit retaliation for taking leave.

Amends the Illinois Lottery Law. Requires the Department of the Lottery, beginning on January 1, 2016 or as soon thereafter as is practical, to offer a special instant scratch-off game with the title of "The End of Alzheimer's Begins With Me". Requires the net revenue from that game to be deposited into the Alzheimer's Awareness Fund. Authorizes the Department to adopt rules necessary to implement and administer the game. Effective immediately.

Amends the General Obligation Bond Act. Provides that the unused portion of federal funds received for or as reimbursement for a capital facilities project (currently, the unused portion of federal funds received for a capital facilities project) shall remain in the Capital Development Board Contributory Trust Fund. Removes a provision providing that any federal funds received as reimbursement for the completed construction of a capital improvement project shall be deposited in the Capital Development Bond Retirement and Interest Fund. Amends the Capital Development Bond Act of 1972. Makes conforming changes. Effective immediately.

Amends the Illinois Lottery Law. Requires the Department of the Lottery, beginning on January 1, 2016 or as soon thereafter as is practical, to offer a special instant scratch-off game to benefit State police memorials. Requires the net revenue from that game to be deposited into the Criminal Justice Information Projects Fund. Provides that moneys received from the scratch-off game shall be divided equally for distribution into the Chicago Police Memorial Foundation Fund, the Police Memorial Committee Fund, and the Illinois State Police Memorial Fund. Provides that moneys received from the scratch-off game shall be used to fund grants for building and maintaining memorials and parks; holding annual memorial commemorations; giving scholarships to children of officers killed or catastrophically injured in the line of duty, or those interested in pursuing a career in law enforcement; and providing financial assistance to police officers and their families when a police officer is killed or injured in the line of duty. Authorizes the Department to adopt rules necessary to implement and administer the game. Defines "net revenue". Amends the Illinois Criminal Justice Act to make conforming changes. Effective immediately.
