RENEWABLE FUELS PROGRAMS

Amends the Illinois Renewable Fuels Development Program Act. Provides that a recipient of Program grants must be constructing, modifying, altering, or retrofitting an (i) ethanol plant (now, just plant) that has annual production capacity of no less than 30,000,000 gallons of renewable fuel per year or a (ii) biodiesel plant. Requires the Department of Commerce and Economic Opportunity to establish and administer grant programs including: the Illinois Renewable Fuels Majority Blended Ethanol Program, the Illinois Corn Grain to Fuel Research Consortium Assistance Program, the Illinois Renewable Fuels Corn-to-Hydrogen Fuel Cell Research Program, the Illinois Renewable Fuels Biodiesel Infrastructure Grant Program, the Illinois Renewable Fuels Ethanol Development Intergovernmental Assistance Program. Sets forth the purposes and conditions for these grant programs. Provides that subject to appropriation (now, subject to appropriation from the Build Illinois Bond Fund), the Director is authorized to award Renewable Fuels Development Program Fund grants. Sets forth that the annual aggregate amount for these grants shall not exceed $25,000,000 in Fiscal year 2007 and 2008 and $15,000,000 thereafter (now, may not exceed $15,000,000). Specifies how these grant funds shall be allocated. Sets forth certain limitations on spending on the various Program grants including for research conducted at the National Corn-to-Ethanol Research Facility at SIU-Edwardsville not to exceed $1,000,000 annually, and a one-time grant in FY 2007 not to exceed $3,000,000 for construction, remodeling, and expansion of the National Corn-to-Ethanol Research Facility at SIU-Edwardsville. Provides that normal operating and execution of renewable fuels programs in existence on January 1, 2006 within the Department from the Renewable Fuels Development Program Fund shall not exceed $5,000,000 annually. Amends the State Finance Act to create the Renewable Fuels Development Program Fund as a special fund in the State treasury to fund these grant programs. Sets forth certain conditions for the operation of this Fund. Provides for certain annual payments from the General Revenue Fund to the Renewable Fuels Development Program Fund. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act, to provide that on or after July 1, 2006 and on or before June 30, 2016, those tax rates apply to 90% of the proceeds of sales made on gasohol (now, apply to 80% of the proceeds of sales made on gasohol). Amends the Motor Fuel and Petroleum Standards Act to provide that beginning January 1, 2008 a minimum of 10% of all motor fuel sold or offered for sale in Illinois must be denatured ethanol and that beginning January 1, 2012 a minimum of 15% of all motor fuel sold or offered for sale in Illinois must be denatured ethanol. Effective July 1, 2006.

IDHS - HOMEMAKER REGISTRY

Amends the Disabled Persons Rehabilitation Act. Provides that the Department of Human Services shall establish and maintain a publicly accessible online registry of all homemakers who are currently employed through a Community Care Program homemaker provider. Sets forth the requirements for the registry, including: (i) the name of the homemaker, (ii) his or her current address, (iii) the date and location of the pre-service training completed by the individual, (iv) the date of the individual's last criminal background check, and (v) the date and location of all in-service training completed by the individual. Provides that the Department shall update this registry on a quarterly basis. Effective January 1, 2006.

Amends the Unified Code of Corrections. Requires that a person convicted of an offense that results in injury to a victim shall be ordered to pay for the medical and dental costs incurred by the victim in seeking treatment for those injuries inflicted by the person convicted.

MEDICAID-NURSING HOME RATES

Amends the Illinois Public Aid Code. Provides that under the Medicaid program, the Department of Public Aid's standards of payment for long-term care must take into account a nursing facility's transactions with related individuals or entities, including overpayments made to a related individual or entity. Provides for deductions from the Medicaid reimbursement otherwise due a nursing facility if the facility (i) had combined transactions with related individuals and related entities totaling more than 10% of the facility's total expenses for a fiscal year or (ii) made payments to a related entity that exceeded the entity's operating costs for a fiscal year. Provides that in determining payment rates for long-term care, the Department shall assure the opportunity for a profit not to exceed 10% of a facility's total revenue for a fiscal year (instead of simply "a profit"). Provides for deductions from the Medicaid reimbursement otherwise due a facility if the facility (i) failed to apply any profits in excess of 10% of revenues to patient-care-related expenses or (ii) paid a salary to a person holding an ownership interest in the facility or in a related entity that exceeded 1% of the facility's Medicaid reimbursement. Effective January 1, 2006.

DEPT ON AGING-HEALTHCARE

Amends the Illinois Act on the Aging. Provides that beginning January 1, 2007, the Department shall pay an additional $1.33 per hour of chore/housekeeping and homemaker service performed by a chore/housekeeping and homemaker service provider vendor to all vendors who certify that they will offer health insurance to all qualifying employees, and their dependents. Requires the amount of funding, for years after 2007, to be adjusted by the amount of which the medical component of the Consumer Price Index exceeds such component for the previous calendar year. Defines a qualifying employee as an employee that provides over 100 hours of chore/housekeeping and homemaker services per month for 3 consecutive months. Requires that chore/housekeeping and homemaker service provider vendors must certify that 50% of their workforce is eligible for coverage as a qualifying employee. Provides that the Department must set minimum standards for a qualifying health plan by rule. Sets forth that provider vendors who fail to offer coverage to all qualifying employees shall be subject to penalties up to and including the requirement to return all moneys paid under this paragraph by the State as prescribed by Department rule.

PROP TX-VETERAN AMNESTY

Amends the Property Tax Code. Provides that a member of the armed forces of the United States, other than a reserve component, on active duty on the due date of any installment of taxes due under the Property Tax Code shall not be deemed delinquent in the payment of the installment until 90 days after the due date or, if the member is deployed outside the continental United States, 90 days after the member is redeployed to the continental United States. Provides that members of the reserve components of the armed forces of the United States or members of the National Guard who are on active duty shall not be deemed delinquent in the payment of the installment until 90 days (now, 30 days) after the member returns from active duty. Deletes provisions concerning an amnesty period in Cook County for certain National Guard members for taxes on homestead property due and payable in 1991 or 1992. Effective immediately.

COMMUNTY & HOME CARE-ELIGBLITY

Amends the Illinois Act on the Aging and the Disabled Persons Rehabilitation Act. In provisions for a community care program of services to prevent unnecessary institutionalization of persons age 60 and older, persons with Alzheimer's disease and related disorders, and persons in need of long-term care who are established as blind or disabled, provides that the eligibility standards for the services must include a provision that, to be eligible for services, a person may not have assets totaling more than $15,000 in FY06, $17,500 in FY07, and $20,000 in FY08 and thereafter if (i) the person is unmarried or (ii) the person is married and the person or the person's spouse meets certain criteria. Provides that if the person is married and the person's spouse does not receive community care services, the person may not have assets totaling more than the asset disregard amount used by the Department of Public Aid in determining eligibility for medical assistance under the Illinois Public Aid Code. Provides that a person who does not meet the eligibility standards for services to prevent unnecessary institutionalization because of excess assets may establish eligibility for those services by paying a monthly amount to the Department on Aging or Department of Human Services as a spend-down or deductible. Effective immediately.

LOTTERY-INTERNET PILOT PROGRAM

Amends the Illinois Lottery Law. Provides that the Department of Revenue shall create a pilot program that allows Illinois residents to purchase Illinois lottery tickets on the Internet. Provides that the Act and the rules adopted pursuant to the Act pertaining to the sale of lottery tickets apply to the sale of lottery tickets under this program. Amends the Criminal Code of 1961. Provides that the exemption from conviction of gambling for lotteries when conducted by the State of Illinois in accordance with the Illinois Lottery Law includes any activity conducted by the Department of Revenue to sell lottery tickets pursuant to the provisions of the Illinois Lottery Law and its rules. Provides that persons who purchase lottery tickets through the Internet in connection with the Department of Revenue's pilot program shall not be convicted of gambling.
