GA CHAMBER MEMORIALS

Amends the General Assembly Operations Act. Authorizes the Speaker and Minority Leader of the House of Representatives and the President and Minority Leader of the Senate to provide permanent physical memorials in each chamber of the General Assembly in the Capitol to those members who died in office.

MNTL HLTH FACILITY-INVOL ADMIT

Amends the Mental Health and Developmental Disabilities Code. Provides that a peace officer may take a person into custody and transport him to a mental health facility when the peace officer has reasonable grounds to believe that the person is subject to involuntary admission and in need of immediate hospitalization (removes a requirement that the "reasonable grounds" be a result of the peace officer's personal observation). Provides that nothing in these provisions shall be interpreted to prevent (i) the filing of a petition for involuntary admission completed by the facility director or any other person or (ii) a decision by the petitioner or his or her counsel or the State's Attorney to proceed with a hearing on a petition for involuntary admission completed by someone other than the peace officer who transported the respondent to the facility. Effective immediately.

ENT ZONES-EXEMPT FROM IESA-NAP

Amends the Illinois Endangered Species Protection Act and the Illinois Natural Areas Preservation Act to provide that areas designated as Enterprise Zones under the Illinois Enterprise Zone Act that are located on a former U.S. military base that was closed in 1990 or thereafter are exempt from the provisions, duties, obligations, and penalties provided under these Acts. Effective immediately.

VEH CD-DEALER FEES

Amends the Illinois Vehicle Code with regard to new and used vehicle dealer license fees. Provides that the fee varies according to the number of vehicles sold by the dealer during the previous year. Provides that a dealer's license application shall indicate the number of vehicles sold by the dealer the previous year, supported by documentation prescribed by the Secretary of State. Sets a new schedule of license fees for new and used vehicle dealers, including one fee for the applicant's established place of business and a lower fee for each additional place of business, if any, to which the application pertains. Effective immediately.

$GAMING BD-E DUBUQUE BOAT

Appropriates $3,000,000 from the General Revenue Fund to the Illinois Gaming Board for distribution to the City of East Dubuque and JoDaviess County to compensate those entities for expenses they incurred for infrastructure improvements made to accommodate a riverboat within the City of East Dubuque. Effective July 1, 2006.

FINANCE AUTHORITY-LOAN PROGRAM

Amends the Illinois Finance Authority Act. Creates the Manure Management Guarantee Program. Provides that the Illinois Finance Authority is authorized to issue State Guarantees, secured by the Illinois Farmer and Agribusiness Loan Guarantee Fund, to lenders for loans to finance or refinance certain manure management programs for farmers who do not qualify for the federal Environmental Quality Initiatives Program. Provides that Guarantees may not exceed $15,000 per applicant and may be no longer than 5 years in duration. Contains provisions for the administration of the the program. Effective immediately.

INC TX-ETHANOL SALES CREDIT

Amends the Illinois Income Tax Act. Allows credits of $10,000 for high-impact ethanol retailers and high-impact biodiesel retailers. Defines "high-impact ethanol retailer" as a motor fuel retailer who has been certified by the Department as being one of the top 25 retailers in the sale of motor-fuel ethanol in the State during the previous calendar year, and defines "high-impact biodiesel retailer" as a motor fuel retailer who has been certified by the Department as being one of the top 25 retailers in the sale of biodiesel in the State during the previous calendar year. Provides that the credits may not be carried forward or back and may not reduce a taxpayer's liability to less than zero. Effective immediately.

VEHIC-USED CAR DEALER LICENSE

Amends the Illinois Vehicle Code. Provides that no used vehicle dealer license may be issued to any franchised motor vehicle dealer or any independent motor vehicle dealer owned by a franchised motor vehicle dealer or its dealer-operator and operated by the dealer-operator of a franchised motor vehicle dealer, unless the dealer-operator holds a valid certificate of qualification issued by the Secretary of State. Sets forth requirements for certification. Provides that certain dealers may obtain a license without examination. Provides that no license may be issued to any independent motor vehicle dealer unless the dealer-operator holds a valid certificate of qualification issued by the Secretary of State. Sets forth requirements for certification. Provides that the Secretary of State may establish minimum qualifications for applicants and, on and after January 1, 2007, shall require applicants for an original independent dealer-operator license to complete a course curriculum and to pay set course fees. Provides that the Secretary of State may approve qualified persons to prepare and present the courses and to administer the examination.
