CTY CD-MUNI CD-REBATE OCC TAX

Amends the Counties Code and the Illinois Municipal Code. Provides that, on and after June 1, 2004, neither a county board nor the corporate authorities of a municipality nor a retailer may enter into any agreement to share or rebate any portion of retailers' occupation taxes generated by retail sales of tangible personal property if: (1) the tax on those retail sales, absent the agreement, would have been paid to another unit of local government; and (2) the retailer maintains, within that other unit of local government, a retail location or a warehouse from which the tangible personal property is delivered to purchasers. Authorizes any unit of local government denied retailers' occupation tax revenue because of such an agreement to file an action in circuit court against the municipality or the county. Provides that if the unit of local government prevails in the circuit court action, it is entitled to damages in the amount of the tax revenue it was denied as a result of the agreement, statutory interest, costs, reasonable attorneys' fees, and an amount equal to 50% of the tax. Provides that any agreement to share or rebate retailers' occupation taxes entered into prior to June 1, 2004 is not affected by the provisions of the amendatory Act. Preempts home rule. Effective immediately.

IDPH-SAFE BOTTLED WATER

Creates the Safe Bottled Water Act and amends the State Finance Act. Requires that water-bottling plant and private water source operators obtain a license from the Department of Public Health, and imposes a license fee of $150. Imposes an additional fee of $50 for late submission of applications for licensure. Imposes like fees for the registration of out-of-state water-bottling plants. Prescribes minimum standards for various activities in connection with bottled water or vended water. Preempts the exercise of home rule powers in connection with the licensing of activities relating to bottled water. Authorizes the Department to conduct inspections and undertake other activities in connection with administering the Act, and makes it a Class A misdemeanor to interfere with a representative of the Department who is conducting an inspection or other authorized activity. Makes other violations of the Act a petty offense. Creates the Safe Bottled Water Fund, to consist of moneys paid to the Department of Public Health under the Safe Bottled Water Act and to be used by the Department for administering the Act. Effective January 1, 2005.

FED SUBSIDIZED HOUSNG PRESERVE

Amends the Federally Subsidized Housing Preservation Act. Changes the short title to the Federally Assisted Housing Preservation Act, and replaces references to "subsidized housing" with references to "assisted housing". Requires the owner of an assisted housing development to give 12 (instead of 6) months notice of the owner's intent to sell or otherwise dispose of the assisted housing; also requires notice of the owner's intent to complete prepayment or complete termination of the development's participation in a federal subsidy program or termination of the development's affordability restrictions. Provides for representation of a tenant association by a not-for-profit corporation or private purchaser. Requires that the owner offer the property for sale to a tenant association within 60 days after the association has complied with the requirements of the Act concerning notice to the owner. Requires that a tenant association notify the owner of its intent to purchase the property within 90 (instead of 30) days after receiving the owner's offer of sale. Effective immediately.

MUNI CD-ZONING-TELECOMMUNICTNS

Amends the Illinois Municipal Code. Deletes a provision prohibiting a municipality from exercising its zoning powers outside of the corporate limits of the municipality with respect to facilities of telecommunications carriers. Effective immediately.

ELECTION CODE 2004 ELECTION

Amends the Election Code. Authorizes the State Board of Elections to take such action as necessary to give effect to directions of the national committee of an established political party regarding certification of the Presidential and Vice Presidential candidate selected at the national nominating convention in 2004.

COMP REVIEW-REJECT COLA

With respect to the 2004 report of the Compensation Review Board, approves the report insofar as it does not recommend any increase in salary level, but reduces recommended cost of living adjustments in whole proportionately in accordance with Section 5 of the Compensation Review Act by rejecting cost of living adjustments based upon adjustments otherwise applicable beginning July 1, 2002 and July 1, 2003 under Senate Joint Resolution 192 of the 86th General Assembly. Rejects the Board's recommendation that it submit its reports in odd-numbered years, rather than even-numbered years.

CON AMEND GA-MEMBER-TERMS

Proposes to amend the Legislature Article of the Illinois Constitution. Changes the terms of members of the General Assembly. Provides that Senators elected in 2006 shall serve six-year terms. Provides that Senators elected in 2008 shall serve four-year terms. Provides that Representatives elected in 2006 shall first serve four-year terms and then two-year terms. Provides that Representatives elected in 2008 shall serve four-year terms. Provides that, beginning in 2012, in each ten-year period, Senators shall be divided into two groups. Provides that Senators in the first group shall first be elected for terms of six years and then for terms of four years. Provides that Senators in the other group shall first be elected for terms of four years and then for terms of six years. Provides that, beginning in 2012, Representatives shall first be elected for terms of four years, then for terms of two years, and then for terms of four years. Provides that whenever a seat in either house becomes vacant with more than 28 months remaining in the term, the vacancy shall be filled by appointment until the next general election, at which time a replacement shall be elected to serve for the remainder of the term. Provides that the General Assembly shall be a continuous body for a period beginning and ending at noon on the second Wednesday of January of consecutive odd-numbered years. Effective upon being declared adopted. Applies to the election of General Assembly members in 2006 and thereafter; does not affect the terms of members elected in 2002 or 2004.

VITAL REC ACT-DEATH CERT PREG

Amends the Vital Records Act. Provides that a death certificate shall state whether the deceased was pregnant, regardless of whether a separate fetal death certificate was issued.

UNIFIED CHILD SUPPORT ACT

Creates the Unified Child Support Services Act. Provides that, on July 1, 2006, the Department of Public Aid shall delegate to the State's Attorney in each Illinois county with a population of 900,000 or more the responsibility for managing a Unified Child Support Services Program pursuant to an approved Plan for Unified Child Support Services and an intergovernmental agreement entered into between that county's State's Attorney and the Department. Requires the State's Attorney of each such county to submit a plan for a program by July 1, 2005 and each July 1 thereafter. Provides that, by July 1, 2007 or any July 1 thereafter, a State's Attorney in a county with a population of less than 900,000 may elect to submit a plan to the Department to manage a program. Provides that any State's Attorney who submits a plan must commit to manage a unified child support services program for at least 3 years. Sets out components that a unified child support services program must contain. Requires the Department to establish performance standards for State's Attorneys operating a program. Requires the Department to submit an annual report on the operations of the programs to the General Assembly.
